Project Description: NCDOT intends to replace Bridge No. 186 on SR 2329, Lizard Lick Road, over
Rocky Branch northwest of Zebulon. The proposed replacement structure will be in the same location as
the original structure. The length of the proposed project is listed at 1056 feet (nearly 321.86 meters).
Right-of-way (ROW) at the crossing was not provided with the review request, but an arbitrary 300-foot
(91.44-meter) wide study corridor was included with the project mapping. For the purposes of the current
archaeological review this corridor will be considered to be the area of potential effects (APE). Thus, the
proposed APE incorporates an area of more than 7.27 acres (over 2.94 hectares).
SUMMARY OF CULTURAL RESOURCES REVIEW
Brief description of review activities, results of review, and conclusions:
A review of the site maps and files archived at the North Carolina Office of State Archaeology (OSA)
was conducted on October 17, 2016. One previously identified archaeological sites is recorded within the
proposed APE: 31WA826. This site was one of 104 archaeological resources recorded by Archaeological
Research Consultants, Inc., as part of the archaeological survey for a proposed Little River Reservoir
(Hargrove 1991). In general, that study examined areas below the 280-foot contour line (AMSL) in the
Little River drainage basin. In areas of low surface visibility the survey area was examined through the
excavation of subsurface tests at a 30-meter interval. A handful of archaeological sites were identified
along the Rocky Branch portion of the study area including sites 31WA797, 31WA826, 31WA838 and
31WA839. But, of these sites only 31WA826, a small Woodland-period site, falls within the limits of the
current APE. Two Native American ceramic sherds and a handful of lithic debitage (described as quartz
and felsic material) were recovered from a cultivated field on the ridgetoe overlooking the creek from the
north. Hargrove (1991:48) described the site as having a low density of archaeological remains and a
high degree of disturbance from plowing and soil erosion. He considered the site to have little potential
for additional research.
An examination of the data presented on the North Carolina State Historic Preservation Office HPOWEB
GIS Service (http://gis.ncdcr.gov/hpoweb/) reveals that the following historic properties are located
within a .5-mile radius: the former location of the Study-listed, early 19th-century Georgian frame, John
Perry House (WA1943) and the 1921 Colonial Revival/Craftsman B.K. Horton House. Neither of these
properties extend into the current APE.
An examination of soils in Wake County presented on the National Resources Conservation Service Web
Soil Survey (http://websoilsurvey.nrcs.usda.gov/app/WebSoilSurvey.aspx) indicates that the following
soil types fall within the delineated APE: Appling sandy loam, 6 to 10 percent slopes (ApC); Appling
sandy loam, 6 to 10 percent slopes, moderately eroded (ApC2); Colfax sandy loam, 0 to 3 percent slopes

(CnA); Louisburg loamy sand, 6 to 10 percent slopes (LoC); Mantachie sandy loam, 0 to 2 percent slopes,
rarely flooded (MeA); Wake-Wateree complex, 10 to 25 percent slopes, very rocky (WkE); Wehadkee silt
loam, 0 to 2 percent slopes, frequently flooded (WnA); and Wehadkee and Bibb soils, 0 to 2 percent
slopes, frequently flooded (WoA).
No further archaeological investigations are required for the project within the area established as the
current APE. Should the project change to include a larger footprint than covered by the current APE,
further consultation will be necessary. In the unlikely event that archaeological remains are encountered
during the bridge replacement, work should cease in that area and the NCDOT Archaeology Group
should be notified immediately.
Brief Explanation of why the available information provides a reliable basis for reasonably predicting
that there are no unidentified historic properties in the APE:
While the current APE does extend well beyond the disturbed portions of the landscape associated with
the transportation facility, it appears to fall entirely (or nearly completely) within the survey area
examined by Hargrove. As noted above Hargrove did identify an archaeological site near the proposed
project, that is mapped in OSA records as extending downslope from the ridgetoe west of SR 2329 into
the current APE. That site does not appear to have been explicitly assessed for National Register of
Historic Places (NRHP) eligibility, but the estimation that the site retained a low potential for additional
archaeological information may be assumed to answer questions of NRHP eligibility. The description of
the Little River Reservoir project area and the identification of an archaeological site near Bridge No.186,
strongly imply that most if not all of the current APE has already been investigated by archaeologists with
Archaeological Research Consultants in 1991.

on timber joists with timber caps and piles. The proposed crossing is located in Zone AE of FIRM Map number 3720178600J and was studied by “Detailed” methods. The
proposed culvert consists of 2 @ 14'X10' RCBC with 6" top bevel with 1' sill in north barrel and 2' sill in south barrel. Both the proposed and existing stormwater runoff flows off
the road and over grassed shoulders on both sides.

State project 17BP.5.R.86 involves the replacement of the existing NCDOT Bridge #910186 on SR 2329 over Rocky Branch. Bridge #910186 consists of 2@17’-7” timber floor
on timber joists with timber caps and piles. The proposed crossing is located in Zone AE of FIRM Map number 3720178600J and was studied by “Detailed” methods. The
proposed culvert consists of 2 @ 14'X10' RCBC with 6" top bevel with 1' sill in north barrel and 2' sill in south barrel. Both the proposed and existing stormwater runoff flows off
the road and over grassed shoulders on both sides.

Minimization - 2:1 side slopes were utilized to minimize impacts to jurisdictional features. Erosion Control - Bank stabilization with Class II rip rap
will be utilized up and downstream to avoid bank erosion. Impervious dikes will be used during the construction of the culvert. Silt fence will be
installed along the fill slopes. Minimize Clearing - During the construction of the proposed culvert and roadway there shall be minimal clearing of
vegetation on the existing shoulders and side slopes.

The birds listed below are birds of particular concern either because they occur on the USFWS Birds of Conservation
Concern (BCC) list or warrant special attention in your project location. To learn more about the levels of concern for birds
on your list and how this list is generated, see the FAQ below. This is not a list of every bird you may nd in this location, nor a
guarantee that every bird on this list will be found in your project area. To see exact locations of where birders and the
general public have sighted birds in and around your project area, visit the E-bird data mapping tool (Tip: enter your location,
desired date range and a species on your list). For projects that occur o the Atlantic Coast, additional maps and models
detailing the relative occurrence and abundance of bird species on your list are available. Links to additional information
about Atlantic Coast birds, and other important information about your migratory bird list, including how to properly
interpret and use your migratory bird report, can be found below.
For guidance on when to schedule activities or implement avoidance and minimization measures to reduce impacts to

BREEDING SEASON
Certain birds are protected under the Migratory Bird Treaty Act and the Bald and Golden Eagle Protection Act .
Any person or organization who plans or conducts activities that may result in impacts to migratory birds, eagles, and their
habitats should follow appropriate regulations and consider implementing appropriate conservation measures, as described
below.

Probability of Presence Summary
The graphs below provide our best understanding of when birds of concern are most likely to be present in your project
area. This information can be used to tailor and schedule your project activities to avoid or minimize impacts to birds. Please
make sure you read and understand the FAQ "Proper Interpretation and Use of Your Migratory Bird Report" before using or
attempting to interpret this report.
Probability of Presence ()
Each green bar represents the bird's relative probability of presence in the 10km grid cell(s) your project overlaps during a
particular week of the year. (A year is represented as 12 4-week months.) A taller bar indicates a higher probability of species
presence. The survey e ort (see below) can be used to establish a level of con dence in the presence score. One can have
higher con dence in the presence score if the corresponding survey e ort is also high.
How is the probability of presence score calculated? The calculation is done in three steps:
1. The probability of presence for each week is calculated as the number of survey events in the week where the species was
detected divided by the total number of survey events for that week. For example, if in week 12 there were 20 survey
events and the Spotted Towhee was found in 5 of them, the probability of presence of the Spotted Towhee in week 12 is
0.25.
2. To properly present the pattern of presence across the year, the relative probability of presence is calculated. This is the
probability of presence divided by the maximum probability of presence across all weeks. For example, imagine the
probability of presence in week 20 for the Spotted Towhee is 0.05, and that the probability of presence at week 12 (0.25) is
the maximum of any week of the year. The relative probability of presence on week 12 is 0.25/0.25 = 1; at week 20 it is
0.05/0.25 = 0.2.

Yellow bars denote a very liberal estimate of the time-frame inside which the bird breeds across its entire range. If there are
no yellow bars shown for a bird, it does not breed in your project area.

Vertical black lines superimposed on probability of presence bars indicate the number of surveys performed for that species
in the 10km grid cell(s) your project area overlaps. The number of surveys is expressed as a range, for example, 33 to 64
surveys.

No Data ()
A week is marked as having no data if there were no survey events for that week.
Survey Timeframe
Surveys from only the last 10 years are used in order to ensure delivery of currently relevant information. The exception to
this is areas o the Atlantic coast, where bird returns are based on all years of available data, since data in these areas is
currently much more sparse.

Nationwide Conservation Measures describes measures that can help avoid and minimize impacts to all birds at any location year round.
Implementation of these measures is particularly important when birds are most likely to occur in the project area. When birds may be
breeding in the area, identifying the locations of any active nests and avoiding their destruction is a very helpful impact minimization measure.
To see when birds are most likely to occur and be breeding in your project area, view the Probability of Presence Summary. Additional
measures or permits may be advisable depending on the type of activity you are conducting and the type of infrastructure or bird species
present on your project site.
What does IPaC use to generate the list of migratory birds that potentially occur in my speci ed location?
The Migratory Bird Resource List is comprised of USFWS Birds of Conservation Concern (BCC) and other species that may warrant special
attention in your project location.
The migratory bird list generated for your project is derived from data provided by the Avian Knowledge Network (AKN). The AKN data is based
on a growing collection of survey, banding, and citizen science datasets and is queried and ltered to return a list of those birds reported as
occurring in the 10km grid cell(s) which your project intersects, and that have been identi ed as warranting special attention because they are a
BCC species in that area, an eagle (Eagle Act requirements may apply), or a species that has a particular vulnerability to o shore activities or
development.
Again, the Migratory Bird Resource list includes only a subset of birds that may occur in your project area. It is not representative of all birds
that may occur in your project area. To get a list of all birds potentially present in your project area, please visit the Rapid Avian Information

What does IPaC use to generate the probability of presence graphs for the migratory birds potentially occurring in my speci ed location?
The probability of presence graphs associated with your migratory bird list are based on data provided by the Avian Knowledge Network (AKN).
This data is derived from a growing collection of survey, banding, and citizen science datasets.
Probability of presence data is continuously being updated as new and better information becomes available. To learn more about how the
probability of presence graphs are produced and how to interpret them, go the Probability of Presence Summary and then click on the "Tell me
about these graphs" link.
How do I know if a bird is breeding, wintering or migrating in my area?
To see what part of a particular bird's range your project area falls within (i.e. breeding, wintering, migrating or year-round), you may query your
location using the RAIL Tool and look at the range maps provided for birds in your area at the bottom of the pro les provided for each bird in
your results. If a bird on your migratory bird species list has a breeding season associated with it, if that bird does occur in your project area,
there may be nests present at some point within the timeframe speci ed. If "Breeds elsewhere" is indicated, then the bird likely does not breed
in your project area.
What are the levels of concern for migratory birds?
Migratory birds delivered through IPaC fall into the following distinct categories of concern:
1. "BCC Rangewide" birds are Birds of Conservation Concern (BCC) that are of concern throughout their range anywhere within the USA
(including Hawaii, the Paci c Islands, Puerto Rico, and the Virgin Islands);
2. "BCC - BCR" birds are BCCs that are of concern only in particular Bird Conservation Regions (BCRs) in the continental USA; and
3. "Non-BCC - Vulnerable" birds are not BCC species in your project area, but appear on your list either because of the Eagle Act requirements
(for eagles) or (for non-eagles) potential susceptibilities in o shore areas from certain types of development or activities (e.g. o shore
energy development or longline shing).
Although it is important to try to avoid and minimize impacts to all birds, e orts should be made, in particular, to avoid and minimize impacts to
the birds on this list, especially eagles and BCC species of rangewide concern. For more information on conservation measures you can

Details about birds that are potentially a ected by o shore projects
For additional details about the relative occurrence and abundance of both individual bird species and groups of bird species within your
project area o the Atlantic Coast, please visit the Northeast Ocean Data Portal. The Portal also o ers data and information about other taxa
besides birds that may be helpful to you in your project review. Alternately, you may download the bird model results les underlying the portal
maps through the NOAA NCCOS Integrative Statistical Modeling and Predictive Mapping of Marine Bird Distributions and Abundance on the
Atlantic Outer Continental Shelf project webpage.

Bird tracking data can also provide additional details about occurrence and habitat use throughout the year, including migration. Models relying
on survey data may not include this information. For additional information on marine bird tracking data, see the Diving Bird Study and the

What if I have eagles on my list?
If your project has the potential to disturb or kill eagles, you may need to obtain a permit to avoid violating the Eagle Act should such impacts
occur.
Proper Interpretation and Use of Your Migratory Bird Report
The migratory bird list generated is not a list of all birds in your project area, only a subset of birds of priority concern. To learn more about how
your list is generated, and see options for identifying what other birds may be in your project area, please see the FAQ "What does IPaC use to
generate the migratory birds potentially occurring in my speci ed location". Please be aware this report provides the "probability of presence"
of birds within the 10 km grid cell(s) that overlap your project; not your exact project footprint. On the graphs provided, please also look
carefully at the survey e ort (indicated by the black vertical bar) and for the existence of the "no data" indicator (a red horizontal bar). A high
survey e ort is the key component. If the survey e ort is high, then the probability of presence score can be viewed as more dependable. In
contrast, a low survey e ort bar or no data bar means a lack of data and, therefore, a lack of certainty about presence of the species. This list is
not perfect; it is simply a starting point for identifying what birds of concern have the potential to be in your project area, when they might be
there, and if they might be breeding (which means nests might be present). The list helps you know what to look for to con rm presence, and
helps guide you in knowing when to implement conservation measures to avoid or minimize potential impacts from your project activities,

Wetlands in the National Wetlands Inventory (NWI)
Impacts to NWI wetlands and other aquatic habitats may be subject to regulation under Section 404 of the Clean Water Act,
or other State/Federal statutes.

Please note that the NWI data being shown may be out of date. We are currently working to update our NWI data set. We
recommend you verify these results with a site visit to determine the actual extent of wetlands on site.

Data limitations
The Service's objective of mapping wetlands and deepwater habitats is to produce reconnaissance level information on the location, type and
size of these resources. The maps are prepared from the analysis of high altitude imagery. Wetlands are identi ed based on vegetation, visible
hydrology and geography. A margin of error is inherent in the use of imagery; thus, detailed on-the-ground inspection of any particular site may
result in revision of the wetland boundaries or classi cation established through image analysis.
The accuracy of image interpretation depends on the quality of the imagery, the experience of the image analysts, the amount and quality of
the collateral data and the amount of ground truth veri cation work conducted. Metadata should be consulted to determine the date of the
source imagery used and any mapping problems.
Wetlands or other mapped features may have changed since the date of the imagery or eld work. There may be occasional di erences in
polygon boundaries or classi cations between the information depicted on the map and the actual conditions on site.

Certain wetland habitats are excluded from the National mapping program because of the limitations of aerial imagery as the primary data
source used to detect wetlands. These habitats include seagrasses or submerged aquatic vegetation that are found in the intertidal and subtidal
zones of estuaries and nearshore coastal waters. Some deepwater reef communities (coral or tuber cid worm reefs) have also been excluded
from the inventory. These habitats, because of their depth, go undetected by aerial imagery.
Data precautions
Federal, state, and local regulatory agencies with jurisdiction over wetlands may de ne and describe wetlands in a di erent manner than that
used in this inventory. There is no attempt, in either the design or products of this inventory, to de ne the limits of proprietary jurisdiction of
any Federal, state, or local government or to establish the geographical scope of the regulatory programs of government agencies. Persons
intending to engage in activities involving modi cations within or adjacent to wetland areas should seek the advice of appropriate Federal, state,
or local agencies concerning speci ed agency regulatory programs and proprietary jurisdictions that may a ect such activities.

This letter is in response to your letter of January 14, 2022 which provided the U.S. Fish and Wildlife
Service (Service) with the biological conclusion of the North Carolina Department of Transportation
that the replacement of Bridge No. 186 on SR 2329 over Rocky Branch in Wake County with a two-
barrel 14’x10’ box culvert may affect, but is not likely to adversely affect the federally listed Dwarf
Wedgemussel (Alasmidonta heterodon), Yellow Lance (Elliptio lanceolata), Atlantic Pigtoe
(Fusconaia masoni), Tar River Spinymussel (Elliptio steinstansana), Carolina Madtom (Noturus
furiosus), and Neuse River Waterdog (Necturus lewisi). The following response is provided in
accordance with Section 7 of the Endangered Species Act (ESA) of 1973, as amended (16 U.S.C.
1531-1543).
The Service previously provided concurrence with your biological conclusion for the Dwarf
Wedgemussel, Yellow Lance, and Atlantic Pigtoe with a letter dated December 4, 2018. That
concurrence was based, in part, on a mussel survey report from 2017 indicating less than optimal
habitat and only a relatively small number of common Elliptio complanata being observed.
According to submitted information, additional surveys were conducted at the project site for the
Neuse River Waterdog and Carolina Madtom on March 4, 2019 and April 3, 2019, respectively.
Neither species was observed, and habitat was less than optimal. Review of aerial photographs from
2021 and several years prior reveal a shallow water wetland system isolates the bridge/culvert site
from good quality habitat downstream in the Little River.
Based on survey results and over available information, the Service concurs with your conclusion
that the proposed action may affect, but is not likely to adversely affect the Dwarf Wedgemussel,
Yellow Lance, Atlantic Pigtoe, Tar River Spinymussel, Carolina Madtom, and Neuse River
Waterdog. We believe that the requirements of Section 7(a)(2) of the ESA have been satisfied. We
remind you that obligations under Section 7 consultation must be reconsidered if: (1) new
information reveals impacts of this identified action that may affect listed species or critical habitat in
a manner not previously considered in this review; (2) this action is subsequently modified in a
manner that was not considered in this review; or (3) a new species is listed or critical habitat
determined that may be affected by this identified action. If you have any questions regarding our

Given the braided, shallow wetland conditions that continue to persist both downstream and upstream of the
bridge crossing, the habitat continues to be poor quality for all the listed aquatic species. Therefore, our
previous concurrence is still valid even if the project let date slips to 2024. For the broader question regarding
whether a signed concurrence letter means no further coordination is needed, I would say no. Each situation is
different. When we provide a concurrence letter, the response is based, in part, on the age of the survey data
and the expectation of when the project will be let. There will certainly be times when a slipped let date will
generate the need for additional surveys. However, if habitat quality is poor such as this case, we have more
flexibility in not requiring any additional surveys.

The USFWS provided updated informal consultation for this project in a letter dated January 18, 2022 (see
attached). The consultation provided findings of MA-NLAA for Dwarf wedgemussel, Yellow lance, Atlantic pigtoe, Tar
River spinymussel, Carolina madtom and Neuse River waterdog. Reviews of aerial photographs continue to depict
shallow water wetlands at the bridge site that isolates the bridge/culvert site from good quality habitat downstream in
the Little River.
The following below email chain provides the history on surveys and informal consultations for this
project. Unfortunately, let dates for Division-managed bridge projects continue to slide (due to ROW issues, utility
issues and funding issues), with many projects tentatively schedule for let at least a year or even two years than what
was previously proposed and provided to you in earlier correspondence. This issue is additionally compounded with the
knowledge that several of these projects could at any time be accelerated due to unforeseen opportunities for

funding. Environmental planning on these projects is a double-edged sword, as we are required to have shovel-ready
projects that can be started at almost any time. There is no great pathway except to have projects ready to go…..one big
issue on all of these projects is to ensure that protected aquatic species surveys are up to date.
The Division has continually provided you with up to date information on the possible letting of this particular
project. The most recent informal consultation does not provide direct information on how long the information can be
relied on for construction. The most recent revised let date for this project is now at July 2024. But, this project could
be accelerated based on my conversation with the bridge program manager. Accordingly, we need to make decisions
about the survey needs to catch NRWD surveys in the fall and mussel/CMT surveys next spring/summer.
Can you provide any information concerning the need for updated surveys for this project if the letting slips to 2022? I
am unsure of the full issues/responsibilities on our part/implications of previously completed informal consultation for
this (and other projects). Does the signed consultation indicate that no further coordination is necessary, no matter the
expected date of let and construction (even if it slips further and further into the future)?

The Department has been coordinating this project with your agency since December 2016. Initial coordination was
focused on the decision to replace the existing 2@ 17 ft, 7 in bridge structure with a 2 @ 14 ft x 10 ft Reinforced
Concrete Box Culvert (note: a one foot sill will be installed in the north barrel and a two foot sill will be installed in the
south barrel). A freshwater mussel survey was conducted at the bridge site by staff members of RK&K on February 27,
2017. A total of 2.5 person hours of survey indicated the presence of Eastern Elliptio. The habitat in Rocky Branch varies
from shallow cascades of water over bedrock above the road crossing to braided channels flowing through a wide,
historically flooded area at the downstream end of the survey reach. The substrate in the stream below the bridge is
dominated by sand along with a significant amount of silt. Review of aerial photography indicates that entire area for
over a mile upstream of the Rocky Branch and Little River confluence has been flooded and impounded for several
years. These swamp-like conditions may have contributed to the low DO and pH levels. The USFWS issued informal
concurrence on April 26, 2017 indicating that the project may affect, but is not likely to adversely affect the dwarf
wedgemussel and yellow lance.
RK&K staff provided a more formal report dated October 23, 2017 of the mussel survey conducted on February 27, 2017
providing the same results of only collecting the Eastern Elliptio. The USFWS issued revised informal concurrence on
December 4, 2018 indicating that the project may affect, but is not likely to adversely affect the dwarf wedgemussel,
yellow lance and Atlantic pigtoe.
RK&K staff conducted survey efforts for Neuse River waterdog on March 4, 2019 and Carolina madtom on April 3,
2019. See attached report dated December 3, 2021. No Neuse River waterdogs or Carolina madtoms were captured
during the noted surveys. Additionally, the project is not located within any Critical Habitat for the two species.
The project is located on Rocky Branch, which converges with Little River approximately 0.45 mi downstream of Bridge
910086. The following table is pulled from the most recent aquatics report and indicates the close distance to known
populations of Dwarf wedgemussel and Neuse River waterdog.

Summary:
The Division formally requests that you confirm the previously determined conclusions of May Affect, Not Likely Affect
for Dwarf wedgemussel, Yellow lance and Atlantic pigote. Additionally, the Department requests concurrence of
findings of May Affect, Not Likely to Adversely Affect for the Tar River spinymussel, Neuse River waterdog and Carolina
madtom. The project will be constructed in either 2022 or 2023.
The USFWS provided clarification on issues associated with the project via email on December 14, 2021 and indicated
that they are willing to provide revised concurrence of May Affect, Not Likely to Adversely Affect for the referenced
aquatic species.

Please accept this letter as a summary of the efforts made and resulting findings on the part of
NCDOT Division 5 to update the status of Bald eagle and Red-cockaded woodpecker for the
above referenced project.
Bald eagle: IPaC does NOT identify potential for this species at the project location. Habitat
for Bald eagle primarily consists of mature forest in proximity to large bodies of open water
for foraging. Large dominant trees are utilized for nesting sites, typically within 1.0 miles of
open water. Based on an examination of aerial photography, there are a few ponds at least 2
acres in size or greater identified within 1.0 mile of the project location. Although these
ponds provide some open water, due to location and proximity from large water bodies
around which eagles typically nest, these ponds would not be considered optimal feeding
sources. Additionally, a review of NCNHP records, February 2, 2022, revealed no known
occurrences of this species within 1.0 mile of the project location. No bald eagles or nest
trees were observed in the project study area or within 660 feet of the study area during a
visual survey conducted on January 24, 2022. Due to the lack of suitable habitat and no
known occurrences, a biological opinion of No Effect is rendered for this species.
Red-cockaded woodpecker: Habitat for the red-cockaded woodpecker (RCW) does not
exist within the project study area. The study area is comprised mainly of hardwoods and
young pines. The older pines are interspersed throughout hardwoods. The pines within the
areas of managed pine are younger than 30 years old. There are Virginia pines surrounding
the rock outcrops that are older than 30 years but the diameter of the trees is too small for
nesting habitat for the RCW. A review of the NCNHP database indicates no known
occurrences of the species within 1.0 miles of the study area. Due to the lack of suitable
habitat and known occurrences, a biological opinion of No Effect is rendered for this species.

SPECIAL CONDITIONS
1. This USACE permit does not authorize you to take a threatened or endangered species, in
particular, the Northern Long-eared Bat (NLEB) (Myotis septentrionalis). In order to legally
take a listed species, you must have separate authorization under the Endangered Species Act
(ESA) (e.g., a Biological Opinion (BO) under the ESA, Section 7, with “incidental take”
provisions with which you must comply). The U.S. Fish and Wildlife Service’s (USFWS’s)
Programmatic BO titled "Northern Long-eared Bat (NLEB) Programmatic Biological Opinion
for North Carolina Department of Transportation (NCDOT) Activities in Eastern North
Carolina (Divisions 1-8),” dated March 25, 2015, and adopted on May 4, 2015, contains
mandatory terms and conditions to implement the reasonable and prudent measures that are

Project Description: The North Carolina Department of Transportation (NCDOT)
proposes bridge replacement of Bridge No. 186 on SR 2329 (Lizard Lick Road) over
Rocky Branch in Wake County. The purpose of the proposed project is to replace a
structurally deficient bridge.
Bride No. 186 was constructed in 1955. The bridge is 35 feet long with a deck width of
22 feet. The structure type is timber floor on timber joists. NCDOT Bridge Management
Unit records indicate Bridge No. 186 has a sufficiency rating of 17.14.
Bridge No. 186 would be replaced in-place with an off-site detour. The proposed
structure would be a reinforced concrete box culvert. The bridge typical section is two
11-foot lanes (undivided) with four-foot shoulders. The proposed design speed is 50
mph. The project length is approximately 700 feet.
Anticipated Permit or Consultation Requirements: USACE Nationwide Permit No.
14 and NCDEQ DWR Water Quality Certificate 4135; buffer authorization has been
received by NCDOT
Special Project Information:
Design Speed - SR 2329 is currently Statutory 55 mph. However, Bridge Approach
Speed Investigation indicated the reasonable and comfortable passenger car speed of 45
mph, and a design speed of 50 mph.
Detour – Traffic will be managed with an off-site detour. The off-site detour would begin
from SR 2320 (Riley Hill Road), to SR 2331 (Jack Mitchell Road), to NC 96 (Zebulon
Road), to SR 2308 (Fowler Road), and end on SR 2329; approximately five miles.
Threatened & Endangered Species – A biological conclusion of “May Affect, Likely to
Adversely Affect” is provided for Northern long-eared bat. The Programmatic Biological
Opinion (PBO) will provide incidental take coverage for the Northern long-eared bat and

will ensure compliance with Section 7 of the Endangered Species Act for five years for
all NCDOT projects with a federal nexus in Divisions 1-8, which includes Wake County,
where Bridge No. 186 is located.
A mussel survey was conducted in February 2017. Biological conclusions of “May
Affect, Not Likely to Adversely Affect” were proposed for dwarf wedgemussel, yellow
lance, and Atlantic pigtoe. The US Fish & Wildlife Service (USFWS) provided informal
consultation for these species by letters dates April 26, 2017 and December 4, 2018 that
agreed with these findings. Biological conclusions of “No Effect” are provided for the
Cape Fear shiner and Tar River spinymussel.

NCDOT will contact the Wendell Fire Department Fire Chief at 919-365-3635 at least
one month prior to lane reduction and/or roadway closure to allow first responders to
prepare for the anticipated action.
NCDOT will contact the Zebulon Fire Department Fire Chief at 919-269-6487 at least
one month prior to lane reduction and/or roadway closure to allow first responders to
prepare for the anticipated action.
NCDOT will contact the Wake County Public School System Director of Transportation
at 919-533-7837 at least one month prior to lane reduction and/or roadway closure to
allow schools to prepare for the anticipated action.
FEMA
If a CLOMR and subsequent final LOMR are required for the project, NCDOT will
submit sealed as-built construction plans to the Hydraulics Unit upon project completion
certifying the project was built as shown on construction plans.
