The Town of Fuquay-Varina Staff have approved the above -referenced erosion control plan. This approval
is only for erosion control and does not constitute approval of site improvements as defined in the Town of Fuquay-
Varina Land Development Ordinance. An approved erosion and sedimentation control plan is valid for one (1)
calendar year from the date of approval. If a land disturbance permit has not been obtained within the one (1) year
period, the erosion control and sedimentation plan approval becomes null and void.
By acceptance of these approved plans, the owner, owner's agents, heirs, successors and assigns, agree to be
bound to and comply with the Town of Fuquay-Varina's Code of Ordinances and the Town's Standard Specifications
and Construction Details as promulgated and amended by the Town.
The owner/developer or their representative must meet the following obligations as part of this approval:
• A pre -construction meeting is required prior to commencement of any construction. Approval of site
improvements is required prior to scheduling a pre -construction meeting. A fee sheet for required permit
fees will be provided with site improvement approval.
• Grading, other than for installation of soil erosion and sedimentation control measures, is prohibited prior
to completion of an approved compliance inspection.
• EC plan approval shall be prominently displayed until all construction is complete, all permanent
sedimentation and erosion control measures are installed, and the site has been stabilized. A copy of the
approved plan shall be kept on file at the job site.
• Agents, officials, or other qualified persons authorized by the Town, have the right to periodically inspect
land disturbing activities to ensure compliance and to determine whether the measures required in the
plan are effective in controlling erosion and sedimentation resulting from land disturbing activity.
• As of April 1, 2019, all new construction activities are required to complete and submit an electronic
Notice of Intent (NOI) form requesting a Certificate of Coverage (COC) under the NCG010000

Construction Stormwater General Permit. This form MUST be submitted prior to the commencement of
any land disturbing activity on the above named project. The NOI form may be accessed at
deg.nc.gov/NCG01. Please direct questions about the NOI form to Paul Clark at Pau l.clark(cDncdenr.gov
or Brooklyn Broussard at Brooklyn.Broussard(c�ncdenr.gov. After you submit a complete and correct NOI
Form, a COC will be emailed to you within three business days. Initially, DEMLR will not charge a fee for
coverage under the NCG01 permit. However, on or after May 1, 2019, a $100 fee will be charged
annually. This fee is to be sent to the DEMLR Stormwater Central Office staff in Raleigh.
Title 15A NCAC 4B .0118(a) and the NCG01 permit require that the following documentation be kept on
file at the job site:
1. The approved E&SC plan as well as any approved deviation.
2. The NCG01 permit and the COC, once it is received.
3. Records of inspections made during the previous 30 days.
The Town of Fuquay-Varina is not responsible for subject approvals of other Local, State or Federal Agencies. The
subject approvals are (but not limited to) Federal Emergency Management Area Flood regulations/requirements,
Division of Water Quality under stormwater or other water quality regulations/requirements, U.S. Army Corps of
Engineers under Article 404/401 (Wetlands/Streams) jurisdiction/requirements, any provisions of the North Carolina
State Building Code or any structural design plans as conducted by the Fuquay-Varina Inspections Department ,
and/or any Federal, State, County and Local municipal regulations or permit requirements. These permits and
approvals are separate from this approval and the owner, owner's agents, heirs, successors and assigns are
responsible for investigating the need, and obtaining these other permits if required.
Approval of these plans does not supersede, in any manner, the Town of Fuquay-Varina's Code of Ordinances or
the Town's Standard Specifications and Construction Details. All construction shall be implemented in accordance
with the Code of Ordinances and the Standard Specifications and Construction Details as now promulgated and as
hereafter amended by the Town of Fuquay-Varina. Any deviations from the Town's Code of Ordinances and
Standard Specifications and Construction Details shall be called to the attention of the Town before such deviations
are implemented.
To the extent these approved plans vary or conflict with the Town of Fuquay-Varina's Code of Ordinances and/or
the Town's Standard Specifications and Construction Details, said Code and Standard Specifications and
Construction Details shall control irrespective of approval of subject plans. The owner, owner agents, heirs,
successors and assigns, agree the Town shall not be responsible for any claims, damages, losses, costs,
engineering fees, attorney's fees or other professional fees whatsoever, incurred by the owner orthe owner's agents
occasioned by relying upon the subject plans approved by the Town in the event that the subject plans are
inconsistent or in conflict with the Town's Code of Ordinances or the Town's Standard Specifications and
Construction Details.
