Army Corps of Engineers 151 Patton Avenue, Room 208 Asheville, NC 28801-5006 Subject: Application for Section 404 Nationwide Permits 13, 14, and 27 Reverification and Section 401 Water Quality Certification for the Proposed Caldwell Station Tributary Greenway, Mecklenburg County (USACE Action ID SAW-2020-01659; NCDWR #21-0131) Dear Mr. Perez: On behalf of Mecklenburg County Asset and Facility Management, WSP USA has completed a Pre -Construction Notification (PCN) application for the Caldwell Station Tributary Greenway project to request reverification of Nationwide Permits 13, 14 and 27 from the US Army Corps of Engineers (USACE) and the associated 401 Water Quality Certifications (WQC) from the North Carolina Division of Water Resources (NCDWR). The USACE issued an NWP verification for the project on August 18, 2021 and the NCDWR issued a 401 Water Quality Certification on December 8, 2021. The project was under contract to commence prior to the NWP verification expiration date of March 18, 2022, however, the previously authorized work in waters of the U.S. will not be completed within the 12-month extension period ending on March 18, 2023. There have been no changes to the project, which proposes to construct a new greenway trail, approximately 1.0 mile in length, that will connect the existing Caldwell Station Creek Greenway to the new Northern Regional Recreation Center. The greenway runs parallel to the Caldwell Station Tributary Creek, partially within a Duke Energy easement, and is designed to include two neighborhood connections, one at Caldwell Depot Road and one at Caldwell Track Drive, as well as a connection to an existing commercial development to the north. The proposed project will include a paved ten -foot wide greenway with two -foot shoulders, plantings, storm water controls, and culverts that will impact streams. Reinforced concrete box culverts will be installed at two stream crossings with instream work proposed at either end of the culverts to enhance the stream channel by increasing channel bed and bank stability and improving bedform diversity. A third stream will be piped and the stream channel filled as part of the greenway project. Total proposed permanent stream impacts include 106 linear feet of fill impact, 72 linear feet of culvert fill impact, 129 linear feet of stream enhancement, and 8 linear of stream bank stabilization. Total proposed temporary stream impacts include 73 linear feet. No wetland impacts are proposed. The proposed impacts to waters of the U.S. have not changed from the previous NWP and WQC approvals. The attached permit drawings are unchanged from the previous approvals. The County satisfied the mitigate obligation for 178 linear feet of stream impacts through purchase of 267 credits from the City of Charlotte Umbrella Wetland and Stream Mitigation Bank. There are two reinforced concrete box culvert crossings, at two separate locations, included in this project. Both crossings are 12'(w) x 9'(h) with a single rectangular barrel. Provide information for low -flow and storm -flow conditions through the proposed culverts. a. Low -flow calculations have been computed based on the low -flow channel dimensions which will be maintained through installation of sills/baffles. A sketch of these measures and the associated channel calculations are included below as Attachment A. b. Design storm discharges have been confirmed using appropriate USGS regression equations, and the culvert performance has been analyzed in HY-8. The culverts were analyzed to reflect an embedment depth of 12" as well as an additional 9"-12" of blockage for low -flow channel benches. As such, in the HY-8 models a representative embedment depth of 2' was utilized, to ensure a conservative capacity analysis. Calculations for storm flow conveyance are included as Attachment B. 3. Confirm base flow width and reflect this width in the low -flow channel design. a. Based on site observations, a low flow channel base width of 4' has been selected for the culvert at 25+95 (701-702). A base width of 3' has been selected for the culvert at 33+88 (901-902). 4. Ensure a good blend of materials (riprap, #57 stone, gravel, screenings, and sand/clay) are incorporated into the design for the channel bed. a. A revised bed mixture has been included in the plans for the channel (25% Class A riprap, 25% Class B riprap, 25% #57 stone, and 25% native materials). Permit drawing Figure 7 (constructed channel detail), has been revised to change the note regarding mixture of stream bed material. In addition, Figure 5A (plan view of Impact Sites S1 — S5) and Figure 6A (plan view of Impact Sites S6 to S8) have been revised to further clarify the design details. These revised figures are included in Attachment C. Note, there have been no changes to impact location, length or area. b. The low flow channel in the culvert (Attachment A) will also incorporate a mix involving larger stone. However, that stone is not intended to be exposed.
