The email requests NCDOT's contractor be allowed an additional one week of in -water work beyond the current in -water work moratorium start date to remove the bridge abutments of the previous bridge down to adjacent wetland elevations (7'). In accordance with Condition 2 of the CAMA Major Permit issued for this project (Permit No. 45-20), and after consideration of the request and comments from the appropriate fisheries resource agencies, DCM has determined that a one-time relaxation of the in -water work moratorium is appropriate at this time. This email shall serve as official notification that the work to remove the bridge abutments of the previous bridge at the Neuse River Overflow down to adjacent wetland elevations (7') as proposed in the attached email thread may be conducted until February 22, 2023 as requested. Thank you for clearing that up. The area of disturbance and length of in water work this early in the migration season should not have significant impacts. Therefore WRC is amenable to allowing an extension for one week into the in water work moratorium (February 225Y) If flow conditions do not allow the work to occur during this extension we will need to re-evaluate. They are waiting for the water to drop below the required excavation elevation of 7.0, but the wood abutment needs to come out and we will still be connected until elevation 5.6. If that is the case WRC does not object. Since the overflow and river are not connected at that elevation then anadromous fish should not be able to migrate through the project work area. I have attached a copy of the agreed upon elevation of 5.6' that determined "connectivity' with the river. With the moratorium beginning on 2/15/2023, does anyone see an issues with the removal of the wood abutments this early in the season? I'm not sure if there is any bit of a grace period so early in the moratorium. Let me know your thoughts. Currently, we are waiting for the water levels at the overflow to recede below the 7+/- elevation in order to remove the abutments and for Barnhill to excavate the area. With this being said, it appears we will be inside the moratorium when performing this work. I would like to request an exception from the agencies to perform this work during the moratorium period. Please pass this along to the appropriate agencies as soon as you can. We will keep working with you and Joe to determine a suitable time to remove this material.
