Rex Gleason f' Prepared By: Michael Parker 9 Subject: Town Greek WWTP Wasteload Allocation NPDES Permit No. NCOO23892 Rowan County A review of the WLA for the subject facility has been conducted. our comments/concerns are noted below, and should be resolved prior to Permit reissuance. Although this facility does ey-4ntually plan to discharge directly to the Yadkin River, th �outfall extension is not planned for at least 5-7 years. If water impacts, such as nutrient problems or stream standards violations are predicted, the appropriate limitation(s) should be established. The proposed effluent limitation for mercury is based on the treatment plant permitted flow and 7Q10 stream flow, however, no documented WQ violations for mercury have been found. Imposing such a limit without having sufficient evidence that the stream standard may be compromised may be inappropriate, especially since the limitation is lower than most laboratories can detect. It should also be noted that Salisbury has questioned the mercury limitation at their other WWTP (Grant Creek WWTP) as a result of a recent civil penalty assessment for mercury violations. This matter has yet to be resolved. Significant gains have been made in Salisbury's pretreatment program as evidenced by this facility's history of compliance. The establishment of an instream monitoring program to determine whether the standard is being compromised is suggested at this time, in lieu of an effluent limitation. If WQ violations are found, then including an effluent limitation in the Permit would be appropriate. We suspect that if the limit is imposed, Salisbury will seek adjudication of the Permit. Staff report inidcates that the facility is well maintained and operated, but the facility is very antiquated. Salisbury is planning to combine both the Town Creek and Grant's Creek plant and discharge to the Yadkin River. The plan is to relocate the pipes to the Yadkin, then start building a new plant and abandon the old sites. The facility has had 1 BOD5 and 1 TSS violation in the past year. Salibury has had only 2 toxicity failure in the past 2 years. Since the facility will not be discharging to this arm of High Rock Lake in the future, no nutrient limits will be imposed. Monitoring for TP and TN on a monthly basis should continue. Facility will not receive NH3-N/tox choice due to stringent existing NH3-N limit and passing toxicity tests. The effluent concentration at which there may be no observable inhibition of reproduction or significant mortality is % (defined as treatment two in the North Carolina procedure document). Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should any single quarterly monitoring indicate a failure to meet specified limits, then monthly monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will revert to quarterly in the months specified above. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Environmental Management indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival and appropriate environmental controls, shall constitute an invalid test and will require immediate retesting(within 30 days of initial monitoring event). THROUGH: Ruth Swanek �c Carla Sanderson SUBJECT: Salisbury - Town Creek WWTP' NC0023892 Rowan County Technical Support has received the Mooresville Regional Office's recent memo regarding the elimination of the mercury limit from the Salisbury -Town Creek WWTP permit renewal recommendation. The MRO suggests that the limit be dropped due to the lack of documented water quality violations for mercury instream. Permit limits for toxic substances are based on their likelihood of occurring in the effluent and the possibility of their causing a water quality violation. The allowable effluent level is based on a mass balance calculation (WWTP design flow and 7Q10s low flow) which should only occur during worst case conditions. Water quality violations may not have been found instream since those worst case conditions have not occurred; this should not preclude the recommendation of a limit. If this were the case, no limits could be set until waters were already impaired. The Salisbury -Town Creek mercury limit was developed based on EPA's Local Limits Guideline Manual (1987) default value for domestic flow. This predicted value was within 10% of the allowable effluent level for mercury, so a limit was imposed. Because this value was based on a default domestic contribution and not on actual influent values, permitted values, or observed values, as were the other metals, Technical Support concurs with the MRO's recommendation to drop the mercury limit for the Town Creek WWTP. Effluent monitoring for mercury will still be required with a frequency based on the classification of the facility (2/month). All other metals limits or monitoring requirements will remain the same.
