Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:* The proposed project is located at 4175 Hendersonville Road in Fletcher, North Carolina. The subject property has several structures (Local Fresh Produce Stand and the Taco Truck) and is partially vacant. Adjoining properties appear to be primarily residential and commercial properties. 4b. Explain the purpose of the proposed project:* D&H Company wishes to pursue a convenience store and filling station to be located on five (5) parcels at the northwest corner of the intersection of US Hwy 25 (Hendersonville Road) and Woodhill Drive, with Henderson County PINs 9652673798, 9652673975, 9652674962, 9652684005, and 9652684073, totaling 1.57 acres. 4i. Describe the overall project in detail, including indirect impacts and the type of equipment to be used:* The purpose of the proposed project is to construct a single -story convenience store approximately 5,670 SF (See Appendix 2 - Plans Set) with gas pump stations, sidewalks, adequate parking spots, and a proposed sanitary sewer relocation located parallel to Hendersonville Road (See Appendix 2 - Plans Set - Sanitary Sewer Relocation Sheet 1). No indirect impacts are anticipated for the proposed project. The proposed permanent impacts (Impact W1) for the project are approximately 0.2434 Acres resulting from grading and fill for the convenience store and adequate parking spaces. Silt fencing shall be used in stockpile area during construction to prevent discharge to jurisdictional areas. See Appendix 2 - Plans Set (Sheets C-101, C-102, C-103 - Erosion Control and Grading Plans). Typical equipment to be used may include track hoes, back hoes, skid steers, dump trucks, excavators and dozers. 5. Jurisdictional Determinations 5a. All Threatened and Endangered Species found on the USFWS IPAC Report were surveyed for and no species occurrences were found within the project area. NLEB - Occupied HUC12-NC Data Polygons - See Appendix 8 for NLEB Occupied HUC Map The polygons represent the USGS NHD 12-digit HUC polygons which contain confirmed hibernation, maternity, and winter roost sites for Northern long- eared bat (Myotis septentrionalis). No species occurrences were found during the site inspection on 4/20/2022. According to the USGS NHD 12-Digit HUC Data, the proposed project does not fall within an NLEB occupied habitat. 6. If "Breeds elsewhere" is indicated, then the bird likely does not breed in your project area. What are the levels of concern for migratory birds? Migratory birds delivered through IPaC fall into the following distinct categories of concern: 1. "BCC Rangewide" birds are Birds of Conservation Concern (BCC) that are of concern throughout their range anywhere within the USA (including Hawaii, the Pacific Islands, Puerto Rico, and the Virgin Islands); 2. "BCC - BCR" birds are BCCs that are of concern only in particular Bird Conservation Regions (BCRs) in the continental USA; and 3. A Preliminary Jurisdictional Determination (PJD) provides an indication that there may be "waters of the United States" or "navigable waters of the United States"on a property. PJDs are sufficient as the basis for permit decisions.
