Trion St / Morehead Square Dr & E. Morehead St / E. Carson Blvd. The Applicant proposes to discharge at 0.075 GPD (estimated groundwater recovery at 112 gpm). This is herein designated as the permitted effluent flow rate, not to exceed. Fact Sheet-- NEW NPDES Permit NC0090123 Morehead Tryon Land LP — Queensbridge Collection Page 1 of 8 The Applicant proposes to pre -treat groundwater (est. recovery rate 112 gpm) dewatered while excavating sub -grade concrete parking structures, to include pilons and a proposed slab located 2 ft below the groundwater surface (est. slab area 153,900 ft2). Treated effluent is approved to discharge to an existing stormsewer inlet by Charlotte -Mecklenburg Stormwater Services (letter dated June 6, 2022). This stormsewer inlet is designated Outfall 001 located at LAT/LONG = 35°, 13' 11" N / 80°, 51', 04" W. Ultimately, treated effluent reaches surface waters at Little Sugar Creek, LAT/LONG = 35°, 13' 2.4" N / 80°, 50', 42.3" W, as approved under this NPDES permit. 2.0 BACKGROUND The Applicant's site -assessment identified "limited groundwater impacts" at the site, apparently the result of petroleum release(s) from former underground storage tanks located adjacent to the existing Uptown Cabaret, a building in the northern corner of the site. 3.0 RECEIVING -STREAM EVALUATION Little Sugar Creek and its UTs by association are currently classified C waterbodies located within the Catawba River Basin. Little Sugar Creek is listed by the Division as impaired [2018 North Carolina 303 (d) List]. Established total maximum daily loads (TMDLs) include: • Fecal Coliform • Turbidity limit [< 50 NTU]. • Dissolved Oxygen [daily average not < 5 mg/ L; instantaneous value not < 4 mg/L during 7Q10 stream -flow conditions. In accord with statewide NPDES permitting guidance, any discharge to a storm -sewer inlet is deemed zero flow and therefore may afford no dilution to the effluent [15A NCAC 02B.0206 (d)], see 4.0 DWR Evaluation of Proposed Discharge. 4.0 DWR EVALUATION of PROPOSED DISCHARGE Contaminants of Concern (COCs). The Division considered a list of COCs as site -assessment data provided by the Applicant as analytes "believed to be present" [see EPA applications, table Summary of Analytical results and details provided by Pace Analytical Services, LLC, page 4 of 38]. DWR has added monitoring Weekly for these organic and inorganic analytes (see permit Section A. (1.)]. Metals require effluent monitoring for Total Hardness to established compliance with EPA guidelines for metals in dissolved fraction [see below, 9.0]. In addition to analytes "believed to be present," DWR has added Monthly monitoring for suites of analytes as a comprehensive spot-check for organic compounds: • Total Purgeable Organic Compounds, EPA 624 • Base -Neutral Acids (Semi -Volatile Organics), EPA Method 625 • Total PAHs, EPA Method 8270 While site -assessment soil and groundwater analyses provide potential COCs, there are no treated effluent data to date. Table A. (1) includes a footnote allowing the Permittee to petition to alter parameters and/or monitoring frequency, as future data may warrant [see permit section A. (1.)]. Fact Sheet Morehead Tryon Land LP -- NEW NPDES Permit NC0090123 Page 2 of 8 5.0 ESTABLISHING COMPLIANCE & PERMIT LIMITS The Applicant proposes to discharge from an onsite Groundwater Treatment System to an established storm -sewer inlet adjacent SE to the site on Morehead Drive. Because this outfall discharges to a storm -sewer inlet, the Division will assume zero flow receiving -stream conditions offering no dilution, per NPDES permitting guidance statewide. Permit limits therefore reflect Contaminants of Concern (COCs) based on analytes identified by the Applicant as "known to be present" [See EPA Application form 2D]. If an analyte has an established surface water quality standard, DWR has applied this standard as "limited" both as acute and chronic [see section A. (1.)]. Reasonable Potential Analyses (RPAs) -- Current databases reflect site -assessment from monitoring wells and soil borings only. Therefore, in the absence of treated discharge data, no RPA was conducted. Whole Effluent Toxicity (WET) Testing -- This facility applies granular activated carbon (GAC) filters as a final treatment to polish its effluent. Data show that these filters likely render the effluent too clean to support aquatic life, a portent to WET -test failure [Cindy Moore, Aquatic Toxicology Branch (DEQ/ATB)]. Therefore, consistent with current permitting guidance, WET testing of this proposed discharge is not required. 6.0 ENGINEERING ALTERNATIVES ANALYSIS (EAA) The Applicant's Engineering Alternatives Analysis (EAA) notes that a "positive streamflow" historically exists for mainstem Little Sugar Creek (see Table 1 above), but they further assert that its "unnamed tributaries (UTs) are similarly therefore not subject to zero flow stream restrictions." Morehead Tryon appears to assume thereby that their proposed effluent at Outfall 001 may be afforded dilution [see EAA Terracon, Step 1., 02Jun2022]. This is an incorrect assumption (see above section 3.0). The application includes supporting documents from local permitting Authorities. As required of new discharges, the Applicant has presented an Engineering Alternatives Analysis (EAA),. The EAA considered: • land application • connecting to an existing WWTP • installing infiltration galleries • wastewater reuse • off -site disposal via vacuum truck, and • direct discharge to surface waters including an evaluation of potential impacted species. Morehead Tryon concludes that "off -site disposal via vacuum truck," and "direct discharge to surface waters" remain as the only alternatives due to a restrictively dense urban environment surrounding the site, and further that groundwater (treated or otherwise) is unacceptable to local wastewater treatment plants (WWTPs). Thus, discharge alternatives are restricted to two viable options only. Present -Value Costs were thereby estimated for Batch and Haul = $275,000 and for Discharge to Surface Waters = $30,661. The Applicant concludes that a surface -water discharge is the most viable discharge alternative based on cost (see Permittee's EAA Present Value Cost, Memorandum Step 5.). DWR concurs with this conclusion. Corporon, PG DATE: 02FEB2023 9.0 EPA METALS EVALUATION — for TOTAL HARDNESS NPDES Implementation of Instream Dissolved Metals Standards — Freshwater Standards The NC 2007-2015 Water Quality Standard (WQS) Triennial Review was approved by the NC Environmental Management Commission (EMC) on November 13, 2014. The US EPA subsequently approved the WQS revisions on April 6, 2016, with some exceptions. Therefore, metal limits in draft permits out to public notice after April 6, 2016 must be calculated to protect the new standards - as approved. Tablel. However, application of the dissolved and hardness -dependent standards requires additional consideration in order to establish the numeric standard for each metal of concern of each individual discharge. The hardness -based standards require some knowledge of the effluent and instream (upstream) hardness and so must be calculated case -by -case for each discharge. Metals limits must be expressed as `total recoverable' metals in accordance with 40 CFR 122.45(c). The discharge -specific standards must be converted to the equivalent total values for use in the RPA calculations. We will generally rely on default translator values developed for each metal (more on that below), but it is also possible to consider case -specific translators developed in accordance with established methodology. Fact Sheet Morehead Tryon Land LP -- NEW NPDES Permit NC0090123 Page 5 of 8 RPA Permitting Guidance/WQBELs for Hardness -Dependent Metals - Freshwater The RPA is designed to predict the maximum likely effluent concentrations for each metal of concern, based on recent effluent data, and calculate the allowable effluent concentrations, based on applicable standards and the critical low -flow values for the receiving stream. If the maximum predicted value is greater than the maximum allowed value (chronic or acute), the discharge has reasonable potential to exceed the standard, which warrants a permit limit in most cases. If monitoring for a particular pollutant indicates that the pollutant is not present (i.e. consistently below detection level), then the Division may remove the monitoring requirement in the reissued permit. 1. To perform a RPA on the Freshwater hardness -dependent metals the Permit Writer compiles the following information: • Critical low flow of the receiving stream, 7Q10 (the spreadsheet automatically calculates the 1Q10 using the formula 1Q10 = 0.843 (s7Q10, cfs) 0.993 • Effluent hardness and upstream hardness, site -specific data is preferred • Permitted flow • Receiving stream classification 2. In order to establish the numeric standard for each hardness -dependent metal of concern and for each individual discharge, the Permit Writer must first determine what effluent and instream (upstream) hardness values to use in the equations. The permit writer reviews DMR's, Effluent Pollutant Scans, and Toxicity Test results for any hardness data and contacts the Permittee to see if any additional data is available for instream hardness values, upstream of the discharge. If no hardness data is available, the permit writer may choose to do an initial evaluation using a default hardness of 25 mg/L (CaCO3 or (Ca + Mg)). Minimum and maximum limits on the hardness value used for water quality calculations are 25 mg/L and 400 mg/L, respectively. If the use of a default hardness value results in a hardness -dependent metal showing reasonable potential, the permit writer contacts the Permittee and requests 5 site -specific effluent and upstream hardness samples over a period of one week. The RPA is rerun using the new data. The overall hardness value used in the water quality calculations is calculated as follows: Combined Hardness (chronic) = (Permitted Flow, cfs *Avg. Effluent Hardness, mg/L) x (s7Q10, cfs *Avg. Upstream Hardness, mg/L) (Permitted Flow, cfs + s7Q10, cfs) The Combined Hardness for acute is the same but the calculation uses the 1Q10 flow. 3. The permit writer converts the numeric standard for each metal of concern to a total recoverable metal, using the EPA Default Partition Coefficients (DPCs) or site -specific translators, if any have been developed using federally approved methodology. Fact Sheet Morehead Tryon Land LP -- NEW NPDES Permit NC0090123 Page 6 of 8 EPA default partition coefficients or the "Fraction Dissolved" converts the value for dissolved metal at laboratory conditions to total recoverable metal at in -stream ambient conditions. This factor is calculated using the linear partition coefficients found in The Metals Translator: Guidance for Calculating a Total Recoverable Permit Limit from a Dissolved Criterion (EPA 823-B-96-007, June 1996) and the equation: Cdiss = 1 Ctotal 1 + { [Kpo] [SS0+0] [ 10-6] } Where: ss = in -stream suspended solids concentration [mg/1], minimum of 10 mg/L used, and Kpo and a = constants that express the equilibrium relationship between dissolved and adsorbed forms of metals. A list of constants used for each hardness - dependent metal can also be found in the RPA program under a sheet labeled DPCs. 4. The numeric standard for each metal of concern is divided by the default partition coefficient (or site -specific translator) to obtain a Total Recoverable Metal at ambient conditions. In some cases, where an EPA default partition coefficient translator does not exist (ie. silver), the dissolved numeric standard for each metal of concern is divided by the EPA conversion factor to obtain a Total Recoverable Metal at ambient conditions. This method presumes that the metal is dissolved to the same extent as it was during EPA's criteria development for metals. For more information on conversion factors see the June, 1996 EPA Translator Guidance Document. 5. The permit writer enters the most recent 2-3 years of effluent data for each pollutant of concern. Data entered must have been taken within four and one-half years prior to the date of the permit application (40 CFR 122.21). The RPA spreadsheet estimates the 95th percentile upper concentration of each pollutant. The Predicted Max concentrations are compared to the Total allowable concentrations to determine if a permit limit is necessary. If the predicted max exceeds the acute or chronic Total allowable concentrations, the discharge is considered to show reasonable potential to violate the water quality standard, and a permit limit (Total allowable concentration) is included in the permit in accordance with the U.S. EPA Technical Support Document for Water Quality -Based Toxics Control published in 1991. 7. When appropriate, permit writers develop facility specific compliance schedules in accordance with the EPA Headquarters Memo dated May 10, 2007 from James Hanlon to Alexis Strauss on 40 CFR 122.47 Compliance Schedule Requirements. 8. The Total Chromium NC WQS was removed and replaced with trivalent chromium and hexavalent chromium Water Quality Standards. As a cost savings measure, total chromium data results may be used as a conservative surrogate in cases where there are no analytical results based on chromium III or VI. In these cases, the projected maximum concentration (95th %) for total chromium will be compared against water quality standards for chromium III and chromium VI. 9. Effluent hardness sampling and instream hardness sampling, upstream of the discharge, are inserted into all permits with facilities monitoring for hardness -dependent metals to ensure the accuracy of the permit limits and to build a more robust hardness dataset. 10. (Terracon) has completed the enclosed NPDES Permit Application and supporting documentation for the above - referenced property. Preparation of this NPDES Individual permit application is associated with proposed dewatering that will be necessary during and after the construction of three high-rise, mixed use towers at the site, which will include a 2- or 3-story below grade parking structure that intersect will intersect the water table. Limited groundwater impacts have been identified at the site, apparently the result of petroleum release(s) from former underground storage tanks located adjacent to the existing Uptown Cabaret building in the northern portion of the site. Morehead Tryon Land LP proposes to pre -treat the groundwater that is dewatered from the sub -grade parking structure and then discharge the effluent to the Charlotte -Mecklenburg County municipal stormwater sewer, with ultimate discharge occurring to Little Sugar Creek, under a new individual NPDES permit. As noted on EPA Forms 3510-2D and 3510-2E, Morehead Tryon Land LP is requesting a waiver for the following effluent characteristics: biochemical oxygen demand, chemical oxygen demand, total organic carbon, ammonia, and oil and grease. These parameters, and the remaining listed in Table A of Form 3510-2D and Section 4.2 of Form 3510-2E (total suspended solids, discharge flow, pH, and temperature), have not been collected. As the discharge in question will be composed solely of groundwater, it is not anticipated that the effluent will contain constituents that would have an impact on biochemical oxygen demand, chemical oxygen demand, total organic carbon, ammonia, or oil and grease. Morehead Tryon Land LP plans to redevelop the site with three mixed -use high-rise towers which will overlay an approximate 2- to 3-story sub -grade parking structure. Limited groundwater impacts have been identified at the site (see Table 1 and Exhibit 2), apparently the result of petroleum release(s) from former underground storage tanks located adjacent to the existing Uptown Cabaret building in the northern portion of the site. Morehead Tryon Land LP proposes to pre -treat the groundwater that is dewatered during construction activities and then discharge the effluent to the Charlotte -Mecklenburg County municipal stormwater sewer, with ultimate discharge occurring to Little Sugar Creek, under a new individual NPDES permit. Determination of Discharge Permit Eligibility Terracon has reviewed the potential restrictions identified in the EAA guidance document and does not believe that the identified restrictions will pose an impediment to an NPDES discharge from this location, as discussed below. The discharge will be to Little Sugar Creek and will occur after the groundwater has been treated. 1) Zero Flow Stream Restrictions According to the United States Geological Survey (USGS), Little Sugar Creek, the receiving stream for the proposed discharge, is not a zero -flow stream. As such, Little Sugar Creek is not subject to zero -flow stream restrictions. A copy of USGS correspondence providing flow estimates is included as an attachment to this memo. As such, the proposed discharge will also enter Little Sugar Creek at a similar location and the USGS-provided flow characteristics provided in December 2021 are applicable for the Queensbridge Collective project. 2) Receiving Stream Classification According to NCDEQ DWR's online surface water classifications map, the receiving stream for the proposed discharge, Little Sugar Creek, is a Class C water. Class C waters are not subject to discharge restrictions and/or stricter treatment standards such as those that may be required for certain stream classifications (e.g. ORW, WS, SA, NSW, and HQ). 2) Basinwide Water Quality Plan According to the most recent Catawba River Basinwide Water Quality Plan (2010), Little Sugar Creek is listed as impaired for copper, mercury, and turbidity standards as well as biological integrity of fish and benthic communities (page 3.12 of the Plan). The Basinwide Plan includes total maximum daily load (TMDL) restrictions (see Item # 3 below for more information regarding TMDLs) to limit wastewater discharge within the Catawba River Basin. The Basinwide Plan indicates that Little Sugar Creek is subject to TMDLs for turbidity and fecal coliform bacteria (FCB; page 3.13 of the Plan). It should be noted that the Basinwide Plan also indicates that during the TMDL study window (1997 to 2004), Little Sugar Creek turbidity did not exceed the applicable turbidity standard and that the TMDL in question only covers Long Creek (page 1.43 of the Plan). 3) Impaired Waters and TMDLs According to a Final Report issued by NCDEQ in 2005 establishing TMDLs for turbidity within the Catawba River Basin, the TMDL for turbidity is only applicable to the portion of Little Sugar Creek between North Carolina Highway 51 and the North Carolina -South Carolina state line, which begins approximately 8 miles south of the site. As such, the proposed discharge to Little Sugar Creek is not limited by an established TMDL. According to a Final Report issued by NCDEQ in 2002 establishing TMDLs for FCB in four watersheds within Mecklenburg County, the entirety of Little Sugar Creek from its source to the state line is subject to the FCB TMDL. The proposed discharge is not a potential source of FCB, as it originates as dewatered groundwater generated during installation of deep foundations at a construction site. As such, the proposed discharge will not result in FCB impact to Little Sugar Creek or result in exceedance of the established TMDL. A TMDL was also established for dissolved oxygen (DO) in Little Sugar Creek in 1996. The proposed discharge is not expected to significantly affect the DO within Little Sugar Creek, as it is composed of groundwater from dewatered foundation installation activities in an urban area and it is not expected to be loaded with nutrients such as phosphorus and nitrate that would reduce DO. Further, the effluent will be treated on -site via carbon filtration prior to discharge. As such, the DO TMDL should not limit the proposed discharge. 4) Presence of Endangered Species According to the USFWS Information for Planning and Consultation (iPAC) online system, the following listed endangered species are potentially present in the general region of the site and down -stream portions (within approximately 3 miles of the proposed discharge point) of Little Sugar Creek: Michaux's Sumac (flowering plant), Schweinitz's Sunflower (flowering plant), Smooth Coneflower (flowering plant), Northern Long-eared Bat (mammal), Monarch Butterfly (insect), and Carolina Heelsplitter (clam). In addition, a number of migratory birds are listed in the iPAC information. As the Carolina Heelsplitter is the only aquatic species potentially present in Little Sugar Creek, there would be no expected impact to the other species listed above. According to the most recent Catawba River Basinwide Water Quality Plan (2010), the only stream in the Catawba River basin that supports populations of the Carolina Heelspliter is Waxhaw Creek (page 3.16 of the Plan), which enters the Catawba River some 30 miles south of the point of proposed discharge to Little Sugar Creek. As such, there would be no expected impact to the Carolina Heelsplitter from the proposed discharge. A summary of the iPAC endangered species information is included as an attachment to this letter. STEP 2 . Determination of Discharge Permit Eligibility A. Summary of Process Information and Flow Estimates The discharge will result from the temporary dewatering of caisson boreholes and excavation for subgrade foundation construction. The boreholes will range in diameter from 2.5 feet to 6 feet and will be advanced via auger rotary and rock core methods. A temporary casing will be driven ahead of the drill tooling to limit infiltration of the groundwater into the borehole. Once a borehole has reached the appropriate depth, it is anticipated that the borehole will remain open for a maximum of approximately one day prior to the installation of the concrete caisson via tremie pipe. Based on Terracon's geotechnical experience in the Charlotte area, groundwater is typically encountered within boreholes that are allowed to remain open overnight at the approximate expected depth of the water table based on the Iithological conditions observed in the cuttings (e.g. saturated soil conditions). As such, Terracon conservatively assumes that groundwater will rise to the depth of the water table within the boreholes prior to caisson installation. Caissons are planned to be installed one at a time, with construction crews finishing one before moving to the next. The subgrade foundation is designed to intersect the reported groundwater surface elevation with approximately 153,900 square feet of floor area 2 feet below static water table level. Based on the caisson drilling schedule and dewatering to 2 feet below Charlotte, NC Environmental • Facilities • Geotechnical • Materials lrerracon Memorandum groundwater surface elevation for the subgrade foundation construction, Terracon is assuming a maximum flow rate for temporary construction dewatering at 112 gallons per minute (GPM). Groundwater will be directed into a frac tank which discharges into a treatment train consisting of bag filtration (to remove sediment) and a steel vessel containing 8,000 pounds of reactivated carbon, as detailed in the NPDES permit application. The technical specifications of the treatment system are provided in Appendix D of the permit application. Please note that while the proposed pre-treatment is not considered a groundwater remediation treatment for the purposes of reducing petroleum concentrations of impacted groundwater within the subsurface at the site, for the purposes of this EAA and the NPDES Permit Application, it is referred to as a groundwater remediation system below. Terracon anticipates that the maximum discharge during working days will be approximately 112 GPM. Per the carbon filter manufacturer, the system should be operated at above 50 GPM to minimize channeling within the carbon vessel. As such, the system will be operated to maintain an average flow rate between 50 and 112 GPM. Flow rates will be intermittent, not continuous, based on construction phasing and groundwater infiltration. B. Low Flow Data for Receiving Stream Low flow information for the receiving water(s) was obtained from the US Geological Society (USGS)and the NCDEQ in Raleigh, North Carolina. Correspondence from the agencies is provided in Attachment A. Generally, the discharge from the system will be directed to a designated outfall through underground piping. From the point of discharge, underground piping discharges to a topographic depression in which stormwater ultimately flows into Little Sugar Creek. The USGS provided the following low -flow statistics based on a period of analysis of 1995 through 2011 climatic years: Frequency Discharge 7Q10 1.5 cubic feet per second (cfs) 30Q2 4.0 cfs W7Q10 2.3 cfs 7Q2 2.5 cfs Based on the USGS-provided information, Little Sugar Creek is not considered a zero -flow stream and is therefore not subject to zero -flow stream restrictions as set forth in 15A NCAC 2B.0206(d)(2). Reasonable Projections for Flow As discussed in the EAA Guidance Document, non —municipal flow projections for groundwater remediation projects are based on engineering design considerations and/or production projections rather than population projections. As discussed in Step 1C above, the anticipated maximum flow associated with the temporary construction dewatering activities will be approximately 112 GPM. As there currently is no firm projection for the phases of construction, the flow rate is based on the calculation of hydraulic conductivity and infiltration into the maximum floor area anticipated to be below the groundwater elevation during construction activities — 2 feet saturated at 153,900 square feet. Flow rates will be intermittent, not continuous, based on construction phasing and groundwater infiltration. STEP 3. Evaluate Technologically Feasible Alternatives As discussed in the EAA Guidance Document, discharges from groundwater remediation systems are required to evaluate whether wastewater treatment plant (WWTP) connection, land application, infiltration galleries, in -situ groundwater remediation wells, or closed -loop groundwater remediation wells. As these alternatives have not been deemed technologically feasible, as discussed below, Terracon has also considered closed -wastewater reuse, discharge to surface waters, and combinations of the above as possible alternatives. A. Connection to an Existing WWTP The Charlotte -Mecklenburg Utilities (CMU) has discontinued accepting groundwater discharges. Specifically, the City of Charlotte Sewer Use Ordinance prohibits the discharge of groundwater in Section 23-79 (14) without permission from the CMU-System Protection (SP). Based on conversations with representatives of SP, CMU will not accept discharge of the dewatered groundwater, making this treatment alternative infeasible. B. Land Application The facility is located at 111 East Morehead Street in Charlotte, North Carolina. This location is just outside Uptown Charlotte in an urban area consisting predominantly of commercial development. Ground cover in the area is predominantly already developed hardscape. Land application of the discharge would interfere with construction. Based on the design and land constraints and the available land, land application is not feasible at this time. Infiltration Galleries As discussed above, there is not space on the site to install an infiltration gallery. As such, infiltration galleries are not a technologically feasible alternative. D. In -Site or Closed -Loop Groundwater Remediation Wells As the proposed discharge is temporary, and it would be difficult to protect/maintain wells on an active construction site, permanent re -injection well infrastructure is unnecessary and not technically feasible. E. Wastewater Reuse The site will consist of an active construction site during the dewatering activities. As such, there are no site processes available in which the dewatered groundwater could be reused. Therefore, wastewater reuse is not technically feasible. F. Off -site Disposal of Discharge via Vacuum Truck The off -site disposal of temporarily containerized dewatered groundwater via vacuum truck ("batch and haul") is a technologically feasible alternative for disposal. However, as discussed in Step 5 below, it is not an economically feasible alternative compared to NPDES surface water discharge. G. Direct Discharge to Surface Waters Surface water discharge has been determined to be a technically feasible alternative for disposal of the dewatered groundwater based on the presence of Charlotte -Mecklenburg stormwater infrastructure at/adjacent to the site and its ultimate discharge to surface water. The discharge from the outlet of the treatment system will be directed into a stormwater intake located in an existing stormwater detention basin located at the southeast boundary of the property along Morehead Square Drive. Treated flow from dewatering activities ultimately discharges into Little Sugar Creek. Refer to Exhibit 1 for the approximate and location of the facility in relation to the Little Sugar Creek. Evaluate Economically Feasible Alternatives "Batch and haul" and surface water discharge have been determined to be the only technically feasible alternatives for disposal of dewatered groundwater. As the proposed discharge is temporary and will only occur during an approximate 4-month period during 2022/2023, a 20- year present value cost analysis (PVCA) has not been completed. However, Terracon has completed a comparison of the overall projected costs of the two identified technologically feasible alternatives. Below is a table comparing costs for the disposal of the dewatered groundwater via "batch and haul" versus surface water discharge under a NPDES Individual Permit. The costs are estimates and are limited to those elements specific to the discharge, e.g. operational requirements, treatment costs, monitoring costs and maintenance. As the disposal facility will require characterization sampling of groundwater exported from the site via "batch and haul," and periodic sampling of pre-treated groundwater discharge is anticipated under the NPDES permit requirements, it has been assumed that the difference in sampling costs (labor and laboratory analysis) is negligible. In addition, as dewatered groundwater will be containerized within a rented frac tank in either scenario, its cost has not been included in the table below. CMSWS would like to make the permittee and NC DEQ aware of the following considerations and information: • CMSWS reserves the right to access, inspect, sample, and review documentation regarding the groundwater treatment system at any time. • In the event of an illicit discharge, bypass, or exceedance of permit discharge limits, Morehead Tryon Land LP Or its consultant shall immediately notify CMSWS and immediately implement corrective actions. • CMSWS reserves the right to rescind approval to discharge to the City of Charlotte's MS4 for due cause including gross improper operation of the system, and established trend of discharge limit exceedances, failure to provide notification of illicit discharges, system bypasses, and similar reasons. • CMSWS does not guarantee adequate capacity is available to permitted dischargers to keep any property or street free of water or harm as a result of this discharge.
