Project area is a Town of Cary Utility Easement, located within an approximate 4.48 acre parcel at 1412 Old Apex Road
in Cary, NC. The project area is currently undeveloped woodlands in the area of the utility easement. A commercial
landscaping nursery is located to the southwest, and a Town of Cary fire station is located to the northeast. Undeveloped properties and a pond are located to the northwest across Old
Apex Road. Single-Fanily residential properties are located to the southeast, across a railroad right-of-way.

The proposed project consists of the replacement (reinforcement) of existing 12-inch diameter waterline with a 16-inch
diameter waterline, located along Old Apex Road in Cary, NC. The project extends approximately 8,300 linear feet of
from an existing 20" waterline at SW Cary Parkway and will connect to an existing 12" waterline on Maynard Road. This project will include crossing a UT to Crabtree Creek in the
proposed project area.
4i. Describe the overall project in detail, including indirect impacts and the type of equipment to be used: *
The existing utility corridor for the project is primarily within the Old Apex Road right-of-way. In the area of the proposed impacts, the waterline must be moved out of the right-of-way due to
the presence of an existing RCP culvert underneath Old Apex Road. A utility easement was obtained for the portion of the line outside the road ROW. Moving the waterline off the existing
roadway and into a wooded area adjacent to the road requires the establishment of a new 20'-wide utility maintenance corridor, which will be regularly mowed and maintained by the Town
of Cary.
The establishment of the new maintenance corridor will require temporary wetland and stream impacts, which will be restored to pre -construction contours and seeded with a wetland seed
mix. The corridor will be regularly mowed and maintained, resulting in the conversion of a headwater forested wetland to an herbaceous wetland, and permanent removal of forested
riparian buffer along the stream channel.
Construction techniques and equipment used will be typical of utility installations.

Stream and wetland impacts will be temporary, with the impact areas restored to pre -construction contours. Impact areas will be reseeded with a wetland
seed mix following completion of the installation.
The proposed utility installation has been designed to align with the existing waterline as much as possible along Old Apex Road. The relocation in the
project area is necessary due to the presence of an existing 30-inch RCP culvert underneath Old Apex Road. Due to the presence of the culvert,
installation of the water line within the Old Apex Road right-of-way would require relocation and reconstruction of the existing culvert and roadway.
The corridor will cross the unnamed tributary at a perpendicular angle as it enters a culvert under Old Apex Road, minimizing impacts to the riparian
buffer.
lb. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques:
Construction activities will be conducted under an Erosion and Sediment Control Plan, which will be submitted to NCDEMLR for approval. Construction
access to the proposed corridor will be from high ground, and equipment usage in the jurisdictional areas will be minimized as much as possible,
reducing disturbance to pre -construction contours. Silt fence will be used as appropriate.

Enclosed are attachments to the Town's application for the above -referenced project. The project site
is a water line stream crossing under a UT to Crabtree Creek (Neuse Basin). Applications for
404/401 approvals and Neuse buffer authorization were submitted for this project in 2019 (SAW-
2019-02117 and DWR# 20191230). The project was delayed and the approvals expired. No
chances have been made to the project design or impacts. We are re -applying for the
perm its/approvals.
The Town proposes the following:
1. Clearing/grubbing of a 20-foot corridor at the location of the stream crossing for the purposes of
installing the water line;
2. Open -cut installation of the water line beneath the intermittent UT to Crabtree Creek;
3. Restore the pre -project contours of the stream bed and banks; and
4. Re -vegetate the corridor with a wetland seed mix in the wetland, and grass for the remainder of
the corridor. A 20-foot utility easement will be maintained.
Proposed impacts are 0.003 acres of forested headwater wetland (temporary; converted to herbaceous
wetland), 20 LF of temporary stream impact, and 1,358 SF of Z1 buffer impacts/831 SF of Zone 2
impacts.
We are proposing the work be covered under a NW 58 from USACE and corresponding GC 4276, and
a Neuse Lake buffer authorization for impacts associated with clearing the 20-foot easement and re -
vegetating with herbaceous vegetation.

Hello Crystal,
Unfortunately the previous authorization was issued under a General Certification (and Nationwide
Permits with the USACE) that no longer exists, therefore we have no ability to issue an extension.
You will need to submit a new application for a new authorization. I believe that the USACE is likely
to request the same, I have copied Ms. Gibby so she is aware of your situation.
In submittal of a new application, you can use the original application submittal date as the "pre -
filing request date" on the PCN form and please indicate that this is a request to reissue a previously
approved project with no changes. That will help us process it efficiently as we won't need to re -
review the project in detail.

Good afternoon Kelsey —
The Town of Cary (TOC) had previously received a 401 permit approval for the Old Apex Waterline
Reinforcement which includes the installation of a new 24-inch waterline along a portion of Old Apex
Rd. I have attached the permit number DWR# 19-1230 from November 2019 for your reference.
This project was put on hold in 2021, however TOC is ready to begin moving this project forward
again. TOC would like to request an extension of this permit. Please let me know what steps need
to be taken to extend the permit approval for this project. The project was fully designed when it
was placed on hold and no changes have been made to the design in the interim.

benefit of the TOWN OF CARY, a municipal corporation of the State of North Carolina, with a mailing
address of P.O. Box 8005, Cary, NC 27512-8005, Grantee. The designation Grantors and Grantee as
used herein shall include said parties, their heirs, successors and assigns, and shall include the singular,
plural, masculine, feminine or neuter as required by context.
WITNESSETH:
WHEREAS, the Grantors are the owners of a certain lot or parcel of land with a site address of
1405 Old Apex Road, located in Wake County, North Carolina and more particularly described in Deed
Book 15875 at Page 196, Wake County Registry ("Grantor Property"), and have agreed to convey to the
Grantee, according to the terms set forth below, the permanent utility and pipeline easement interest
hereafter described; and
WHEREAS, Grantee desires the permanent utility and pipeline easement.
NOW THEREFORE, for good and valuable consideration, the receipt of which is hereby
acknowledged, the Grantors hereby give, grant, bargain, sell, and convey unto the Grantee, its successors
and assigns, the right, privilege and permanent Utility and Pipeline Easement in, on, over, under, along,

This Utility and Pipeline Easement is for utility purposes including to improve, upgrade, remove, inspect,
replace, repair, maintain, use and operate such pipelines, laterals, interceptors, mains, manholes, conduits,
facilities and related appurtenances within the UPE are as may be necessary or convenient for the receipt,
conveyance, transmission and distribution of water, reclaimed water, and/or wastewater and for access
thereto.
Further Specific Terms and Conditions Applicable to the UPE:
Grantors shall not obstruct, encroach upon, or utilize the UPE in any way that interferes with its
use by Grantee as provided hereunder. The placing or planting of trees and shrubs and the
placing or installation of structures and improvements are deemed to interfere with Grantee's use,
unless permitted in accordance with paragraph 3 below.
Grantee may remove, clear and keep removed from the UPE any structures, fill, embankments,
trees, plants and other vegetation, materials, improvements and obstructions of any nature.
Following completion of initial installation, Grantee shall restore all disturbed areas in
accordance with generally accepted engineering and landscaping practices located in the UPE as
of the date hereof as a result of the exercise of the Grantee's rights hereunder. Grantor may elect
to plant ground cover or grasses. Certain encroachments within the UPE may thereafter be

permitted by Grantee in accordance with Grantee policies and procedures and in accordance with
a valid executed Town of Cary Encroachment Agreement, provided Grantors bear all risk of
damage to any such encroachment caused by Grantee exercising its rights hereunder.
Grantors shall retain fee simple ownership of the UPE, provided however, no use may be made of
the UPE by Grantor which interferes with Grantee's rights hereunder.
TO HAVE AND TO HOLD the aforesaid permanent and perpetual Utility and Pipeline Easement
and all privileges and appurtenances thereunto belonging to the said Grantee forever and the aforesaid
Temporary Construction Easement and all privileges and appurtenances thereunto belonging to the said
Grantee for the time period stated above. Grantors do warrant and covenant that they are seized of the
UPE and TCE areas in fee and have the right to grant and convey this UPE and TCE and that they will
warrant and defend the said grant of easement against claims of all persons whomsoever.

You have our approval for the impacts listed below for the purpose described in your
application received by the Division of Water Resources (Division) on September 16, 2019 with
payment received on September 18, 2019. These impacts are covered by the attached Water
Quality General Certification Number 4133 and the conditions listed below. This certification is
associated with the use of Nationwide Permit Number 12 once it is issued to you by the U.S.
Army Corps of Engineers. Please note that you should get any other federal, state or local
permits before proceeding with your project, including those required by (but not limited to)
Sediment and Erosion Control, Non -Discharge, and Water Supply Watershed regulations.
This approval requires you to follow the conditions listed in the enclosed certification and the
following additional conditions:

2. Stormwater Management Plan (SMP) Approval from Local Community Required
The stormwater management plan (SMP) must be approved by the Town of Wake Cary and
meet the requirements of this Certification. The SMP may not be modified without prior
written authorization from the Town of Cary. [15A NCAC 02H .0506(b)(3)]
3. The permittee shall report to the Raleigh Regional Office any noncompliance with this
certification, any violation of stream or wetland standards [15A NCAC 02B .0200] including
but not limited to sediment impacts, and any violation of state regulated riparian buffer
rules [15A NCAC 02B .0200]. Information shall be provided orally within 24 hours (or the
next business day if a weekend or holiday) from the time the applicant became aware of the
circumstances. A written submission shall also be provided within 5 business days of the
time the applicant becomes aware of the circumstances. The written submission shall
contain a description of the noncompliance, and its causes; the period of noncompliance,
including exact dates and times, if the noncompliance has not been corrected, the
anticipated time compliance is expected to continue; and steps taken or planned to reduce,
eliminate, and prevent reoccurrence of the noncompliance. The Division may waive the
written submission requirement on a case -by -case basis.
4. Protective Fencing
The outside buffer, wetland or water boundary and along the construction corridor within
these boundaries approved under this authorization shall be clearly marked with orange
warning fencing (or similar high visibility material) for the areas that have been approved to
infringe within the buffer, wetland or water prior to any land disturbing activities to ensure
compliance with 15 NCAC 02H .0500. [15A NCAC 02H .0506 (b)(2) and (c)(2) and 15A NCAC
02H .0507 (c)]

5. This approval is for the purpose and design described in your application. The plans and
specifications for this project are incorporated by reference as part of the Certification and
Buffer Authorization. If you change your project, you must notify the Division and you may
be required to submit a new application package with the appropriate fee. If the property is
sold, the new owner must be given a copy of this approval letter and General Certification
and is responsible for complying with all conditions. [15A NCAC 02B .0507(d)(2)]
This approval and its conditions are final and binding unless contested. [G.S. 143-215.5]
This Certification and Buffer Authorization can be contested as provided in General Statute
150E by filing a written petition for an administrative hearing to the Office of Administrative
Hearings (hereby known as OAH) within sixty (60) calendar days.
A petition form maybe obtained from the OAH at http://www.ncoah.com/ or by calling the OAH
Clerk's Office at (919) 431-3000 for information. A petition is considered filed when the original
and one (1) copy along with any applicable OAH filing fee is received in the OAH during normal
office hours (Monday through Friday between 8:00am and 5:00pm, excluding official state
holidays).
The petition may be faxed to the OAH at (919) 431-3100, provided the original and one copy of
the petition along with any applicable OAH filing fee is received by the OAH within five (5)
business days following the faxed transmission.

Location description: The proiect site is located on the east site of Old Apex Road, south of its intersection with West Chatham
Street, near the town of Cary, Wake County, North Carolina.
Description of projects area and activity: This permit verificiation allows for 148 square feet of temporary wetland impacts and
20 linear feet of temporary stream channel impacts from open cutting for the replacement of an existing water line crossing.
No mitigation is required for this proposal.

Your work is authorized by the above referenced permit provided it is accomplished in strict accordance with the enclosed
Conditions, your application signed and dated 9/16/2019, and the enclosed plans entitled "Old Apex Road waterline
reinforcement" dated 10/5/2018. Any violation of the attached conditions or deviation from your submitted plans may subject
the permittee to a stop work order, a restoration order, a Class I administrative penalty, and/or appropriate legal action.
This verification will remain valid until the expiration date identified below unless the nationwide authorization is modified, suspended
or revoked. If, prior to the expiration date identified below, the nationwide permit authorization is reissued and/or modified, this
verification will remain valid until the expiration date identified below, provided it complies with all requirements of the modified
nationwide permit. If the nationwide permit authorization expires or is suspended, revoked, or is modified, such that the activity would
no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are under construction)
or are under contract to commence in reliance upon the nationwide permit, will remain authorized provided the activity is completed
within twelve months of the date of the nationwide permit's expiration, modification or revocation, unless discretionary authority has
been exercised on a case -by -case basis to modify, suspend or revoke the authorization.
Activities subject to Section 404 (as indicated above) may also require an individual Section 401 Water Quality Certification. You
should contact the NC Division of Water Resources (telephone 919-807-6300) to determine Section 401 requirements.
For activities occurring within the twenty coastal counties subject to regulation under the Coastal Area Management Act (LAMA), prior
to beginning work you must contact the N.C. Division of Coastal Management Morehead City, NC, at (252) 808-2808.

SECTION I - The Prollowing identifies your righ and options regarding an administrative appeal of the above decision.

A: INITIAL PROFFERED PERMIT: You may accept or object to the permit.
• ACCEPT: If you received a Standard Permit, you may sign the permit document and return it to the district engineer for final
authorization. If you received a Letter of Permission (LOP), you may accept the LOP and your work is authorized. Your
signature on the Standard Permit or acceptance of the LOP means that you accept the permit in its entirety, and waive all
rights to appeal the permit, including its terms and conditions, and approved jurisdictional determinations associated with the
permit.
• OBJECT: If you object to the permit (Standard or LOP) because of certain terms and conditions therein, you may request
that the permit be modified accordingly. You must complete Section II of this form and return the form to the district
engineer. Your objections must be received by the district engineer within 60 days of the date of this notice, or you will
forfeit your right to appeal the permit in the future. Upon receipt of your letter, the district engineer will evaluate your
objections and may: (a) modify the permit to address all of your concerns, (b) modify the permit to address some of your
