Location description: The site is located near the intersection of Deer Park Road and Dairy Road, on the Biltmore
Estate, in Asheville, NC. Coordinates are: 35.548997 -82.571381.
Description of projects area and activity: This permit authorizes excavation, in -stream structures and bank sloping for
the Sleepy Hollow Stream Restoration Project. Impacts authorized by this permit total 235 linear feet of Dairy Branch
and 640 linear feet of Sheep Branch. The following special condition is included in the is authorization:
1. In order to avoid potential effects to archaeological resources in the project area, construction activities
will be monitored by a qualified archaeologist as outlined in the North Carolina State Historic
Preservation Office (SHPO) letter dated January 25, 2023. In the event that archeological resources are
discovered, work should immediately stop and our office notified so that proper coordination with SHPO
can be initiated.

Your work is authorized by the above referenced permit provided it is accomplished in strict accordance with the
attached conditions, above noted special conditions, and your submitted application and attached information dated
December 5, 2022. Any violation of the attached conditions or deviation from your submitted plans may subject the
permittee to a stop work order, a restoration order, a Class I administrative penalty, and/or appropriate legal action.
This verification will remain valid until the expiration date identified below unless the nationwide/regional authorization is
modified, suspended or revoked. If, prior to the expiration date identified below, the nationwide/regional permit authorization
is reissued and/or modified, this verification will remain valid until the expiration date identified below, provided it complies
with all requirements of the modified nationwide/regional permit. If the nationwide/regional permit authorization expires or is
suspended, revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the
nationwide/regional permit, activities which have commenced (i.e., are under construction) or are under contract to commence
in reliance upon the nationwide/regional permit, will remain authorized provided the activity is completed within twelve months
of the date of the nationwide/regional permit's expiration, modification or revocation, unless discretionary authority has been
exercised on a case -by -case basis to modify, suspend or revoke the authorization.
Activities subject to Section 404 (as indicated above) may also require an individual Section 401 Water Quality Certification.
You should contact the NC Division of Water Resources (telephone 919-807-6300) to determine Section 401 requirements.
For activities occurring within the twenty coastal counties subject to regulation under the Coastal Area Management Act
(CAMA), prior to beginning work you must contact the N.C. Division of Coastal Management at (252) 808-2808.

Dear Ms. Jones:
Thank you for your submission of December 21, 2022, concerning the above -referenced project. We have
reviewed the information provided and offer the following comments:
The proposed stream restoration on the Biltmore Estate National Historic Landmark involves stream
channeling, sloping, riparian planting, and in -stream construction. A portion of the area of potential effects
(APE) was previously surveyed and one archaeological site (31BN971) was identified and determined to be
not eligible for listing in the National Register of Historic Places (NRHP). Given the high potential for
significant historical resources to be present on this property and to ensure that no unidentified
archaeological resources are inadvertently impacted, we recommend that archaeological monitoring be
conducted during restoration in the portions of the APE where modifications to stream bank slopes take
place. The archaeological monitoring should be carried out by an experienced archaeologist who meets the
Secretary of the Interior professional qualifications.
We ask that two paper copies and one digital copy (PDF) of the resulting archaeological monitoring report,
as well as a digital copy (PDF) of the North Carolina Site Form for any sites recorded, should be forwarded
to the Office of State Archaeology (OSA) through this office for review and comment, as soon as they are
available. OSA's Archaeological Standards and Guidelines for Background Research, Field
Methodologies, Technical Reports, and Curation can be found online at: https://archaeology.ncdcr.gov/osa-
guidelines.
As proposed, the project will have no adverse effect on the Biltmore Estate (BN1835), a National Historic
Landmark.
The above comments are made pursuant to Section 106 of the National Historic Preservation Act and the
Advisory Council on Historic Preservation's Regulations for Compliance with Section 106 codified at 36
CFR Part 800.
