W-218, SUB 239 BEFORE THE NORTH CAROLINA UTILITIES COMMISSION In the Matter of Application by Aqua North Carolina, Inc., Post Office ) Drawer 4889, Cary, North Carolina 27519, for a ) ORDER GRANTING Certificate of Public Convenience and Necessity to } FRANCHISE AND Provide Water and Sewer Utility Service in Olde Beau } APPROVING RATES Subdivision in Alleghany County, North Carolina, and } for Approval of Rates } BY THE COMMISSION: On June 21, 2006, Aqua North Carolina, Inc. (Applicant or Aqua), filed an application with the Commission for a certificate of public convenience and necessity to provide water and sewer utility service in Old Beau Subdivision in Alleghany County, North Carolina, and for approval of rates. On July 24, 2006, information clarifying the requested rates was filed in the docket. On December 11, 2006, Aqua filed maps of the water system service area. On December 20, 2006, Aqua filed maps of the sewer system service area. On September 7, 2006, the Commission issued an Order Requiring Customer Notice. On October 23, 2006, the Certificate of Service was filed by Aqua indicating that customer notice was given as required. The customer protest period has expired, and no protests from customers in the subdivision have been received. The Applicant's proposed rates are consistent with the rates currently approved in its other franchised service areas. On the basis of the verified application and the records of the Commission, the Commission makes the following FINDINGS OF FACT 1. Aqua presently serves approximately 11,000 water customers and 800 sewer customers in North Carolina. Its record of service is satisfactory. 2. The service areas covered are the areas shown on the plans filed in this docket on December 11, 2006, and December 20, 2006, as Exhibit 10. There are presently approximately 11.7 water customers and 63 sewer customers being served in Olde Beau Subdivision at no charge pending the issuance of the certificate. 3. The Public Staff has recommended that Aqua be required to post a $20,000 bond for Olde Beau Subdivision. Aqua currently has $1,750,000 of bonds posted with the Commission. Of this amount, $1,690,000 of bond surety is assigned to specific subdivisions and $60,000 of bond surety is unassigned. 4. Aqua has the technical, managerial, and financial capacity to provide water and sewer utility service in this new franchise area. 5. Aqua has filed the exhibits required with the application. 6. The North Carolina Department of Environment and Natural Resources has approved plans and specifications for the water and sewer systems serving Old Beau Subdivision, and has issued permits for construction and operation of the systems. 7. Aqua is acquiring the water and sewer utility systems under an agreement between Aqua and the owner, Olde Beau Water and Sewer System, Inc. (OBWSS), dated May 17, 2006. Aqua will pay OBWSS $400 per residential equivalent unit for connections to the water system up to 185 residential units. Aqua has also agreed to pay OBWSS $400 per residential equivalent unit for connections to the sewer system. Aqua will not collect any connection charges relating to the water or sewer systems. 8. Since the net book value of the assets being acquired is greater than the purchase price, the Public Staff recommended that Aqua be allowed to include the purchase price in rate base. 9. The Public Staff recommended that the advances for construction related to the contract be deducted from rate base in future proceedings so that Aqua will not earn a return on plant for which it has not yet paid. CONCLUSIONS Based upon the foregoing, the Commission is of the opinion that $20,000 of the Applicant's unassigned bond surety should be assigned to Olde Beau Subdivision; that the water and sewer utility franchise requested by Aqua for Olde Beau Subdivision should be granted; and that the requested rates should be approved. IT IS, THEREFORE, ORDERED as follows: 1. That $20,000 of the $60,000 unassigned bond surety be assigned to Olde Beau Subdivision. The remaining unassigned bond surety shall be $40,000. 2. That Aqua is granted a certificate of public convenience and necessity to provide water and sewer utility service in Olde Beau Subdivision in Alleghany County, North Carolina. The service areas covered in the franchise are the areas shown on the plans filed in this docket as Exhibit 10. 2 3. That Appendix A constitutes the Certificate of Public Convenience and Necessity. 4. That the attached Schedule of Rates, attached hereto as Appendix B, is approved for Aqua in Olde Beau Subdivision. 5. That Aqua be allowed to include its purchase price as rate base. 6. That the advances for construction be deducted from rate base in future proceedings. 7.
