Dear Mr. Biehl:
In accordance with the application for discharge permit, the Division is forwarding herewith the
subject NPDES permit. This permit is issued pursuant to the requirements of North Carolina General
Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S.
Environmental Protection Agency dated May 9, 1994.
Based on the letter dated September 4, 2001, Brenntag Southeast, Inc. has acquired Worth
Chemical Corporation, Inc. This permit has been modified to reflect the new owner Brenntag Southeast,
Inc. No other comments were received on the draft permit and no other changes were made to this final
permit.
If any parts, measurement frequencies, or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty
(30) days following receipt of this letter. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the office of
Administrative Hearings, Mail Service Center 6714, Raleigh, North Carolina 27699-6714. Unless such
a demand is made, this permit shall be final and binding.
Please take notice that this permit is not transferable except after notice to the Division of
Water Quality. The Division of Water Quality may require modification or revocation and reissuance of
the permit.
This permit does not affect the legal requirements to obtain other permits which may be required by
the Division of Water Quality, the Division of Land Resources, the Coastal Area Management Act, or any
other federal or local governmental permit.

stage air stripper located at HCI Boulevard, Greensboro, Guilford County, and,
2. Discharge wastewater from said treatment works (Outfall 001) at the location specified
on the attached map into an unnamed tributary to South Buffalo Creek which is
classified C NSW waters in the Cape Fear River Basin.

A. (1.) EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS — FINAL
During the period beginning on the effective date of the permit and lasting until expiration, the
Permittee is authorized to discharge 0.216 MGD of remediated groundwater from outfal1001.

There shall be no discharge of floating solids or visible foam in other than trace amounts.

A. (2.) CHRONIC TOXICITY PERMIT LIMIT (QRTRLY)
The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to
Ceriodaphnia dubia at an effluent concentration of 22 %.
The permit holder shall perform at a minimum, guarterfu monitoring using test procedures outlined in the
"North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent
versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February
1998) or subsequent versions. The tests will be performed during the months of January, April. July, and
October. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent
discharge below all treatment processes.
If the test procedure performed as the first test of any single quarter results in a failure or ChV below
the permit limit, then multiple -concentration testing shall be performed at a minimum, in each of
the two following months as described in "North Carolina Phase H Chronic Whole Effluent Toxicity
Test Procedure" (Revised -February 1998) or subsequent versions.
The chronic value for multiple concentration tests will be determined using the geometric mean of the
highest concentration having no detectable impairment of reproduction or survival and the lowest
concentration that does have a detectable impairment of reproduction or survival. The definition of
"detectable impairment," collection methods, exposure regimes, and further statistical methods are specified
In the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or
subsequent versions.
All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge
Monitoring Form (MR-1) for the months in which tests were performed, using the parameter code TGP3B for
the pass/fail results and THP3B for the Chronic Value. Additionally, DWQ Form AT-3 (original) is to be sent
to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Branch no later than
30 days after the end of the reporting period for which the report is made.
Test data shall be complete, accurate, include all supporting chemical/physical measurements and all
concentration/response data, and be certified by laboratory supervisor and ORC or approved designate
signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is
employed for disinfection of the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is
required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form
indicating the facility name, permit number, pipe number, county, and the month/year of the report with the
notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental
Sciences Branch at the address cited above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will
be required during the following month.
Should any test data from this monitoring requirement or tests performed by the North Carolina Division of
Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified
to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival, minimum control organism reproduction, and appropriate environmental controls, shall
constitute an invalid test and will require immediate follow-up testing to be completed no later than the last
day of the month following the month of the initial monitoring.

(a) The name and state of incorporation of each of the constituent corporations of the
merger are as follows:

corporation, which is surviving the merger, existing on the effective date of the merger shall
continue in full force as the Articles of Incorporation of the Survivor Corporation until they are
duly altered, amended or repealed. The by-laws of Brenntag Southeast, Inc., which is surviving
the merger, existing on the effective date of the Merger shall continue in full force as the by-laws
of the Survivor Corporation until they are duly altered, amended or repealed.
(d) Each share of common stock of the merged corporation which shall be outstanding
on the effective date of this merger, and all rights in respect thereto shall forthwith be changed
and converted into one share of common stock of the surviving corporation. After the effective
date of this merger, each holder of an outstanding certificate representing shares of common
stock of the merged corporation shall surrender the same to the surviving corporation and each
such holder shall be entitled upon such surrender to receive the number of shares of common
stock of the surviving corporation on the basis provided herein. Until so surrendered, the
outstanding shares of stock of the merged corporation to be converted into the stock of the
surviving corporation as provided herein, may be treated by the surviving corporation for all
corporate purposes as evidencing the ownership of shares of the surviving corporations as though
said surrender and exchange had taken place. After the effective date of this merger, each
registered owner of any uncertificated shares of common stock of -the merged corporation shall
have said shares of cancelled and said registered owner shall be entitled to the number of
common shares of the surviving corporation on the basis provided herein.
(e) The Plan of Merger is on file at the principal place of business of the Survivor

SUMMARY
Worth Chemical Corporation operates a groundwater remediation facility. The contamination
occurred as a result of spills collected in Worth's containment pond in the past (the pond has
since been cleaned and filled).
Per the applicant, no changes in the treatment system have taken place since the previous
permit issuance. The applicant requests deletion/relaxation of toluene, benzene, 1,2
dichloroethene, trichloroethene.
Previous notes in the file indicate that the 22% IWC for toxicity testing is likely based on the
final receiving stream - but toxicants are based on the immediate discharge point.

TOXICITY TESTING:
Current (and recommended) Requirement: Chronic P/F Q 22% (Jan, May, Aug, Nov)
The facility has had an exemplary tox record with no failures for the entire previous permit
cycle.
COMPLIANCE SUMMARY: BASED ON THE PREVIOUS 2 YEARS
Per the computer printout, the facility has had no noncompliant incidences.
INSTREAM MONITORING: N/A
TOXICANT ANALYSIS: A reasonable potential analysis (RPA) was conducted for the organic
chemicals required by the permit (toluene, benzene, 1,2-dichloroethene, trichloroethene).
The facility does a range of organic sampling on a quarterly basis and has had non -detect for
parameters monitored (with most at a 5 ug/I detect level).

Dear Mr. Weaver:
Worth Chemical Corporation would like to request the renewal of the above
referenced NPDES Permit for our treated groundwater discharge. Attached please
find a completed permit application and two copies.
There have been no construction changes in our treatment system or the type and
volume of our wastewater discharge since the last permit renewal. Additionally,
the system is not designed to generate solids so no sludge is created.
Based on effluent non -detect lab results since 1993, Worth would like to request
that the organic parameters trans-1,2-Dichloroethene and Trichloroethene be
removed from the effluent organic monitoring requirements in Part III, Condition
G of the permit. Worth also requests that the effluent monitoring requirements for
Toluene and Benzene be removed from Section A of the permit since all lab results
from 1993 to the present have been non -detect for these parameters as well.

The Division is beginning the cycle of permit renewals for the Cape Fear river basin. An examination of the Cape
Fear basin plan and the NPDES permit schedule has revealed that the existing expiration dates in Cape Fear NPDES
permits do not coincide with the revised permit expiration dates for the basin. This discrepancy could create unnecessary
delays in the processing of over 200 permit renewals. Accordingly, the Division is changing the permit expiration dates for
NPDES permits in the Cape Fear river basin.
This permit modification changes the expiration date of the subject permit in subbasin 30602 to June 30, 2001. Please
find enclosed the revised permit cover page. Insert the new cover page into your permit and discard the old page. All
other terms and conditions contained in the original permit remain unchanged and in full effect. This permit modification
is issued under the requirements of North Carolina General Statutes 143-215.1 and the Memorandum of Agreement
between North Carolina and the U. S. Environmental Protection Agency.
In accordance with the modification of the permit expiration date, the new due date for your renewal application is
January 1, 2001. Renewal application forms will be sent to you approximately 6-8 weeks in advance of the new due date
or you may download the forms from the NPDES web site at http://h2o.enr.state.nc.us/NPDES/documents.html.
You will need to download Short Form C-GW. If you have already submitted a permit renewal form, there is no need to
submit any other forms to the Division; the application will be processed during the renewal period for your subbasin.
If any part of this permit modification are unacceptable to you, you have the right to an adjudicatory hearing upon
written request within thirty (30) days following receipt of this letter. This request must be a written petition conforming
to Chapter 150B of the North Carolina General Statutes, filed with the Office of Administrative Hearings (6714 Mail
Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding.

Based on recent discussions with EPA Region IV, the Division of Water Quality (DWQ) is further
modifying its Whole Effluent Toxicity (WET) Enforcement Policy. The primary difference will be
separation of DWQ's application of civil penalties from compliance determinations. Any WET test result
that does not achieve compliance with the NPDES permit limit will be considered a violation of the
permit and the permittee will be sent, at minimum, a Notice of Violation. The Division's new Whole
Effluent Toxicity Enforcement Policy will apply to whole effluent toxicity monitoring initiated on
or after September 1,1999.
Draft NPDES permits sent to public notice after 7/l/99 will contain chronic toxicity test condition
language which specifies follow-up multiple concentration toxicity testing upon any single quarterly test
failure. The first test of the quarter (three-month monitoring period defined by the permit) may be
conducted either as either a pass/fail test or as a multiple concentration (ChV) test. If the pass/fail test
fails or if the chronic value is lower than the permit limit, then a NOV is issued and at least two multiple
concentration tests (one per month) are required over the following two months. NOVs will be generated
for each failure to meet the permit limit. As many analyses as can be completed during the quarter will be
accepted.
Permittees with NPDES permits which contain "old" chronic toxicity pass/fail testing language will have
the OPTION to respond to any single quarterly toxicity test failure with follow-up multiple concentration
toxicity testing or single concentration toxicity testing. The enclosed toxicity test condition language will
be incorporated in the NPDES permit upon permit renewal and/or permit modification. Initiation of
multiple concentration toxicity testing after any single quarterly failure will influence the Division's
enforcement response. Permittees will be issued a NOV for any test result that does not achieve
compliance with the permit limit. A civil penalty will be assessed for each quarter of toxicity
noncompliance based on the arithmetic average of ChVs submitted for the remaining two months of the
quarter.

Important WET Enforcement Policy items are:
I. CHRONIC TOXICITY TESTING
• The first test of the quarter can be conducted as either a pass/fail test or a
chronic value (ChV) test.
• If the pass/fail test fails or if the ChV is lower than the limit, then a NOV is
issued and at least two ChV tests (one per month) will be conducted over the
following two months. As many analyses as can be completed will be
accepted.
• A NOV will be issued for any test result failing to meet the permit limit.
• Any civil penalty assessed will be based on performance over a quarter.
• NPDES Permits containing chronic toxicity pass/fail testing will be modified
upon permit renewal to include the new permit language.
II. ACUTE TOXICITY TESTING
• A NOV will be issued for each acute limit violation.
• A civil penalty will be assessed for any two consecutive acute limit
violations.
Note that no changes have occurred in DWQ's enforcement responses to acute limit noncompliances
since the May 13'' mailing.
Choosing to respond to a chronic "fail' result with a pass/fail test instead of conducting multiple
concentration toxicity testing during the second and third months of the calendar quarter will
result in enforcement for single concentration test results which do not meet chronic toxicity
permit limitations.
As in the past, if you are unable to consistently comply with your toxicity permit limitation, you may
notify your respective Regional Office to discuss the possibility of entering into a Special Order by
Consent (SOC). The SOC provides conditional compliance for permit parameters that the facility can not
consistently comply with and may be issued in situations where facility operation and maintenance are
not in question. If a SOC is signed by the permittee/DWQ and contains toxicity as a noncompliant
parameter, you will be required to: conduct a Toxicity Reduction Evaluation (TRE), submit quarterly
THE progress reports, and reduce/eliminate effluent toxicants to acceptable levels.

CHRONIC TOXICITY PERMIT LIMIT (QRTRLY)
The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to
Ceriodaphnia dubia at an effluent concentration of %.
The permit holder shall perform at a minimum, Quarterly monitoring using test procedures outlined in the "North Carolina
Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Carolina
Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The tests will
be performed during the months of . Effluent sampling for this testing shall be performed at the NPDES
permitted final effluent discharge below all treatment processes.
If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then
multiple -concentration testing shall be performed at a minimum, in each of the two following months as described in "North
Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions.
The chronic value for multiple concentration tests will be determined using the geometric mean of the highest concentration
having no detectable impairment of reproduction or survival and the lowest concentration that does have a detectable
impairment of reproduction or survival. The definition of "detectable impairment," collection methods, exposure regimes,
and further statistical methods are specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test
Procedure" (Revised -February 1998) or subsequent versions.
All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring
Form (MR-1) for the months in which tests were performed, using the parameter code TGP3B for the pass/fail results and
THP3B for the Chronic Value. Additionally, DWQ Form AT-3 (original) is to be sent to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Branch no later than 30 days after
the end of the reporting period for which the report is made.
Test data shall be complete, accurate, include all supporting chemical/physical measurements and all
concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature. Total
residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of
the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the
permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name,
permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area
of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required
during the following month.
Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality
indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate
monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival,
minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will
require immediate follow-up testing to be completed no later than the last day of the month following the month of the
initial monitoring.
