Hello Mr. Blackwell,
Thank you for emailing the Division of Water Resources.
On January 30, 2023, the Division of Water Resources (Division) received your application requesting a 401 Water
Quality Certification from the Division for the subject project. The Division has determined that your application is
incomplete and cannot be processed. The application is on‐hold until all of the following information is received:
1. The permanent impacts above the normal pool level proposed on your application are reported as
1 sqft and impacts below the normal pool level are reported as 150 sqft. Staff believe this is a
mistake on your application and requires the proposed amount of disturbance above the normal
pool level associated with your project. Please provide the proposed permanent and temporary
impacts above the normal pool elevation associated with your project. [15A NCAC 02H
.0502(a)(9)]
2. The site plan received with your application is unclear and staff are unable to determine impacts to
the shoreline above and below the normal water level. Please provide a site plan showing the
location of the impacts to the shoreline and/or lake bottom, and the location of any vegetated
areas that will be impacted (construction access corridors, etc.). In most cases the site plans do
not have to be professionally prepared. The template attached to this email may be used to assist
with this requirement. You may also draw proposed impacts directly on the attached imagery to

3. The application received indicates work will be conducted from the land. Please provide a
description of how work will be conducted, what type of equipment will be used, and a
description of any impacts to the protected Trout Buffer (if any), and a description of measures
proposed to ensure compliance with NC Water Quality Standards. [15A NCAC 02H .0502(a)(9)]
4. Plans received with your application do not indicate the location or type of planned erosion control
measures (silt fencing, temporary or permanent ground cover). Please indicate the type and
location of any planned sedimentation and erosion control measures proposed for the control of
any sediment and erosion onsite to ensure compliance with General Condition II.4 of GC 4502.

Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the
proper consideration of the application. Please respond in writing within 30 calendar days. If all of the requested
information is not received within 30 calendar days of receipt of this letter, the Division will be unable to approve the
application and it will be denied as incomplete. The denial of this project will necessitate reapplication to the Division
for approval, including a complete application package and the appropriate fee. Please email all requested documents to

however the regional office records indicate the application review fee was not paid.

Applications are reviewed on a first come first serve basis once the review fee is paid. Please let me
know if you have paid the review fee for this application and our records are in error.

Hi. I had a friend convert the jpegs into pdf and I just submitted the application. I tried using the link

Is this the link providing the error message you reference when you state “In addition the link under #2
under Project Information gives me an Error message when I try to connect”?
If so, the attached file is the same as the link circled in red above. The diagrams are at the bottom of the
attached document.
Converting jpegs to PDFs varies by computer and user. Some applicants use Microsoft word (or another
word processor) to save as a pdf.
This is done by importing the photo into a word document and then saving the document as a pdf.

There are many ways to convert files and this in only one example.

Good morning. I've received the link you sent below several times and I’ve been trying to complete
it. When I order to submit it says I have to upload a pdf file. I don’t have a way to convert my
pictures to pdf. I’ve been stuck on this for days. In addition the link under #2 under Project
Information gives me an Error message when I try to connect.
I'm not able to submit without attaching pdf files...which I'm not able to get. I'm stuck. How do I

Work that impacts the waters of the US may require a 404 Certification from the United
States Army Corps of Engineers (USACE) and a 401 Water Quality Certification from
NCDWR.

If you project is eligible for coverage under Regional General Permit #30 with the USACE
your project may be eligible for coverage under the corresponding NCDWR Water
Quality Certification #4502.
Written confirmation of coverage from NCDWR is required for coverage under WQC
4502.

If project activities exceed any of the thresholds of the General Certification (GC) linked
above, or cannot meet all the conditions of the GC, an individual Water Quality
Certification may be required.
If an individual Water Quality Certification is required for your projects, a PCN must be
submitted to the Division of Water Resources. Please use the online submission page,
linked below, to submit a PCN in the event an Individual Certification is required.
Please ensure to confirm coverage or secure the appropriate authorization before
commencing any work. This includes but is not limited to authorization from DWR,
USACE‐ Brandee Boggs (brandee.c.boggs@usace.army.mil ), the Town of Lake Lure‐
Mike Williams (mwilliams@townoflakelure.com), and Stan Aiken with NCDEMLR.

As Lake Lure is classified trout waters, a trout buffer authorization may be required for
impacts to the trout buffer. Please contact Stan Aiken regarding the approval process
for impacts to the trout buffer.

Hi Mitchell. I got your information from Michael Williams over at Lake Lure.
I need to put rip rap along my seawall at Lake Lure. I have completed the Lake Structure
Permit Application For Shoreline Stabilization. My understanding is the NC DEpt of
Environmental Quality also needs to approve the rip rap project. I'm needing to
complete this project ASAP seeing as how the lake will only be lowered for a limited
time...starting 1/1/23. Please let me know what you need from me in order to obtain an
approval.
