Lutheran Cc: Hardin°, Kimberlee k; Dunn, Maria T.; Luck, Cameron A Subject: Shugart Dock Expansion (DWR#20221792) Date: Friday, February 17, 2023 1:43:00 PM Attachments: 20221792 Ver 1 DMF Comments 20230213 (2).pdf Good afternoon All, On December 20, 2022, the Division of Water Resources (DWR) received a Coastal Area Management Act (CAMA) major permit application from the Division of Coastal Management (DCM) requesting authorization of the expansion of an existing access pier and platform. The proposed expansion includes the installation of fixed finger piers to access two (2) boatlifts flanking the existing fixed platform and installation of a pilingless floating dock accessed by a dual hinge I-beam gangway secured with cables. The proposed floating dock would be located in waters ranging in depth from -1.2' to -0.5 to -0.75' at NLW. As proposed the boatlifts would be located in waters ranging from -0.2' to -0.3' at NLW. The proposed expansion would be located within the waters of Atlantic Intracoastal Waterway which are classified as SA,HQW by DWR and are designated as Primary Nursery Area (PNA) by the Division of Marine Fisheries (DMF). The Division of Water Resources (DWR) has additional questions regarding the proposed development and has determined that additional information will be necessary to complete the review of your permit application. The DWR has reviewed the attached comments submitted by the Division of Marine Fisheries (dated 1/30/23). The DMF memorandum recommends denial of the expansion of the access pier and platform. Please understand that development proposals located within designated PNA waters within must be consistent with 15A NCAC 02B .0220; 15A NCAC 02B .0222, 15A NCAC 02B .0224 which requires that conditions of waters be suitable for all best uses provided for in state rule (including, at minimum: aquatic life propagation, survival, maintenance of biological integrity, and fishing, fish, and Primary Nursery Area(PNAs) wildlife; secondary contact recreation; and that activities must not cause water pollution that precludes any best use on a short-term or long-term basis. The Division supports the concerns and recommendations from the Division of Marine Fisheries regarding impacts within waters of designated Primary Nursery Areas. Please revise your application in accordance with the recommendations of the resource agencies. If the concerns of the resource agencies are not resolved the DWR will move to deny your application as required by 15A NCAC 2H.0506. If these concerns and recommendations are addressed to the satisfaction of the DMF and WRC, the DWR will have no objection.
