For calendar year 2022, MCAS Cherry Point was in compliance with all conditions of the land application permit. A summary of the corrective actions taken to rectify the non-compliance of calendar year 2021 are included in enclosure (2). During reporting year 2022, 141.80 dry tons were land applied on 67.29 acres of sites 1, 3, and 4. Cherry Point has nine permitted application sites that encompass 389.24 total acres. The residual source was the MCAS Cherry Point Wastewater Treatment Plant (WWTP). Please note that Plant Available Nitrogen (PAN) was not analyzed for the April 8, May 9, and August 25, 2022, sampling dates because of a contracting oversight; the September 2, 2021, PAN value was used on the Residual Sampling Summary Form (RSSF) for these dates. As documented in enclosure (3), the annual data submitted herein was submitted to the Environmental Protection Agency's Biosolids Section via the NPDES eReporting Tool under identification number NCL003816. Only residuals approved for this permit were applied to the permitted sites. 2. Soil pH was adjusted as specified in the permit and lime was applied (if needed) to achieve a soil pH of at least 6.0 or the limit specified in the permit. 3. Annual soils analysis were performed on each site receiving residuals during the past calendar year and three (3) copies of laboratory results are attached. 4. Annual TCLP analysis was performed and three (3) copies of certified laboratory results are attached. 5. All other monitoring was performed in accordance with the permit and reported during the year as required and three (3) copies of certified laboratory results are attached. 6. The facility did not exceed any of the Pollutant Concentration Limits in Table 1 of 40 CFR Part 503.13 or the Pollutant Loading Rates in Table 2 of 40 CFR part 503.13 (applicable to 40 CFR Part 503 regulated facilities). 7. All general requirements in 40 CFR Part 503.12 and management practices in 40 CFR Part 503.14 were complied with (applicable to 40 CFR Part 503 regulated facilities). 8. All operations and maintenance requirements in the permit were complied with or, in the case of a deviation, prior authorization was received from the Division of Water Quality. 9. No contravention of Ground Water Quality Standards occurred at a monitoring well or explanations of violations are attached to include appropriate actions and remediations. 10. Vegetative cover as specified in the permit was maintained on this site and the crops grown were removed in accordance with the crop management plan. 11. No runoff of residuals from the application sites onto adjacent property or nearby surface waters has occurred. 12. All buffer requirements as specified on the permit were maintained during each application of residuals. # • 2022-21635 Pape 9 of 9 PERMIT NONCOMPLIANCE RESOLUTION SUMMARY FROM CY2021 Enclosure (2) PERMIT NONCOMPLIANCE SUMMARY MCAS Cherry Point provided the following information on the conditions of noncompliance noted in this annual Treatment and Land Application of Residuals Report for permit WQ0001489 for calendar year 2021. Explanation of the permit conditions not met and the corrective action taken are detailed herein. Background. The listed noncompliant conditions are all related to the removal and application of sludge from the MCALF Bogue Airfield WWTF. The sludge removal was conducted under a contract for repairs which included the replacement of the two lagoon liners. The replacement of the liners required the contractor to remove the accumulated sludge from the two lagoons and transport it to MCAS Cherry Point for land application on land application sites designated under permit WQ0001489. The contractor land applied the sludge between January 6 and October 7, 2021. Noncompliant Permit Conditions. The application of sludge from this project resulted in noncompliance with the following permit conditions: Permit Condition 11.6: Pollutant concentrations in the residuals from MCALF Bogue Airfield WWTF cannot be calculated for the land application sites as the identified parameters were not analyzed. This impacts the ceiling concentration levels on application sites 2, 3, 4, and 7. Permit Condition 11.11: The plant available nitrogen (PAN) for land application area 2 was exceeded. Permit Condition IV.2: The residuals from MCALF Bogue Airfield WWTF were not analyzed to demonstrate they are non -hazardous under the Resource Conservation and Recovery Act (RCRA). Permit Condition IV.3: The residuals from MCALF Bogue Airfield WWTF were not analyzed for the required parameters. Permit Condition Attachment A: Exceeded the maximum dry tons of 3.10 per year for MCALF Bogue Airfield WWTF. Root Cause: Because of miscommunication and misunderstanding between the engineering firm that designed the project and MCAS Cherry Point environmental compliance, engineering, and utilities personnel, the project specifications required neither the full suite of analytical sampling outlined under permit WQ0001489 nor coordination/prior approval of sludge application with/by Cherry Point environmental compliance staff or the land application permit operator in responsible charge (ORC). The project specifications further assumed that the sludge was exempt from the testing required under conditions IV.2 and IV.3 because MCALF Bogue Airfield WWTF receives only domestic sewage and has no industrial inputs. These issues were not identified during the final project design and implementation phases of the project and came to light during preparation of the permit annual report. Enclosure (2) Corrective Actions Taken: MCAS Cherry Point implemented the following corrective actions. MCAS Cherry Point reviewed its contractual mechanisms and project design/development processes to ensure all permit requirements are incorporated into the specifications for future sludge application projects. MCAS Cherry Point will incorporate in future project specifications a requirement that analytical data be submitted to environmental compliance staff and the ORC prior to land application of sludge; this data will be reviewed for compliance with permit requirements before sludge application is authorized. MCAS Cherry Point contracted with ONE Environmental Group of Carolina, PLLC (ONE) to assess the cumulative loading of sludge application in areas 2, 3, 4, and 7 for the parameters outlined in permit WQ0001489. Composite soil samples were collected and analyzed for Metals, VOCs, SVOCs, Pesticides and Herbicides in May 2022. Based on the results of this analysis, the only parameter that was exceeded was Plant Available Nitrogen (PAN) for all fields analyzed. The current limit for PAN 250 lbs/acre. The same fields were resampled in September 2022 for PAN. The largest contributor of PAN is ammonia, which overall is about 12% less than the May results (on average- omitting the May outlier result from Field 7A) but still high enough to result in most PAN values being near or above the permitted limit. Overall, the increased contribution of nitrogen from the larger fraction of organic matter observed in each sample collected in September resulted in higher total PAN concentrations compared to the May event. Based on September's reported ammonia -nitrogen concentrations for Field 7A (185 mg/kg and 202 mg/kg (Duplicate)), it is our opinion that May's reported Field 7A concentration of 8,919 mg/kg was an error (due either to sample contamination during field collection or laboratory activities/reporting). It should also be noted that September's Field 7A result is the lowest concentration reported for any field, which is reasonable based on fewer reported applications to Field 7A each year. As the Environmental Affairs Department (EAD) works to determine a course of action to lower the PAN levels of the subject fields, we will attempt to avoid the use of these fields (2, 3, 4, and 7) for biosolids Enclosure (2) application. A few options that EAD is currently working on include modifying our current land maintenance contract to have the cut fescue collected and removed from these fields, examining the possibility of changing the cover crop, and working with our engineering department to examine the possibility of opening more acreage in our existing application fields. EAD has started a dialog with Division of Water resources concerning this matter as we examine a way forward.
