Dear Mr. Peck:
I am responding to your request dated December 15, 2014 for modifications to the existing
Department of the Army (DA) permit issued for the above referenced project on November 19,
2014.
The referenced Section 404 and Section 10 permit authorizes impacts to navigable waters
of United States for the construction of a terminal groin structure, fillet and other associated
structures and work on Bald Head Island, Brunswick County, North Carolina. The permit
modification is proposed for the construction of a temporary work trestle to allow for the
delivery of rock from the mainland to the work area.
I have determined that the proposed project modifications described above are minor and
are not contrary to the public interest and therefore, the DA permit is hereby modified. It is
understood that all conditions of the -original permit remain applicable and that the expiration
date is unchanged.
The permit modifications are as f6llows:
1. Construction of the temporary trestle shall not interfere with the ongoing Federal
navigation dredging project and/or any other Federal navigation servitude project that
may be required during the performance period of the permit. The permittee shall not
initiate construction of the temporary trestle until the permittee has provided the Corps
Wilmington Regulatory Field Office with a written statement from the Federal project
contractor and from the Corps Contracting Officer or his representative stating that the
trestle construction will not interfere with the Federal project. The permittee, by
acceptance of this condition, specifically acknowledges that the Corps Contracting Officer
may, at his discretion, require removal, alteration, or suspension of work on the trestle
should it, in his opinion, constitute an impediment to the Federal work.
