(for Occidental Chemical Corporation), Hart & Hickman, PC (H&H) is submitting the enclosed Groundwater Quality Monitoring: Compliance Report Forms (GW-59A and GW-59) and laboratory analytical report for groundwater samples collected during July 2022 in accordance with the Occidental Chemical Corporation Surface Disposal of Residuals (SDR) Permit No. WQ0001492 for the Elementis Chromium Castle Hayne Manufacturing Facility. Under the terms of the SDR permit, groundwater within an established Compliance Boundary (generally surrounding the Quarry as depicted in Figure 1) is monitored on a semi-annual basis (during July and November) for chloride, total chromium, total iron, total nickel, pH, and total dissolved solids (TDS). Please note that four compliance monitoring wells were resampled during August 2022 to further evaluate anomalous detections of total chromium in the wells during the July 2022 sampling event. The August 2022 total chromium results for these four wells are reported in the attached GW-59 forms along with the July 2022 non -chromium data, and the laboratory analytical reports for the July and August 2022 samples are enclosed. Refer to the July 2022 Non -Compliance Summary presented below for additional details. Background Information The facility is currently operating under a 1999 Corrective Action Plan (I -CAP) for remediation of compounds of concern (COCs) in groundwater above standards by processes of natural attenuation pursuant to 15A NCAC 2L .0106(1). The COCs addressed by the 1-CAP include chlorides, iron, pH, and TDS. The objective of the 1-CAP is to reduce COC concentrations which exceed groundwater standards at or outside of the compliance boundary established in the SDR permit by natural attenuation. The target cleanup concentrations for the COCs except total iron are the 2L standards. Annual natural attenuation groundwater monitoring reports are submitted to the NC Department of Environmental Quality (DEQ) Division of Water Resources (DWR) to satisfy the 1-CAP monitoring reporting requirements. The results of the July 2022 monitoring indicated COCs above 2L standards or background. Immediate notification of elevated iron, chloride, and TDS concentrations and pH levels outside the 2L standard range was not made to DWR after receipt of the July 2022 analytical results because these conditions are already known to DWR and are addressed under the 1-CAP. Immediate notification of elevated chromium in well MW-24/CPW-4D was not made after receipt of the July 2022 analytical results because this condition is attributable to the Plant Process Area (PPA) of the site and is already known to DEQ. Chromium impacts associated with the PPA are being managed under an Administrative Agreement (AA) for Voluntary Assessment and Remedial Action under the Inactive Hazardous Sites Branch (IHSB) Registered Environmental Consultant (REC) Program, DEQ ID NCD057454670. Because chromium and nickel are not COCs in the 1- CAP, if chromium and/or nickel concentrations are detected above the 2L standards in the compliance wells (other than chromium in well MW-24/CPW-4D), notification is made to DEQ in accordance with the SDR permit. July 2022 Non -Compliance Summary Results of analysis of the July 2022 SDR compliance monitoring event indicate total chromium was detected above the 2L standard of 10 micrograms per liter (µg/1) in wells MW-23/CPW-3D (11.0 µg/1), MW-17/CPW-7S (10.8 µg/1), MW-18/CPW-8S (30.1 µg/1), and MW-14/CPW-14D (69.6 µg/1). Total chromium is not a COC which is being addressed by the 1-CAP (discussed above). In accordance with Condition IV.12 of the SDR permit, non-compliance notification was made to the DWR Wilmington Regional Office via email and telephone on July 25, 2022. (H&H received the analytical laboratory report after business hours on Friday, July 22, 2022.) In addition, a non-compliance notification report was submitted to the DWR Wilmington Regional Office on July 29, 2022. As shown in Figure 1, well MW-23/CPW-3D is located to the east of the PPA and is not in the vicinity of the Quarry or Former Lagoon where residual solids are or were placed. Well MW- 17/CPW-7S is located along the eastern perimeter of Quarry Section 1 between the PPA of the site and the Quarry and well MW-18/CPW-8S is located along the northwestern perimeter of Quarry Section 1. Residual solids generated by the Elementis Chromium Castle Hayne Manufacturing Facility's wastewater treatment plant (WWTP) are currently disposed in Quarry Section 2, and therefore not in the area of wells MW-23/CPW-3D, MW-17/CPW-7S, and MW-18/CPW-8S. Well MW-14/CPW-14D is located along the southwestern perimeter of Quarry Section 2. During 2021 and 2022, residual solids have primarily been disposed in the northern and northwestern portions of Quarry Section 2. Prior to July 2022, total chromium was detected above the 2L standard in only one sample collected from well MW-23/CPW-3D (51 µg/1 in March 2003), one sample collected from well MW- 14/CPW- 14D (17 µg/1 in March 1999), and two samples collected from well MW-18/CPW- 8S (13 and 26 µg/1 in November 2002 and July 2021, respectively). Based on the low frequency of total chromium detections above the 2L standard in samples collected from wells MW-23/CPW-3D, MW-17/CPW-7S, MW-18/CPW-8S, and MW-14/CPW- 14D prior to July 2022, the relatively long period of time since total chromium detections above the 2L standard were previously detected in the wells (with the exception of the July 2021 detection in well MW-18/CPW-8S), and the fact that well MW-23/CPW-3D is not located near the Quarry or Former Lagoon, and that two of the wells (MW-18/CPW-8S and MW-17/CPW-7S) are not located near Quarry Section 2 where residual solids are currently placed, detections of chromium above the 2L standard in these four wells during a single monitoring event is an anomalous occurrence. Based on our review of sampling information and discussions with sampling and laboratory personnel, we have not identified a likely potential source of the July 2022 total chromium concentrations detected in the four wells. On August 1, 2022, samples were collected from MW-23/CPW-3D, MW-17/CPW-7S, MW- 18/CPW-8S, and MW-14/CPW-14D and submitted for laboratory analysis of total chromium to further evaluate the July 2022 chromium detections in the wells. Results of analysis of the August 2022 samples collected from the wells indicate total chromium was not detected in any of the wells, providing further evidence that the July 2022 chromium detections are anomalous. Based on discussions with DWR, we have reported the August 2022 chromium results for these four wells in the attached GW-59 forms along with the July 2022 non -chromium data for the wells. The next SDR Permit -required sampling event is in November 2022. Future detections (if any) of total chromium or nickel above the 2L standards in SDR Permit compliance wells will be addressed in accordance with Conditions I.1 and 1.2 of the current SDR Permit.
