Hi Eric,
DWR typically does not review and provided written concurrence for projects that are submitted as courtesy copy only.
However, as long as none of the thresholds of GC4244 are exceeded and buffer impacts meet all criteria to be covered
under deemed (15 NCAC 0213.0714 (11)(nn)(ii)), then no written authorization is needed from DWR. From a brief look at
the submitted PCN, it appears that you do not need written authorization.
If you find that your project changes or that any thresholds are exceeded/triggered, please reach out to our office for a
401 certification and/or buffer authorization. Please make sure to obtain any other required approvals from local or
federal agencies before work begins.

Hi Zach,
I am forwarding you the response we received from the USACE. They concurred that the proposed project DENC-M-73
Cardinal to NC State University Pipeline Project does not require notification to the Corps. We wanted to reach to ask if
you had the chance to review and make a 401 WQC Determination. We are trying close the loop on environmental
permitting requirements associated with this project. We look forward to your response.

Dear Mr. Andrew Moore and Mr. Eric Mularski,
Based on the submitted PCN dated 12/20/2022, the above referenced project appears to be authorized under
Nationwide Permit (NWP) 12 and does not require notification to the Corps. Attached is a copy of the NWP 12 including
the applicable permit conditions. Please note that the project must be accomplished in strict accordance with these
conditions and your submitted description, and any violation of the conditions or deviation from your submitted
description may subject the permittee to a stop work order, a restoration order and/or appropriate legal action. The
Action Identification Number for this project is SAW-2022-01049.
It is your responsibility to contact the North Carolina Division of Water Resources (NCDWR) Raleigh Regional Office to
determine the 401 requirements for this project. Please note that, if an Individual 401 WQC is required from NCDWR,
the conditions of the Individual 401 WQC, once issued, are also conditions of the NWP referenced above. You may not
conduct the activity authorized by the above referenced NWP without a valid 401 Water Quality Certification.
