Dear Sir,
The Division of Water Resources (DWR) received a draft Bank Parcel Development Package
(BPDP) for three (3) sites: Upper Musselshell site, Musselshell site and Saints Delight site (Sites) in
2021, for review and approval under the terms and conditions of the Restoration Systems' Neuse 04
Nutrient Offset Umbrella Banking Instrument (NOBI). DWR reviewed the three (3) BPDP
documents and the NOBI and provided comments and recommendations. DWR received three (3)
revised BPDP documents and a revised NOBI that addressed all comments and recommendations.
Effective February 24, 2023, the NOBI was officially made and entered into by Restoration Systems,
LLC (RS) acting as the Bank Sponsor, and the DWR. The table below summarizes the timeline of
the three (3) BPDP documents and the NOBI:
