PROJECT DESCRIPTION: The project site is located at the terminal end of Lewis Road (Pender County Parcel ID 4224-02-7017- 0000), adjacent to the AIWW/ Topsail Sound, north of Hampstead, Pender County. To access the site from Wilmington, take US Hwy 17 N to Sloop Point Loop Road (SR 1563). Turn right onto Sloop Point Loop Road and travel approximately 2.7 miles to Lewis Road (SR 1564). Make a right on Lewis Road and follow it approximately 0.6 miles. The project site will be located on the left-hand side of the road (at the tenninus), adjacent to the Sloop Point Marina and Hampstead Boatyard. The site is accessible by entering the gate at Caison Boat Works, then turning right toward the waterway. Currently, the site is operating as a haul out facility (boat yard/boat maintenance facility). The site consists of a single parcel totaling approximately 1.1 acres with roughly 88 linear feet of water frontage along the eastern shoreline, which is bulkheaded (old steel in need of replacement). Most of the parcel is high ground and is undeveloped with exception of an existing bulkhead and travel lift. According to the applicant, the high ground portion of the property has an elevation of approximately 6'- 12' above Normal High Water (NHW). Vegetation on the high ground portion of the lot consists primarily of sparse grasses. There is a narrow stand of Coastal Wetlands (predominantly Spartina alterniflora, commonly known as Smooth Marsh Cordgrass) bordering the property's eastern shoreline, just waterward of the existing bulkhead. Water dependent features existing on the property include a bulkhead and concrete travel lift (which straddles the property line between Glenn Lewis and Mark Lewis), both of which are located along the eastern shoreline. According to the application package, current water depths adjacent to the bulkhead range from approximately 0.0' to -1' at Normal Low Water (NLW), and water depths surrounding the existing travel lift range from -1.0' to -5.5', NLW. The waters surrounding the existing travel lift connect to the existing access channel for the Lewis Brothers Boatyard. The project site has a CAMA permit history dating back to at least 1991 (CAMA Major #23-91), which initially authorized a series of floating docks and travel lift. CAMA permit 423-91 also authorized excavation of the adjacent finger canal, boat basin and entrance channel located waterward of the subject property. In 1996, CAMA General Permit No. 016483 was issued for replacement of three floating docks abutting the existing travel lift, and in 1999, a CAMA General permit (No. 0I9822-D) was issued for replacement of an existing bulkhead and maintenance dredging around the travel lift, boat basin and entrance channel. Lastly, in 2007 CAMA major permit # 172-07 was issued, authorizing maintenance excavation around the existing Lewis Bros. Boatyard and installation of a new docking facility. Adjacent land uses include a commercial boat yard to the north and west, a commercial marina to the south, and the AIWW to the east. Based on historical records, a known archaeological site, Pd 17 is located within one-half mile of the project site. The waters of the AIWW adjacent to the project site are classified as SA by the North Carolina Division of Water Resources. They are NOT designated as a Primary Nursery Area (PNA) by the North Carolina Division of Marine Fisheries, and they are OPEN to the harvest of shellfish in the immediate vicinity of the project site. In additional, the applicant proposes to perform maintenance dredging around the proposed docking system. With exception to the proposed bulkhead replacement and spoil disposal, no other high ground development is being requested at this time. All other work described in the application package and field investigation report relate to water dependent activities. With regard to the proposed bulkhead, the applicant is requesting authorization to "step out" approximately 2' waterward of the existing steel wall (which currently approximates the normal high water line). As designed, a new vinyl bulkhead would be installed approximately 2' waterward of the existing wall and would begin along the southern property line and extend toward the north to the southern side of the existing travel lift, a distance of approximately 76 linear feet. As a result of this proposal, approximately 152 sq. ft. of open water would be filled, as would a section of Coastal Wetlands totaling approximately 55 sq, ft, in size. The Coastal Wetland fill would occur along the southeastern corner of the property, adjacent to the southern property line. The proposed docking facility would consist of a single access pier and two floating docks. Beginning along the southern edge of the existing travel lift, the applicant proposed to install a new 8' x 50' floating dock which would be accessed by a single ramp/gangway attached to the bulkhead cap. According to the application package, this floating structure would provide dockage for up to two vessels (labeled slips I and 2 on "Sheet 3 of 5"). Just south of slips I and 2, the applicant proposes to install a new 6' x 20' access pier (originating from the bulkhead), which would provide access to a new 8' x 38' section of floating dock. Based on the site plan drawings, this floating structure would provide access to four vessels identified on "Sheet 3 of 5" as slips 3-6. Both floating docks would extend toward the east, and run perpendicular to the shoreline, within the established pier -head alignment. Due to shoaling around the existing bulkhead and travel lift, the applicant proposes to dredge the area around the proposed floating docks. According to application package, including the attached workplan drawing labeled "Sheet 5 of 5", approximately 2,500 sq. ft. (62' x 40' x -6' or 275 cubic yards) of shallow bottom habitat would be excavated from the area surrounding the proposed docking facility. The boat basin would be excavated using a tapered cut that would begin approximately 12'-15' from the outer edge of the existing Coastal Wetlands, and would extend toward the east, terminating at the -6.0' contour (@ NLW). As designed, the proposed dredging activities would remain within the footprint of that previously permitted under CAMA major permit 423-91 and 4172-07. As designed, the dredging methodology for this project would consist of either a bucket -to -barge or land reach operation. The application indicates material would be excavated and transported by land to another property owned by the applicant, which is also located on Lewis Road, approximately 0.25 miles west of the subject property. According to the application package, the location of the 140' x 200' disposal site is void of any wetland. Based on existing water depths surrounding the proposed project, there does not appear to be any SAV in the dredge footprint. ANTICIPATED IMPACTS The construction of the bulkhead would result in the filling of approximately 55 sq. ft. of Coastal Wetland and approximately 152 sq. ft. of Estuarine and Public Trust Waters. In addition, approximately 1,520 sq. ft. of high ground would be disturbed as a result of the tie back system. The proposed floating docks and access pier would incorporate approximately 824 sq. ft. of Estuarine and Public Trust Waters. Dredging operations would impact approximately 2,480 sq. ft. of previously dredged shallow bottom habitat and disposal of spoil material would impact up to 28,000 sq. ft. of high ground. As designed, the northern most floating dock would encroach into the riparian corridor setback shared with the applicants brother (Mark Lewis); however, the applicant has obtained a waiver allowing the encroachment. Along the southern portion of the property, the applicant would be able to meet the 15' riparian corridor setback, so no waiver was necessary. The length of the proposed docking facility would not extend beyond 1 /4/ of the width of the water body, or beyond the near shore edge of the adjacent channel. Submitted by: J. Project Narrative 4.1.1 Project Location and Existing Conditions The project is adjacent to the Intracoastal Waterway at the terminus of Lewis Road (PIN 4224-02-7017-0000) in Hampstead, PenderCounty. There is a bulkhead and concrete travel lift located on the property. Most of the property serves as a boat maintenance facility. A Hydrographic survey of the project area was conducted by TI Coastal on May 27, 2021 referenced to Mean Low Water NAVD88 and represent conditions at that time. An SAV and shellfish survey of the project area was conducted by Land Management Group on October 20, 2021 and found neither SAV or shellfish resources present. Waters in the project area are classified as SA; HQW and are not a Primary Nursery Area. The area is open to shellfishing for marketing purposes. See Appendix B for details. The property has a permitting history which includes bulkhead replacement and maintenance dredging. Preliminary input was requested from the Division of Marine Fisheries on October 21, 2022 regarding two separate projects occurring adjacent to each other located on parcels 4224-02-7174-0000 and 4224-02-7017- 0000. Comments indicated that the originally proposed docking facilities would be in close enough proximity to one another that they would be counted together for the purposes of determining overall slip count and associated shellfish closure. Therefore, designs were altered such that the slip locations are now separated by over 100' as indicated on the plan view drawing. See Appendix B for details. 4.1.2 Proposed Action The applicant proposes installation of a bulkhead 2' waterward of the existing bulkhead. The proposed bulkhead will measure 76' long x 1' wide, be constructed of naval style vinyl sheet pile and will tie to the existing bulkhead and concrete pier. The new bulkhead will create an approximate 580 cubic foot area to be backfilled with approximately 22 cubic yards of sand from a sand mine or other upland source. Approximately 55 square feet of coastal wetlands will be impacted on the southern portion of the bulkhead. To provide additional waterway access to the property and support the upland maintenance facility, two floating docks are proposed. The northern floating dock will measure 8' wide x 50' long and will tie with an access ramp to the proposed bulkhead. The southern floating dock will measure 8' wide x 38' long and tie with an access ramp to a 6' wide x 20' long fixed pier affixed to the proposed bulkhead. The fixed pier bottom deck boards will be constructed at least 3' above any coastal wetlands. There is no additional upland work proposed on the property. See Appendix A for details. Due to water depths surrounding the proposed floating docks and within the access channel, maintenance dredging to -6 MLW is requested within the proposed dredging boundary. An approximate 2,500 square foot box cut to -6 MLW will generate approximately 300 cubic yards of dredge spoil. Dredging will extend to existing -6' MLW depths where applicable within the proposed dredging boundary adjacent to the riparian corridors and connecting to existing water depths. The approximate 0.39- acre study area is located at 314 Lewis Rd., Sloop Point, Pender County, North Carolina. Waters in the vicinity of the survey site are classified as SA-HQW. Methodology A Land Management Group environmental (LMG) scientist conducted the SAV and shellfish survey on 20 October 2021 between the hours of 12:00 pm and 3:00 pm. Sampling times were coordinated to coincide as closely with low tide as possible for that day (2:47 pm for Surf City). Sampled water depths ranged from -O.Oft to -4.Oft and water visibility was 2.5ft as measured with a secchi disk. Weather conditions were clear and cool with an average air temperature of 80* F, an average water temperature of 74* F, water salinity was 35 plat with a west wind at 5 knots. Substrate composition varied throughout the site between sandy to silty sand. The channel on the northeast side of the property was shallow enough at low tide (0.0 ft. - < -1.5ft) to visually inspect the entire length for SAV and shellfish to the southeast corner of the bulkhead, however, 2 areas of subtidal silty sand bottom in the canal were sampled from a floating platform with a clam rake to a depth of 6 inches below the surface. A transect on the south side of the travel lift was sampled along the shoreline and out to -3.0 ft with a clam rake where water depths increased preventing further inspection for SAV, SAV rhizomes or shellfish. The sampling area on the north side of the travel lift was not accessible by foot due to increased water depths and no access from the bulkhead. NCDMF sampling protocol dictates that 25 one -meter square plots be sampled per acre of bottom. A standard clam rake was used to sample 6, one -meter square plots in the general vicinity of the study area and visual inspection was used forthe remaining areas resulting in a total area of 0.39 acres (approximately 16,000 sq. ft.) of subtidal sand bottom sampled (Figure 1). A hydrographic survey conducted in May 2021 is also included with this summary depicting depths throughout the study areas north and south of the travel lift (Figure 2). Results Shellfish According to NCDMF shellfish sampling protocol, a significant shellfish resource is defined as one (1) clam per sample plot per acre. This equates to 10 bushels of clams per acre. A total of 0 clams and 0 oysters were collected from 6 sample plots resulting in a total number of clams or oysters per acre that would not be considered a significant resource. While the shoreline adjacent to the study area does contain sparse shell hash and clumps of living oysters are present on the concrete pilings of the existing travel lift, the LMG scientist found the bottom habitat within the footprint of the study area to be devoid of shellfish (oyster clusters and individual oysters and clams). This area of Sloop Point adjacent to the AIWW is designated as SA-HQW by NCDWR and not Primary Nursery Area by the NCDMF. A search of past permitting history and historical aerial photography indicates that maintenance dredging has occurred in the area (Appendix A). Existing water depths > -5.0 ft. and evidence of dredging over the years in the vicinity of the proposed activities would indicate an environment not suitable as SAV habitat. Conclusions Soft mud bottom, water depths and poor access to portions of the survey area prevented sampling the entire proposed dredging footprint by foot. However, historical evidence from previous permits indicates maintenance dredging since 1991 and a hydrographic survey conducted in May 2021 provides data showing water depths in excess of what is considered to support SAV growth. Therefore, it is believed that the proposed activity would not have a significant impact on any SAV or shellfish resources in the vicinity of the project. The new bulkhead will create an approximate 580 cubic foot area to be backfilled with approximately 22 cubic yards of sand from a sand mine or other upland source. Approximately 55 square feet of coastal wetlands will be impacted on the southern portion of the bulkhead. To provide additional waterway access to the property and support the upland maintenance facility, two floating docks are proposed. The northern floating dock will measure 8' wide x 50' long and will tie with an access ramp to the proposed bulkhead.
