Waters — Sent via email to jlwaters@urbanengineers.com Dear Ms. Waters, This is with reference to the request to refine State Permit No. 18-21, which was originally issued to National Gypsum Company on February 11, 2021, for maintenance dredging of the berth footprint as previously authorized through State Permit 102-94. State Permit 102-94 was renewed twice, modified on November 17, 2003, and expired on December 31, 2007. State Permit No. 18-21 was then transferred to Gold Bond Building Products, LLC on December 1, 2021, and is due to expire on December 31, 2024. The action proposed in your request consists of the construction of a small trestle on the river's edge to support the last section of the 36" effluent pipe associated with the authorized spoil disposal site to prevent the pipe from washing away with the tides. Gold Bond Building Products, LLC proposes driving two (2), 12'-16' treated 6'x6's, 4 feet apart, and one shorter 6'x6' across the top. The final extension will extend 4' to 6' beyond the normal low water (NLW) boundary to addresses State Permit No. 18-21 permit condition # 10 "the disposal area effluent shall extend beyond the normal low water level to prevent gully erosion and unnecessary siltation". A second trestle would be added to support the extension. The supports would be located at the last 1/2 to 1/3 of the pipe (20' stick of pipe is in the mud at grade). One trestle would be located at the end of the pipe with 45° supports going towards shore and towards the river from the base of the trestle. Upon reviewing the information provided, the Division of Coastal Management has determined that the proposed action is consistent with existing State rules and regulations and is in keeping with the original purpose and intent of the permit. This Letter of Refinement authorizes the modification of State Permit No. 18-21 as described in your email and drawing dated received 11/30/2022. Please note this refinement does not alleviate the need to obtain any other local, state or federal permits.
