Dear Ms. Chapman:
Please find attached a letter and three attachments detailing a recent ruling by the United States District Court for the
Eastern District of North Carolina vacating the Record of Decision for the proposed Garden Parkway toll highway due to
NCDOT’s reliance upon a single set of socio-economic data to analyze both “Build” and “No Build” scenarios.
Because the methodology used to analyze the Monroe Bypass contains a near identical flaw to that invalidated by the
District Court we ask that the Division of Water Resources revoke NCDOT’s Water Quality Certification for the Bypass
unless and until NCDOT has produced an analysis that separately forecasts growth for the “Build” and “No Build”
scenarios.
