Sullins Director Division of Water Quality The Wilmington Regional Office received previously requested information regarding the State Stormwater Management Permit Renewal Application for C & S Paint Center Addition on September 3, 2008. A preliminary review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: 1. The renewal fee was paid in 2007. Your consultants submitted another check with the last round of information. Please note that the Division has returned that check to the consultant with a copy of this letter. 2. Please revise the size of the outlet orifice. The project was originally approved with a 1" orifice. The as -built survey indicates that a 2" orifice has been provided, but this will drawdown the pond in less than 2 days. Please note that this request for additional information is in response to a preliminary review. The requested information should be received in this Office prior to October 18, 2008, or the application will be returned as incomplete. The return of a project will necessitate resubmittal of all required items, including the application fee. If you need additional time to submit the information, please mail, email or fax your request for a time extension to the Division at the address and fax number at the bottom of this letter. The request must indicate the date by which you expect to submit the required information. The Division is allowed 90 days from the receipt of a completed application to issue the permit. Please reference the State assigned project number on all correspondence. Any original documents that need to be revised have been sent to the engineer or agent. C&S Paint Center Addition As -Built STORMWATER NARRATIVE C&S Paint Center Addition is an existing development on Fountain Drive in the City of Wilmington, located in New Hanover County, North Carolina. The site is 3.14 acres in size with 2.77 acres draining to an existing wet detention basin. Ronald Choate of Choate Investment, LLC, petitioned Coastal Site Design, PC. to aid in the renewal of a State stormwater permit. Our initial inquiries with your office yielded approved and as -built drawings from The Bob Jacobs Co. drawn in 97'. An issue of noncompliance came up upon this permits renewal in 2007, due to elevations that were not consistent between approved plans and as-builts. We were asked to confirm elevations and submit revised calculations to prove that proper storage volume and surface area exist for the wet detention basin. The impervious square footages were supplied from the previously approved plans and calculations. The As -Built plan and calculations that follow are a result of elevations taken from a new survey performed by Paul Talbot PLS. If you can demonstrate via calculation, that the permitted amounts of surface area and volume have been provided at the as -built elevations, then the renewed permit should reflect those new elevations. This would only be true if the elevations for the entire system from bottom to top were reduced by 0.2 feet. If the permitted amount of surface area and volume has changed as a result of the decreased elevations, then those changes should either be documented (revised calculations) and incorporated into the renewed permit or changes to the elevations and areas to obtain the permitted minimums should be designed, permitted, constructed and certified. If the new as -built survey reveals substantial differences or if changes to the pond are needed, then yes, a new designer's certification will be required to document that those changes have been made. Within the operating agreement for the LLC, which is not recorded with the SOS, the officers in the corporation should have been named along with their official title. Please have Mr. Choate look through that document and send me a copy if it contains the information pertaining to his official title. We have noticed your recommended 'simplest fix' is to raise each approved elevation by 0.2 feet. We assume you would require a plan revision or permit modification to correct the errors if we choose this option. Is this correct? Is changing the approved elevations even necessary if the provided storage volume and surface area is sufficient? We have contacted the original engineer for his as -built survey data, and he informed us that his archives were lost in a fire. As a result, this will require a new survey of the pond to determine if the provided storage volume and surface area meet the original minimum design criteria. Additionally, there is a chance that the original as -built survey data was incorrect. In either case, will you require a new or updated certification? Regarding item #5 in your email, we looked at the Secretary of State website and found the same differences in Mr. Choate's title within the LLC over the years. Anyway, it must have been a late afternoon when I reviewed this because the inconsistencies I thought were there are really not. However, new inconsistencies have surfaced. I will send you a copy of the most recent calculations, and parts of the details from both the approved plan (April 1997) and the as -built plan (July 1997). Within the as -built plan there are also discrepancies between the numbers shown on the associated pond section and riser details: 1. The discrepancies between what we approved in April 97 (approved) and what is shown on the as -built are: a. Permanent Pool Elevation Approved = 35.75 As -built = 35.9 (riser detail) or 35.95 (section detail) b. Temporary Pool Elevation Approved = 38.5 As -built = 38.65 (riser detail) or 38.70 (section detail) The simplest fix would be to raise each approved elevation by 0.2 feet, which would be 35.95 and 38.70, respectively for the permanent pool and temporary pool elevations. 2. The Permanent pool, bottom, and sediment removal elevations reported on the Operation and Maintenance Plan (O&M) you submitted on June 11, 2007, for the pond and forebay differ from the permitted condition. The O&M lists the permanent pool as 38, when it should be 35.9 or 35.95; the O&M lists the pond bottom as 30 when it should be 28.5; and the O&M lists the sediment removal elevation as 32 when it should be 29.5. The new guidelines for sediment removal are for an accumulation of no more than 1' before sediment should be removed. 3. The O&M lists the forebay bottom elevation as 36, when it was permitted at 34.5. 4. For purposes of determining when the sediment must be removed, the O&M currently (and incorrectly) provides elevations in the blanks for sediment removal, where they should be filled in with actual DEPTHS. The allowable permanent pool depth in this case is 6.5' (the permitted design design depth of 7.5 minus the 1' maximum sediment accumulation). A similar situation exists at the forebay. 5. Has the issue of your official title within the LLC been resolved? Most LLC's are either managed by the membership, or have a designated manager. According to the 1996 Articles of Organization, this LLC is manager managed, so you would be considered the manager unless you revised the company structure and are now member -managed, in which case, your title would be a member -manager. The aquatic herbicide application will be applied as the new growth of cattails emerges within the next seven to 10 days. At this site visit a depth plot of the forebay and rnrin pool areas were conducted. The pond level was approximately nomW (+/- three inches) at this time. Depth plots of the forebay found an average depth of one foot. Main pool depth was calculau d at an average depth of six feet. A depth plot is enclosed_ Without the site, grading, and drainage plans depth cannot be verified to the originnal pond speciecations. In accordance with the N. C. Code on Stormwatear pond depth should be maintained at 75 percent of its original depth capacity. This depth includes both the forebay and maim pool of the pond. In ordeal for the pond to be in compliance with state regulations the original depth would be compared to the present depth and a percentage would be determined. Also at this site visit the pond intake and outfall structures and bank vegetation Were observed. Sedimentation was observed at intake areas. The outfall structure appeared to function properly. Maintenance activities shall be performed as follows: After every significant runoff producing rainfall event and at least monthly: a. Inspect the wet detention basin system for sediment accumulation, erosion, trash accumulation, vegetated cover, and general condition. b. Check and clear the orifice [or other inlet/outlet pipe where applicable] of any obstructions such that drawdown of the pond occurs as designed. 2. Repair eroded areas immediately, re -seed as necessary to maintain good vegetative cover, mow vegetative cover to maintain a maximum height of six inches, and remove trash as needed. 3. Inspect and repair the collection system (i.e. catch basins, piping, swales, riprap, etc.) quarterly to maintain proper functioning. Clear discharge piping of sediment or other build-up to ensure the pond empties as designed. 4. Remove accumulated sediment from the wet detention basin system semi-annually or when depth is reduced to 75% of the original design depth (see diagram below). Removed sediment shall be disposed of in an appropriate manner and shall be handled in a manner that will not adversely impact water quality (i.e. stockpiling near a wet detention basin or stream, etc.). Do not allow the sediment build-up to exceed the level of discharge pipe to the infiltration basin. The measuring device used to determine the sediment elevation shall be such that it will give an accurate depth reading and not readily penetrate into accumulated sediments. Remove cattails and other indiaenous wetland plants when they cover 50% of the basin surface. These plants shall be encouraged to grow along the vegetated shelf and forebay berm where applicable. If the basin must be drained for an emergency or to perform maintenance, the flushing of sediment through the emergency drain shall be minimized to the maximum extent practical. 7. All components of the wet detention basin system shall be maintained in good working order. 8. Level spreaders or other structures that provide diffuse flow shall be maintained every six months. All accumulated sediment and debris shall be removed from the structure, and a level elevation shall be maintained across the entire flow spreading structure. Any down gradient erosion must be repaired and/or replanted as necessary.
