The complete construction cost for the project was $138,490.26, which requires an additional fee of $2,381.82 as shown in the Dam Application Fee Calculator, Owners' Certification forms, and supporting documentation in Attachment B. Check Number 053759 for the additional fee is enclosed with this submittal. In addition to the record drawing, below is an update on items discussed during the permit process or discovered after the permit: a. McGill completed an investigation of the sediment in the pond to evaluate the risk of contamination. The evaluation and testing results showed little sediment in the pond and that the contamination levels were not indicative of impact, and therefore that no notification to NCDEQ was required (Attachment C). b. The standpipe, pond bottom, and channel invert downstream of the dam were about two to three feet lower than what was anticipated during design using LiDAR. The breach was therefore excavated lower to match existing upstream and downstream inverts. The bottom width was maintained at 25 feet as designed. The wall width varied between 12 and 30 inches. The top of the wall was about 8 feet below the top of the dam. The wall was removed within the extent of the breach. d. Vegetation has taken hold through most on the pond by completion of construction. Initially, the removal was permitted as a two -stage construction: (1) temporary breach to alleviate the emergency associated with piping, and (2) permanent breach after completion of the sediment investigation. Due to the above additional information, sediment contamination and migration is no longer a concern and the riprap at the bottom of the breach no longer functions as a check dam as the breach provides more conveyance capacity due to the lowering of the breach bottom. Therefore, we are requesting the breach as constructed to be considered a permanent breach. The following photos and captions are provided for support of the above findings and recommendation as well as to show that no impoundment was noted following several hours of rain from Hurricane Ian. ATTCHMENT C- JOHNS-035 SEDIMENT TESTING RESULTS ENVIRONMENT & HEALTH Mr. Dori Sabeh, PE, GISP Project Manager McGill Associates, P.A. 5400 Trinity Road, Suite 107 Raleigh, NC 27607 Summary of Sediment Sampling, Former Finch Pond, Clayton, North Carolina McGill Associates, P.A. (McGill) is providing engineering services to Caterpillar Incorporated (Caterpillar) and Grifols Therapeutics (Grifols) for removal of an earthen dam that impounds Finch Pond and straddles their two properties in Clayton. In support of this removal, McGill requested that Ramboll sample the sediment in Finch Pond, in order to evaluate if these sediments had been impacted by the adjoining Peele Pesticide Disposal Site (Peele Site). This letter documents the results of this sampling. Background The Peele Site was located on a property that is currently owned by the Clayton Fire Department (Figure 1) and is listed on the North Carolina Inactive Hazardous Waste Inventory (NCD986171338). The Peele Site had a burn pit and disposal trench that was remediated in 1998. McGill, and their clients Caterpillar and Grifols, were concerned that the Finch Pond, which is located downgradient of the former disposal trench, could have been impacted by historical operations at the Peele Site. Soil at the Peele Site contained concentrations of pesticides and metals at concentrations above the North Carolina Preliminary Soil Remediation Goals (PSRGs), specifically: • Arsenic • Copper • 4,4-Dichlorodiphenyltrichloroethane (DDT) • 4,4-Dichlorodiphenyldichloroethylene (DDE • 4,4-Dichlorodiphenyldichloroethane (DDD) • Dieldrin • Endosulfan • Endosulfan Sulfate • Endrin • Endrin Aldehyde • Heptachlor • Heptachlor Epoxide • Methoxychlor • Total Chlordane • Toxaphene August 4, 2022 Ramboll 3214 Charles B. Root Wynd Suite 130 Raleigh, NC 27612 USA T 919-987-3090 F 919-781-4360 https://ramboll.com 1/3 In accordance with the proposal to McGill dated February 11, 2022, Ramboll sampled the Finch Pond sediment, as well as two background locations, and characterized the potential impact from the constituents identified above. The sections that follow summarize the work performed, the results of the investigation, and Ramboll's conclusions. Work Performed On May 19, 2022, Ramboll mobilized to the Finch Pond, with the intent of collecting sediment samples from a canoe. Ramboll's objective was to collect discrete samples from across the complete depth of sediment, in order to characterize conditions over the broad sequence of deposition. Ramboll was able to access the proposed sample locations but was unable to obtain representative sediment samples from the pond because of the depth of the water, and the thickness and consistency of the pond sediment. Ramboll was able to collect representative sediment samples from the two background locations (Figure 1) during this mobilization. During this initial site visit, McGill identified leakage of water from the base of the dam in excess of 20 gallons per minute, which represented a high level of risk for the integrity of the dam creating the Finch Pond. Based on this discovery, Caterpillar and Grifols drained the pond to relieve pressure on the dam. Ramboll returned to the Finch Pond to complete the sampling on June 10, 2022, following several weeks of drying, and was able to access four locations for sediment sampling (Figure 2). Using a hand auger, Ramboll was able to penetrate through the sediment and into the underlying native soil at two locations (P-3 and P-4) and was refused on the basal gravel from the former stream underlying the pond at the other two locations (P-1 and P-2). Ramboll collected sediment samples from two depths at locations P-1 and P-2, and one depth at locations P-3 and P-4 (Attachment 1). Sediment samples were sent to Eurofins TestAmerica Laboratory in Pittsburgh for analysis of the constituents listed above. Ramboll also collected a duplicate sample from location P-3, and a matrix spike/matrix spike duplicate pair from location P-2. Investigation Results The laboratory analytical results for the samples collected indicated the presences of arsenic and copper in all of the samples collected, as well as a number of the targeted pesticides (Table 1, Attachment 2). As required by the North Carolina Department of Environmental Quality (NCDEQ), Inactive Hazardous Sites Branch (IHSB) the analytical results for these samples were compared to the PSRGs for soil (NCDEQ, January 2022), as well as the screening values for freshwater sediment in the USEPA Region 4 Ecological Risk Assessment Supplemental Guidance (March, 2018). Except for the following, concentrations were below the PSRGs and the ecological screening value (ESV): • Arsenic was detected at a concentration above the PSRG for residential, but not industrial site use, in all but one sample collected. The pesticides 4,4-DDD and 4,4-DDE were detected at concentrations above the ESV in the sample from 1-2 feet below surface (fbs) at location P-1. The concentration of total DDT/DDE/DDD also exceeded the ESV in this sample. The pesticide 4,4-DDE was also detected at a concentration above the ESV at background location BG-2. 2/3 Conclusions The following conclusions were made with regard to the analytical results: Arsenic was detected at a relatively -consistent concentration in all of the samples analyzed. This metal is naturally -occurring in soil, and is often found at concentrations in excess of the PSRG. Based on its natural occurrence in soil, and the relatively consistent concentration from background locations as well as the Finch Pond sediment, the results appear to represent naturally -elevated concentrations, and not impact from the Peele Site. The pesticides 4,4-DDT/DDE/DDD were found at relatively similar concentrations in both Sample 1-2 fbs from pond sample P-1, as well as background location BG-2. The pesticide 4,4-DDT was in widespread use in North Carolina historically and was often applied through aerial spraying. Based on the detection of 4,4-DDT, and its degradation compounds 4,4-DDE and 4,4-DDD at relatively consistent concentrations in a background as well as one of the pond samples, the results appear to represent widespread aerial spraying of this pesticide, and not impact from the Peele Site. Consistent with the requirements of the IHSB for samples that exceed screening values, Ramboll submitted these results to the NCDEQ project manager for the Peele Site, Bruce Lefler. Mr. Lefler reviewed these results with his supervisor and concurred with Ramboll's evaluation that they were not indicative of impact, and that no notification to NCDEQ was required (email dated July 14, 2022, Attachment 3). With this consideration, no further action is required, and the sediment from the pond does not require special handling or disposal. We appreciate the opportunity to support you on this project. In addition all laboratory quality control samples were within established control limits, with any exceptions noted below. Each sample was analyzed to achieve the lowest possible reporting limit within the constraints of the method. In some cases, due to interference or analytes present at high concentrations, samples were diluted. For diluted samples, the reporting limits are adjusted relative to the dilution required. Calculations are performed before rounding to avoid round -off errors in calculated results. All holding times were met and proper preservation noted for the methods performed on these samples, unless otherwise detailed in the individual sections below. RECEIPT The samples were received on 5/21/2022 10:00 AM. Unless otherwise noted below, the samples arrived in good condition, and where required, properly preserved and on ice. The temperature of the cooler at receipt was 3.80 C. PESTICIDES The following samples were diluted due to the nature of the sample matrix: BG-1 (180-138477-1) and BG-2 (180-138477-2). Elevated reporting limits (RLs) are provided. Surrogate recovery for the following samples were outside control limits: BG-1 (180-138477-1), (180-138477-B-1-A MS) and (180-138477-B-1-B MSD). Evidence of matrix interferences is not obvious. The DCB Decachlorobiphenyl (Surrogate) surrogate recovery for the following samples was outside acceptance limits (high biased) on the primary column due to matrix interference: (LCS 180-399849/2-A). The recovery is within acceptance limits on the other column, indicating that the extraction process was in control. The matrix spike / matrix spike duplicate (MS/MSD) recoveries for preparation batch 180-399849 and analytical batch 180-400163 were outside control limits. Each sample was analyzed to achieve the lowest possible reporting limit within the constraints of the method. In some cases, due to interference or analytes present at high concentrations, samples were diluted. For diluted samples, the reporting limits are adjusted relative to the dilution required. Calculations are performed before rounding to avoid round -off errors in calculated results. All holding times were met and proper preservation noted for the methods performed on these samples, unless otherwise detailed in the individual sections below. RECEIPT The samples were received on 06/14/2022; the samples arrived in good condition, properly preserved and on ice. The temperature of the coolers at receipt was 4.7 C. PESTICIDES Surrogate recovery for the following samples were outside control limits: P-4-061022-0-1 (180-139618-1) and P-2-061022-2-3 (180-139618-3[MS]). Evidence of matrix interference is present; therefore, re -extraction and/or re -analysis was not performed. delta-BHC was detected in method blank MB 180-402836/1-B at a level exceeding the reporting limit. If the associated sample reported a result above the MDL and/or RL, the result has been flagged. I appreciate you calling me back, and your time on the phone this morning. As requested, here are the analytical results for the sampling of the Finch Pond (sample location figures, data summary table, and laboratory reports). Our sampling included two background samples (BG-1 and BG-2), as well as 4 locations within the pond. These samples were analyzed for the list of parameters identified at the Peele Site (arsenic, copper, and pesticides). Our results indicate the following: • Arsenic was present in all the samples (both background and in the pond,) all but one, with a concentration above the Residential PSRG. Given the relatively uniform concentration in both the background and pond samples, this appears to be a naturally -occurring concentration, and not indicative of impact. In my experience, elevated arsenic concentrations are not unusual at sites in this area. • 4,4-DDT, 4,4-DDD, and 4,4-DDE were detected in one of the pond samples at concentrations above the Region IV Ecological Screening value (ESV). All three of these constituents were detected in one of the background samples, with 4,4-DDE at a concentration above the ESV. These presence of low concentrations of this pesticide in both background and pond sediment suggest potential impact from widespread use of this pesticide in the past, and not from the Peele Site. Once again, in my experience it is not uncommon to find DDT/DDD/DDE at sites throughout North Carolina. As discussed, the pond is now drained, and will remain that way. Our client (McGill) plans to breach the dam, and regrade and stabilize the former pond as a stream, so most of the pond sediment is effectively soil at this point (barring that which is actually within the stream). Based on this, our single detection of DDT/DDD/DDE does not appear to represent a concern, and we wanted to get your input on this to better understand how we proceed from this point.
