There will be a copier/scanner available for your use. You can bring a USB drive for scanning, use the email feature on
the copier to send the scans directly to your email, or you can bring a check to pay for any paper copies. If the total
number of copies exceeds 100 pages (or $5), each paper copy is $0.05, payable by check only.
The copier is not sized to handle plan sheets; however, you may take pictures of the plan sheets. If taking pictures of the
plan sheets does not fit your needs, we will arrange to have the plan sheets copied at a nearby copy shop at your
expense. To do so, please flag the plan sets/sheets you wish to have copied / scanned with a post -it note, put the entire
plan set (not just the individual page) on the outside of the file, and include your contact information (phone number
and email) on the file review sheet. The copy shop, Allways Graphics, will contact you for payment.

The file has not been scanned. It is a large file,—12-13" wide. We have a contract with a
company to scan files when requested but it is $35/inch which would make the total
$420-$455. It would also take some time to prepare because we have to arrange each
page of the file into a specific order for the scanning company. (It looks like some of
that has been done but not all of it.) And, I will need to have the file to do my review
over the coming weeks. The other option is to set up a time to review the file at our
office. Let me know what you all would like to do.

I received the attached letter from the HOA dated 10/14 asking to be involved in the
inspection. Unfortunately the inspection had already been completed on 10/12. The
inspector has returned the file to me, but I have not reviewed it to see what he found. If
there was something specific that the HOA is concerned about that is not in the letter
please let me know. I just wanted to touch base to let you know that I was not ignoring
the HOA about the inspection, the timing just did not work out.

Ok, we were thinking there must be a more current certification since obviously a lot of
changes have been done with 2018. So, my take on this is the engineer will still have to

The typical questions I get from homeowner associations going through the transfer
process is about compliance and the associated responsibility. There will be an
inspection as part of the process. I will write up the inspection report, and we will work
through any issues with the permittee. If they have specific concerns the best way to
handle that is via email. Unfortunately I have over 50 of these, and it is difficult to set
up all of the meeting requests I receive.
On a separate note, who is the current HOA President? Is it still Bert Exum or has
someone else been elected? Do you have the meeting notes from the most recent
election by any chance? I need to make sure I communicate with the right people.

There will be a copier/scanner available for your use. You can bring a USB drive for scanning, use the email feature on
the copier to send the scans directly to your email, or you can bring a check to pay for any paper copies. If the total
number of copies exceeds 100 pages (or $5), each paper copy is $0.05, payable by check only.
The copier is not sized to handle plan sheets; however, you may take pictures of the plan sheets. If taking pictures of
the plan sheets does not fit your needs, we will arrange to have the plan sheets copied at a nearby copy shop at your
expense. To do so, please flag the plan sets/sheets you wish to have copied / scanned with a post -it note, put the
entire plan set (not just the individual page) on the outside of the file, and include your contact information (phone
number and email) on the file review sheet. The copy shop, Allways Graphics, will contact you for payment.

The file has not been scanned. It is a large file,—12-13" wide. We have a contract with
a company to scan files when requested but it is $35/inch which would make the total
$420-$455. It would also take sometime to prepare because we have to arrange each
page of the file into a specific order for the scanning company. (It looks like some of
that has been done but not all of it.) And, I will need to have the file to do my review
over the coming weeks. The other option is to set up a time to review the file at our
office. Let me know what you all would like to do.

Ok, we were thinking there must be a more current certification since obviously a lot of
changes have been done with 2018. So, my take on this is the engineer will still have to

Hi Cindy,
The typical questions I get from homeowner associations going through the transfer
process is about compliance and the associated responsibility. There will be an
inspection as part of the process. I will write up the inspection report, and we will
work through any issues with the permittee. If they have specific concerns the best
way to handle that is via email. Unfortunately I have over 50 of these, and it is difficult
to set up all of the meeting requests I receive.
On a separate note, who is the current HOA President? Is it still Bert Exum or has
someone else been elected? Do you have the meeting notes from the most recent
election by any chance? I need to make sure I communicate with the right people.

Thanks. It is best to stay involved with the permittee so you know when the permit is
being submitted. Unfortunately we have 10,000+ of these and it is difficult to keep up

II. SCHEDULE OF COMPLIANCE
No homeowner/lot owner/developer shall fill in, alter, or pipe any drainage feature
(such as swales) shown on the approved plans as part of the stormwater management
system without submitting a revision to the permit and receiving approval from the
Division.

entire lot, including driveways and sidewalks, does not exceed the allowable built -upon
area. Once the lot transfer is complete, the built -upon area may not be revised without
approval from the Division of Energy, Mineral and Land Resources, and responsibility
for meeting the built -upon area limit is transferred to the individual property owner.
3. If an Architectural Review Board or Committee is required to review plans for
compliance with the BUA limit, the plans reviewed must include all proposed
built -upon area. Any approvals given by the Board do not relieve the homeowner of
the responsibility to maintain compliance with the permitted BUA limit.
4. No person or entity, including the permittee, shall alter any component shown in the
approved plans and specifications. Prior to the construction of any modification to the
approved plans, the permittee shall submit to the Director, and shall have received
approval for modified plans, specifications, and calculations including, but not limited
to, those listed below. For changes to the project or SCM that impact the
certifications, a new or updated certification(s), as applicable, will be required and a
copy must be submitted to the appropriate DEQ regional office upon completion of the
modification.
a. Any modification to the approved plans and specifications, regardless of size
including the SCM(s), BUA, details, etc.
b. Redesign or addition to the approved amount of BUA or to the drainage area.
c. Further development, subdivision, acquisition, lease or sale of any, all or part of the
project and/or property area as reported in the approved plans and specifications.
d. Altering, modifying, removing, relocating, redirecting, regrading, or resizing of any
component of the approved SCM(s), the stormwater collection system and/or
vegetative conveyance shown on the approved plan.
e. The construction of any allocated future BUA.
f. The construction of any permeable pavement, #57 stone area, public trails, or
landscaping material to be considered a permeable surface that were not included
in the approved plans and specifications.
g. Other modifications as determined by the Director.
5. The Director may notify the permittee when the permitted site does not meet one or
more of the minimum requirements of the permit. Within the time frame specified in the
notice, the permittee shall submit a written time schedule to the Director for modifying
the site to meet minimum requirements. The permittee shall provide copies of revised
plans and certification in writing to the Director that the changes have been made.
6. The stormwater management system shall be constructed in its entirety, vegetated
and operational for its intended use prior to the construction of any built -upon surface.
7. During construction, erosion shall be kept to a minimum and any eroded areas of the
system will be repaired immediately.

8. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and
prior to operation of this permitted facility, the permittee shall cause a certification from
an appropriate designer for the system installed to be submitted, certifying that the
permitted facility has been installed in accordance with this permit, the approved plans
and specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification. A modification
may be required for those deviations.
9. If the stormwater system was used as an Erosion Control device, it must be restored
to design condition prior to operation as a stormwater treatment device, and prior to
occupancy of the facility.
10. Permanent seeding requirements for the stormwater control must follow the guidelines
established in the North Carolina Erosion and Sediment Control Planning and Design
Manual.
11. Prior to the sale of any lot, the following deed restrictions must be recorded:
a. The following covenants are intended to ensure ongoing compliance with State
Stormwater Management Permit Number SW8 020510 Modification, as issued
by the Division of Energy, Mineral and Land Resources under NCAC 2H.1000.
b. The State of North Carolina is made a beneficiary of these covenants to the
extent necessary to maintain compliance with the Stormwater Management
Permit.
C. These covenants are to run with the land and be binding on all persons and
parties claiming under them.
d. The covenants pertaining to stormwater may not be altered or rescinded without
the express written consent of the State of North Carolina, Division of Energy,
Mineral and Land Resources.
e. Alteration of the drainage as shown on the approved plans may not take place
without the concurrence of the Division of Energy, Mineral and Land Resources.
f. Impervious Area required to be recorded is as summarized in Attachment B.
These allotted amounts include any built -upon area constructed within the lot
property boundaries, and that portion of the right-of-way between the front lot
line and the edge of the pavement. Built upon area includes, but is not limited
to, structures, asphalt, concrete, gravel, brick, stone, slate, coquina and parking
areas, but does not include raised, open wood decking, or the water surface of
swimming pools.
g. Lots within CAMA's Area of Environmental Concern may be subject to a
reduction in their allowable built -upon area due to CAMA regulations.
h. All runoff on the lot must drain into the permitted system. This may be
accomplished through providing roof drain gutters which drain to the street,
grading the lot to drain toward the street, or grading perimeter swales and
directing them into the pond or street. Lots that will naturally drain into the
system are not required to provide these measures.
i. Built -upon area in excess of the permitted amount will require a permit
modification.
j. If the ownership of any commercial lot is not retained by the permittee, the
owner of each of the lots must submit a separate Offsite Stormwater
Management Permit application package to the Division of Energy, Mineral and
Land Resources and receive a permit prior to any construction on the lot.
12. A copy of the recorded deed restrictions must be submitted to the Division within 30
days of the date of recording the plat, and prior to selling lots. The recorded copy must
contain all of the statements above, the signature of the Permittee, the deed book
number and page, and the stamp/signature of the Register of Deeds.
13. Decorative spray fountains will not be allowed in the stormwater treatment system.

14. Prior to transfer of the permit, the stormwater facilities will be inspected by DEMLR
personnel. The facility must be in compliance with all permit conditions. Any items not
in compliance must be repaired or replaced to design condition prior to the transfer.
Records of maintenance activities performed to date will be required.
15. The permittee shall at all times provide the operation and maintenance necessary to
assure that all components of the permitted stormwater system function at optimum
efficiency. The approved Operation and Maintenance Plan must be followed in its
entirety and maintenance must occur at the scheduled intervals including, but not
limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and
specifications.
f. Debris removal and unclogging of structures, orifice, catch basins and piping.
g. Access to all components of the system must be available at all times.
16. Records of maintenance activities must be kept and made available upon request to
authorized personnel of DEMLR. The records will indicate the date, activity, name of
person performing the work and what actions were taken.
17. The facilities shall be constructed, operated and maintained in accordance with the
provisions of this permit, the approved plans and specifications, and the supporting
documents attached to this permit and on file with the Division.
18. Built upon area includes, but is not limited to, structures, asphalt, concrete, gravel,
brick, stone, slate, coquina and parking areas, but does not include raised, open wood
decking, or the water surface of swimming pools.
III. GENERAL CONDITIONS
Current Permittee Name or Address Changes: The permittee shall submit a
completed "Permit Information Update Application Form" (available on the Division
website) to the Division wi in 30 days to making any one or more of the following
changes:
a. A name change of the current permittee;
b. A name change of the project,
c. A mailing address change of the permittee;
2. Permit Transfer: This permit is not transferable to any person or entity except after
notice to and approval by the Director. The permittee shall submit a completed and
signed "Permit Transfer ADDlication Form" (available on the Division website)
accompanre y the require ee an supporting documentation as listed on the form,
to the Division at least 60 days prior to any one or more of the following events:
a. The sale or conveyance of the project area in whole or in part, except in the
case of an individual lot sale that is made subject to the recorded deed
restrictions and protective covenants;
b. The assignment or conveyance of declarant rights to another individual or
entity;
c. The sale or conveyance of the common areas to a Homeowner's or Property
Owner's Association, subject to the requirements of NCGS 143-214.7(c2);
d. Dissolution of the Partnership, corporate, or LLC entity, subject to NCGS 55-14-
05 or NCGS 57D-6-07 and 08;
e. Bankruptcy;
f. Foreclosure, subject to the requirements of Session Law 2013-121,

3. The permittee is responsible for compliance with all of the terms and conditions of this
permit until such time as the Director approves the transfer request. Neither the sale
of the project, in whole or in part, nor the conveyance of common area to a third party
constitutes an approved transfer of the stormwater permit.
4. Any individual or entity found to be in noncompliance with the provisions of this
stormwater management permit or the requirements of the Stormwater rules is subject
to enforcement procedures as set forth in NCGS 143 Article 21.
5. The issuance of this permit does not preclude the Permittee from complying with any
and all statutes, rules, regulations, or ordinances which may be imposed by other
government agencies (local, state, and federal) which have jurisdiction.
6. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including
those as may be required by this Division, such as the construction of additional or
replacement stormwater management systems.
7. The permit issued shall continue in force and effect until the permittee files a request
with the Division for a permit modification, transfer, renewal, or rescission; however,
these actions do not stay any permit conditions.
8. Permittee grants permission to staff of the DEMLR to access the property for the
purposes of inspecting the stormwater facilities during normal business hours.
10. A copy of the approved plans and specifications shall be maintained on file by the
Permittee for a minimum of ten years from the date of the completion of construction.
11. A permit renewal request must be submitted at least 180 days prior to the expiration
date of this permit. The renewal request must include the appropriate application,
documentation and the processing fee as outlined in Title 15A NCAC 02H.1045(3).

We appreciate the open communication from you concerning the above -mentioned
Stormwater permit, however, the board of directors for Waterford Residential Master
Association (WMRA) wants to express their disappointment for not being allowed to
participate in the inspection process that was done on October 12, 2022. There were
several emails and written correspondences to ask for this privilege dating back to
August 23, 2022.
By email communication from Cindy Norris on October 26, 2022, we have confirmed the
WMRA would review the completed file on Tuesday, November 1, 2022, at 2:OOpm at
the local DEQ office. The WMRA Board of Directors has also requested an electronic
copy of all files be made available as soon as DEQ has scanned into their system. The
WMRA Board of Directors will not have a position on this transfer until after all
completed files are submitted and reviewed.
As per your email dated August 23, 2022, you stated "usually the permittee will ask the
HOA to sign the paperwork" I assume this will still be part of the process. As the party
responsible for maintenance of the stormwater facilities outlined in the permit, the
WMRA, its volunteers, and its contractors have the most knowledge about the existing
stormwater facilities.
We look forward to working with you to make sure that the facilities constructed in our
development meet the NC DEQ Stormwater Permit requirements. If you have any
questions, please do not hesitate to contact me.

On December 151, 2020, the Wilmington Regional Office of the Division of Energy, Mineral and Land Resources
received and accepted a complete minor modification application for changes to the approved plans for
Stormwater Management Permit Number SW8 020510. It has been determined that the nature of the proposed
change meets the definition of a minor modification in that it does not result in an increase in the size of the
permitted stonnwater control measure (SCM) and does not increase the amount of built -upon area. Please refer to
Attachment C for a detailed description of the current proposed minor modification and a list of all the past
modifications approved during the effective period of the permit. We are forwarding you an approved copy of the
modified plans for your files. Please add the attached plans to the previously approved plan set. Please replace the
previously issued permit with the revised permit, dated January 5, 2021, attached, including revised deed
restrictions. This revised permit does not impose new or different terms; it merely restates some of the previous
terms to provide you with a better understanding of your obligations under the permit.
Please be aware that all terms and conditions of the permit issued on January 511, 2021 and modified as attached,
remain in full force and effect, including the requirement to revise or amend the recorded deed restrictions with
the updated built -upon area allocations. Please also understand that the approval of this minor modification to
the subject State Stormwater Permit is done on a case -by -case basis. Any other changes to this project must be
approved through this Office prior to construction. The approval of this minor modification does not preclude the
permittee from complying with all other applicable statutes, rules, regulations or ordinances which may have
Jurisdiction over the proposed activity, and obtaining a permit or approval prior to construction.

21FL 1045(3). North Carolina General Statutes and the Coastal Stormwater rules require that this property be
covered under a stormwater permit. Failure to maintain a permit subjects the owner to assessment of civil
penalties.
Please submit a complete permit renewal form along with a $505.00 fee and other submittal requirements within

DESIGN NARRATIVE
I.GENERAL:
On behalf of WDV, Inc., Cape Fear Engineering is submitting to modify the existing High
Density Permit for Waterford (SW8 020510).
The project site is located within Brunswick County, North Carolina and is bound by US Hwy.
74/76 to the north, Magnolia Greens Golf Plantation to the west, US Hwy. 17 to the east, and
Lincoln Industrial Park to the south. The project site is approximately 580 acres.
This project was originally permitted in 2002 and is a high -density project with curbed and
guttered streets draining to a surrounding non -discharge lake system. The permit was modified
most recently in January of 2019.
2. EXISTING SITE:
The majority of the project infrastructure has been constructed and installed since 2002.
The stormwater system consists of a non -discharge pond configuration where stormwater is re-
used for irrigation of the common areas and road right-of-way landscape areas. The system has
been operational for several years and per the permittee the irrigation demands have consistently
exceeded the available storage in the ponds.
3. PROPOSED MODIFICATIONS:
This minor modification is to combine Lots 15 and 16 of Tract M, which will be named Lot 15R.
The stormwater permit allocates 46,500 sf of BUA for Lot 15 and 45,000 sf of BUA for Lot 16.
This modification will combine the allocations with 91,500 sf of BUA allocated to Lot 15R. Lot
15R is in the design phase to be developed as a Furniture Store. The site will have stormwater
infrastructure and an off -site permit, to be named `Waterford Commercial Lot 15R', to SW8
020510 will be established.
Attachments A and B have been updated to match the proposed revisions. An updated High
Density Commercial Deed Restrictions has been provided for the proposed combined
commercial lot.

Proposed Revised Deed Restrictions
Lot 15R
In accordance with Title 15 NCAC 2H.1000 and S.L. 2006-246, the Management Regulations, deed
restrictions and protective covenants are required for High Density Commercial Subdivisions where
lots will be subdivided and sold and runoff will be treated in an engineered stormwater control facility.
Deed restrictions and protective covenants are necessary to ensure that the development maintains a
built -upon area consistent with the design criteria used to size the stormwater control facility.
Lots 15 and 16 of Tract M of the Waterford Commercial Property will be combined as Lot 15R. Lot 15
was previously allocated 46,500 sf of BUA and Lot 16 was previously allocated 45,000 sf BUA. Lot
15R shall have a total of 91,500 sf of BUA.

DESIGN NARRATIVE
GENERAL:
On behalf of WDV, Inc., Cape Fear Engineering is submitting to modify the existing High
Density Permit for Waterford (SW8 020510).
The project site is located within Brunswick County, North Carolina and is bound by US Hwy.
717 to the south, and Olde Regent Way to the north.
The project site is a commercial development in Waterford that utilizes an existing wet detention
pond (non -discharge amenity pond # 14) for stormwater control and treatment. The existing
Waterford Commercial Pond #14 was permitted under NCDENR stormwater permit #SW8
020510 on July 3, 2008 and was certified by K. Davis Fennell on March 13, 2008.
EXISTING SITE:
The project site consists of uplands. Site topography in the area is relatively flat and the entire
project follows the natural drainage pattern of west to east into the Waterford Commercial Pond
#14.
Ground cover consists primarily of sparse grasses and pine trees.
Subsurface soils on the site are typically a mixture of sands, silty sands and organics.
No wetlands are on the site and no impacts are proposed.
PROPOSED MODIFICATIONS:
This minor modification is to combine Lots 15 and 16, and will be combined as Lot 15R. The
Lot 15 and 16 BUA allocation will be combined and allocated to the combined Lot 15R.
BMPs:
No modification to pond geometry or outlet configuration is required.

On November 28, 2018, the Wilmington Regional Office of the Division of Energy, Mineral and Land
Resources received and accepted a complete minor modification application for changes to the approved
plans for Stormwater Management Permit Number SW8 020510. It has been determined that the nature
of the proposed change meets the definition of a minor modification in that it does not result in an
increase in the size of the permitted stormwater control measure (SCM) and does not increase the amount
of built -upon area. The following minor modifications are included and covered by this permit: the
combination of Lots 2 and 3 in Tract F to form Lot 2R. The BUA allocated to this area, now Lot 2R, will
remain the same. We are forwarding you an approved copy of the modified plans for your files. Please
replace the old approved plan sheets with the new ones. Please replace the previously issued Attachment
A with the revised version, dated January 17, 2019, attached.
Please be aware that all terms and conditions of the permit previously issued on April 27, 2016, remain in
full force and effect, including the requirement to revise or amend the recorded deed restrictions with
the updated built -upon area allocations. Please also understand that the approval of this minor
modification to the subject State Stormwater Permit is done on a case -by -case basis. Any other changes
to this project must be approved through this Office prior to construction. The approval of this minor
modification does not preclude the permittee from complying with all other applicable statutes, rules,
regulations or ordinances which may have jurisdiction over the proposed activity, and obtaining a permit
or approval prior to construction.

Section 7.03(f) are deleted and the following substituted therefore:

Guidelines for Access: The staff of Wilmington Regional Office is dedicated to making public records in our custody readily
available to the public for review and copying. We also have the responsibility to the public to safeguard these records and to carry

1. Due to the large public demand for file access, we request that you call at least a day in advance to schedule an

2. You must specify files you want to review by facility name. The number of files that you may review at one time will

DESIGN NARRATIVE
1. GENERAL:
On behalf of WDV, Inc., Cape Fear Engineering is submitting to modify the existing High
Density Permit for Waterford (SW8 020510). '
The project site is located within Brunswick County, North Carolina and is bound by US Hwy.
74/76 to the north, Magnolia Greens Golf Plantation to the west, US Hwy. 17 to the east, and
Lincoln Industrial Park to the south. The project site is approximately 580 acres.
This project was originally permitted in 2002 and is a high -density project with curbed and
guttered streets draining to a surrounding non -discharge lake system. The permit was modified
most recently in March of 2018.
2. EXISTING SITE:
The majority of the project infrastructure has been constructed and installed since 2002.
The stormwater system consists of a non -discharge pond configuration where stormwater is re-
used for irrigation of the common areas and road right-of-way landscape areas. The system has
been operational for several years and per the permittee the irrigation demands have consistently
exceeded the available storage in the ponds.
3. PROPOSED MODIFICATIONS:
This minor modification is to combine Lots 2 and 3 of Tract F, and will be combined as Lot 2R.
Whereas in DB 1891 PG 1391 Lot 2 was allocated as 30,600 BUA and Lot 3 was allocated as
32,876.30 BUA. Lot 2R shall have a total BUA of 63,476.30.
Attachments A and B have been updated to match the proposed permit conditions. An updated
High Density Commercial Deed Restrictions has been provided for proposed commercial lots.
4. BMPs:
No modification to pond geometry or outlet configuration is required.
