The contract will be implemented as a Division Three-Purchase Order Contract (POC) project. The existing 2 span, 36 ft timber bridge with 24 ft of clear roadway will be replaced with a longer bridge along the existing alignment. The proposed bridge will be a 2 span, 8S-ft prestressed concrete cored slab bridge with 40 ft of clear roadway. The attached Categorical Exclusion document states that the proposed bridge is 7S ft in length, however it should be noted that the proposed bridge length was changed to 8S ft. to shift the interior bent out of the stream channel. The structure will include two -12 ft travel lanes with 8-ft offsets. Approach work will consist of resurfacing and tying into the existing alignment for approximately 380 feet to the west and approximately 370 feet to the east of the existing bridge. The roadway approaches and bridge grades will approximately match existing elevations therefore there will be no reduction in navigational clearance. Guardrail will be installed where warranted and as depicted on the plan sheet. Traffic will be detoured along surrounding roads during construction. The proposed bridge replacement is located over the White Oak Branch (DWQ Index No. 18-74-19-6) Class C Sw. The U.S. Army Corps of Engineers verified the wetlands for this project on March 11, 2003 (Action ID #200300651). A total of 0.002 acres (70.16-sq. ft.) of riverine wetland will be impacted by this project associated with shoulder construction. There are no stream impacts on this project. The hydro report for this project included a reinforced concrete box culvert alternative for this site however, after Division personnel review the site in the field, the bridge alternative was chosen. In addition, to further minimize impacts the bridge will be constructed using top construction methods and an off site detour will be utilized during~construction. Rip rap slope protection around the end bents is being proposed at a 2:1 slope to further minimize impacts. No permanent or temporary utility impacts are proposed with this project. The substructwe is composed of timber bents and caps. The Department will take every precautionary measure necessary to ensure that no components will be dropped into waters of the United States. The bridge will be removed using top down methods and NCDOT's Best Management Practices for Bridge Demolition and Removal will be followed. COMPENSATORY MITIGATION ~ Based upon the letter from the U.S. Army Corp of Engineers, Wilmington District dated September 1, 2004, it is ' ~`' understood that the North Carolina Department of Environment and Natural Systems Ecosystem Enhancement ~~ " Program (EEP), will assume responsibility for satisfying the Federal Clean Water Act compensatory mitigation requirements for all NCDOT projects at a 2:1 ratio. It is also NCDOT's understanding that if the USACE District ~ ~~ Engineer determines that compensatory mitigation is required for any project, it will be submitted to EEP for ~' acceptance on a quarterly basis by the Department with a copy provided to the Wilmington District office for ~.' verification and accounting purposes. f~' '~ The Department has avoided and minunized impacts to jurisdictional resources to the greatest extent possible as described above: Therefore, if required by USACE District Engineer, the remaining, unavoidable impacts to OA02 acres of jt3risdictional riverine wetlands will be offset by compensatory mitigation provided by the EEP program. These impacts aze proposed in a coastal plain small stream riverine wetland in the Cape Fear River Basin within USGS hydrologic unit 03030007 (subbasin 030622). NATURAL AND HISTORIC RESOURCES FEDERALLY PROTECTED SPECIES Species with the federal classification of Endangered, Threatened, Proposed Endangered and Proposed Threatened are protected under provisions of Section 7 and Section 9 of the Endangered Species Act of 1973 as amended (16 U.S.C. 1531 et seq.). The United States Fish and Wildlife Service lists three federally protected species for Duplin County: American alligator (Alligator mississippiensis), Red-cockaded woodpecker (Picoides borealis), and American chaffseed (Schwalbea americana). A Natural Heritage GIS Database and field review for occurrences and habitat for these species was conducted and a determination of "No Effect" for the listed species is recommended. HISTORICAL RESOURCES Pursuant to Section 106 of the National Historic Preservation Act and the Advisory Council on Historic Preservations Regulations for Compliance with Section 106 codified at 296 CFR Part 800, this project has been reviewed and cleazed for effects on historical and archeological resources (see attachments). REGULATORY APPROVAL Section 404 Permit: NCDOT is requesting authorization under Nationwide 23 under the USACE Nationwide Permit program (72 FR 11092; March 12, 2007). Section 401 Permit: NCDOT anticipates that the corresponding 401 General Certification # 3632 for Nationwide 23 will apply to this project. Therefore, in accordance with the Water Quality Certification 3632 we are hereby providing DWQ with two copies of the application for review. Furthermore, the NCDOT will adhere to ali general conditions of the Water Quality Certification. Project Description: NCDOT will replace Bridge No. 46 on NC 403 over White Oak Branch in Duplin County. The bridge will be replaced with a new bridge measuring 75 feet in length and 40 feet in width at approximately the same location as the existing bridge. This bridge will provide fora 24 foot travelway and 8 foot offsets on each side. The new approach roadway will be a 24 foot travelway with 8 foot grassed shoulders. The approach work will consist of 380 feet to the west and 370 feet to the east of the existing bridge. The roadway grade of the new structure will be approximately the same as the existing grade at this location. Traffic will be detoured on existing local roads during construction as shown in Figure 1. There will be 1 mile of additional travel (about 3 minutes). B. Purpose and Need: Bridge Maintenance records indicate the bridge has a sufficiency rating of 33.0 out of 100. The bridge's two span superstructure is composed of a reinforced concrete deck on timber joist with an asphalt wearing surface. The substructure is composed of timber caps on timber piles. The bridge's low superstructure condition rating qualifies the bridge as structurally deficient according to Federal Highway Administration (FHWA) standards and therefore eligible for FHWA's Highway Bridge Replacement and Rehabilitation Program. The bridge is also functionally obsolete due to the deck geometry rating. The replacement of this inadequate structure will result in safer traffic operations. C. Proposed Improvements: The following Type II improvements which apply to the project are circled: 1. Modernization of a highway by resurfacing, restoration, rehabilitation, reconstruction, adding shoulders, or adding auxiliary lanes (e.g., parking, weaving, turning, climbing). a. Restoring, Resurfacing, Rehabilitating, and Reconstructing pavement (3R and 4R improvements) b. Widening roadway and shoulders without adding through lanes c. Modernizing gore treatments Construction of new bus storage and maintenance facilities in areas used predominantly for industrial or transportation purposes where such construction is not inconsistent with existing zoning and located on or near a street with adequate capacity to handle anticipated bus and support vehicle traffic. 9. Rehabilitation or reconstruction of existing rail and bus buildings and ancillary facilities where only minor amounts of additional land are required and there is not a substantial increase in the number of users. 10. Construction of bus transfer facilities (an open area consisting of passenger shelters, boarding areas, kiosks and related street improvements) when located in a commercial area or other high activity center in which there is adequate street capacity for projected bus traffic. 11. Construction of rail storage and maintenance facilities in areas used predominantly for industrial or transportation purposes where such construction is not inconsistent with existing zoning and where there is no significant noise impact on the surrounding community. 12. Acquisition of land for hardship or protective purposes, advance land acquisition loans under section 3(b) of the UMT Act. Hardship and protective buying will be permitted only for a particular parcel or a limited number of parcels. These types of land acquisition qualify for a CE only where the acquisition will not limit the evaluation of alternatives, including shifts in alignment for planned construction projects, which may be required in the NEPA process. No project development on such land may proceed until the NEPA process has been completed. 13. Acquisition and construction of wetland, stream and endangered species mitigation sites. 14. Remedial activities involving the removal, treatment or monitoring of soil or groundwater contamination pursuant to state or federal remediation guidelines. SR1317 (White Oak Bridge Road). This would be 3 minutes additional travel time ( 1 mile additional travel). Resurfacing the detour roads will be necessary to strengthen and widen the pavement and remove the weight posting (currently 6.5 tons) on these routes. Bridge Demolition: Bridge No. 46 has 2 spans totaling 35 feet in length. The bridge superstructure is composed of a reinforced concrete deck on timber~oist with an asphalt wearing surface. The substructure is composed of timber caps on timber piles. All components of the bridge will be removed without dropping any of their components into Waters of the United States. Alternatives Studied and Rejected: The "do-nothing" alternative will eventually necessitate closure of the bridge. This is not acceptable due to the traffic service provided by NC 403. Due to the short detour (1 mile) and the relatively low traffic (2400 vehicles per day), and the presence of high quality wetlands in the project area, no other alternatives were studied. E. Threshold Criteria The following evaluation of threshold criteria must be completed for Type II actions. Based on our knowledge of the area, it is unlikely that any archaeological resources that may be eligible for conclusion in the National Register of Historic Places will be affected by the project. We, therefore, recommend that no archaeological investigation be conducted in connection with this project. We have conducted a review of the proposed undertaking and are aware of no historic resources which would be affected by the project. Therefore, we have no comment on the undertaking as propc~ed.
