To Whom It May Concern:
On behalf of Ashton Raleigh Residential, LLC, we are applying for a Nationwide Permit 29 from the US
Army Corps of Engineers (USACE) and an Individual Water Quality Certification and Buffer Authorization
from the NC Division of Water Resources (DWR) for proposed impacts to jurisdictional waters and
riparian buffers associated with The Point North project. The proposed project is a residential
subdivision that will be accessed from Genovesa Drive in Rolesville, Wake County, North Carolina.
The USACE issued a Jurisdictional Determination for The Point North, as well as an additional property,
known as The Point South, under SAW-2018-00871. Likewise, the DWR issued a Letter of Buffer
Determination for both parcels under RRO# 18-446. James Lastinger with the USACE determined that
The Point North is a separate project from The Point South. A DWR Project number has not been
assigned to this project.
A list of the attachments to the online Pre -Construction Notification Application and those attachments

This email is in follow-up to our site meeting on 01/15/2019 to verify the limits of any potentially jurisdictional
waters of the United States (WoUS) within the Rolesville Young Street — PUD project, located at 1004 East young
Street in Rolesville, NC. The revised "Approved Wetland Delineation Exhibit" attached accurately depicts the limits
of any potentially jurisdictional WoUS within the project area. Also, attached is the aquatic resources table.
Will you please respond to this email concurring with the results of the site meeting so that we have documentation
for upcoming submittals. We understand that due to your current workload, the JD will be issued during permitting.

Lyle,
Rapanos language such as RPW non-RPW etc., are not used nor needed in a PJD. We only begin to differentiate
between them if an AJD is requested. With that being said, those two features much more reflect a wetland as they
were flagged than a ditch, and I would prefer to keep them that way.

I wanted to run something by you before sending the concurrence email.
Would you consider calling Wetland H and Wetland G RPW ditches? Troy brought up that they might qualify. If so
Ill add that to the language of the exhibit sent with the concurrence email.
Once I receive your response I will send an updated exhibit with the concurrence email.
The other changes that you will see is that Stream 10 was pulled down to the location where you thought it became a
stream. And Stream 1 is going to be pulled to the property line so it will become a stream throughout. This will get
the stream call consistent with the buffer call for Streams 1 and 10.

Draft USACE Email for USFWS Consultation
This email serves as the USACE (1) notification for the NLEB, and (2) consultation request for other
species (Situation 2).
1) Detailed project description: This verification authorizes the use of Nationwide Permit 29 to impact
176 linear feet of perennial stream for the purpose of constructing a single-family, residential
subdivision. Specifically, this verification authorizes the permanent loss of 99 linear feet (0.026 acre) for
culvert installation (Impact S2 & S5). An additional 48 linear feet (0.010 acre) would be temporarily
disturbed during construction for culvert and utility installation (Impacts S1 & S4) and 29 linear feet
(0.005 acre) would be impacted by placement of riprap for stream stabilization (Impact S3). If work
cannot be completed in the dry, a stream pump -around or similar measure shall be employed to protect
downstream resources.
The use of a jackhammer is anticipated. Blasting is not anticipated, but a minimal amount may be
required if hard rock is encountered.
2) Project latitude and longitude (center of site) in decimal degrees: 35.909694-78.457645
3) Estimate of tree clearing in the USACE action area in either acreage or number of trees cleared:
Approx. 36 acres
Coordination and consultation concerning: Northern long-eared bat (NLEB) (Myotis septentrionalis), red -
cockaded woodpecker (Picoides borealis), Neuse River waterdog (Necturus lewisi), Carolina madtom
(Noturus furiosus), Atlantic pigtoe (Fusconaia masoni), Dwarf Wedgemussel (Alasmidonta heterodon),
Michaux's sumac (Rhus michauxii), and the candidate Monarch butterfly (Danaus plexippus). There are
no critical habitats in this location.
The applicant provided the following text: On February 15, 2022, a protected species assessment was
submitted to the Raleigh Office of the USFWS including an official species list generated by the USFWS
IPaC website and a NCNHP report for the project area. A self -certification letter, species conclusion
table, and email submittal are attached. No response to the assessment has been received.
For the NLEB - this project qualifies for Situation 2 —
- the action area is located outside of a red HUC and there will be pile driving or other percussive
activities (not including blasting), and the USACE has determined that pile driving and other percussive
activities will not affect NLEB resources in a red HUC; and
- the action area is located outside of a red HUC and there will be blasting, but the blasting will not
occur within 0.25 mile of a red HUC boundary.
USACE Rationale and Determination: The USACE conducted a GIS review of the project and surrounding
areas and also reviewed the most current maps of confirmed/known hibernation and maternity (tree)
sites for the NLEB at http://www.fws.gov/raleigh/NLEB RFO.html and via ArcView GIS and has
determined that the action area for this project is located outside of the highlighted areas/red 12-digit
HUCs and activities in the action area do not require prohibited incidental take; as such, this project
meets the criteria for the 4(d) rule and any associated take is exempted/excepted.
U.S. Fish and Wildlife Service (Service) Concurrence for the NLEB: This notice is being sent to the Service
in accordance with the surrogate consultation procedure/SLOPES that was established between the
Service's Asheville and Raleigh Ecological Offices and the USACE, Wilmington District, for the NLEB. This
project does not require prohibited intentional take of the NLEB and meets the criteria for the 4(d) rule;
therefore any associated take is exempt and it is not necessary for the USACE to wait 30 days for the
Service to object or concur.
USACE determination for other species and/or critical habitat under consultation, informed by
consultant reporting -- OTHER SPECIES. AFFECT DETERMINATION for the following reasons:
Red -cockaded woodpecker — No Effect — Mature pine stands are absent within the project area. Habitat
assessment indicated no potential habitat present.
Neuse River waterdog — May Affect Not Likely to Adversely Affect —Suitable habitat is not present due to
lack of connectivity to and distance from a known population. Streams to be crossed flow into Harris
Creek.
Carolina madtom — May Affect Not Likely to Adversely Affect Suitable habitat is not present due to lack
of connectivity to and distance from a known population. Streams to be crossed flow into Harris Creek.
Atlantic pigtoe — May Affect Not Likely to Adversely Affect — Suitable habitat is not present due to lack of
connectivity to and distance from a known population. Streams to be crossed flow into Harris Creek.
Dwarf Wedgemussel — May Affect Not Likely to Adversely Affect — Suitable habitat is not present due to
lack of connectivity to and distance from a known population. Streams to be crossed flow into Harris
Creek.
Michaux's sumac — May Affect Not Likely to Adversely Affect —NRC completed a field survey of suitable
habitat on October 26, 2021 and did not observe Michaux's sumac.
Monarch butterfly — Candidate — Monarch butterfly is not a resident of the project area but could be
expected to occur here during migration. Ample resources are available in the project vicinity to
accommodate any displaced individuals and no adverse impact on this species is anticipated.
Also, USACE is not aware of any other issues concerning listed species and/or critical habitat and has
determined that the project would have no effect on any other species and/or critical habitat. Please let
us know if you have information to the contrary and/or if you need additional information.
