Any violation of these terms may De surject to tines, imprisonment or civil action; or may cause the permit to be null and void. Loa Recovery 1) Log and cribbing piles salvage and operations shall only be carried out at the five sites depicted on the attached location map. Salvage from any additional area shall require a modification of this permit. 2) Log and cribbing piles salvage activities shall only be permitted between February 15 to June 30 of any year. Any request to conduct salvage activities outside of this period shall require approval from the Division of Coastal Management. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval All work must cease when the permit expires on December 31, 2017 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permtttee Harry Hiestand ADDITIONAL CONDITIONS Permit # 98 -14 Page 2 of 2 3) No logs, timbers, trees or other debris shall be removed, repositioned, or stored in a manner that the Division of Coastal Management determines would represent a navigational safety hazard. Materials not intended to be taken to a shore support site shall be repositioned (unburied) as close to its original position as possible. 4) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 5) This permit does not authorize the alteration of the shoreline when removing logs and cribbing piles. 6) This permit does not authorize the removal or salvage of any object or material other than submerged logs and cribbing piles. 7) The permittee shall maintain a comprehensive listing of the number of logs and cribbing piles removed sizes of such logs and general location of where the logs were recovered. Copies of this report shall be submitted to the Division of Coastal Management by March I" of each year that this permit is active. Failure to provide this report by the March 151 deadline may result in a violation of this permit. Cultural Resource Protection 8) As required by N.C.G.S. 121 Article 3, prior to the commencement of any log salvage operations, the permittee shall apply for and receive an underwater archaeology permit from the N.C. Department of Cultural Resources. NOTE: Failure to adhere to the requirements of the permit referenced in Condition No. 6 of this permit may result in a violation of this permit. 9) The permittee shall under no circumstances remove or otherwise disturb the remains of any submerged watercraft or contents thereof as described in G.S. 121 -22 10) No vegetated wetlands or open water areas shall be filled, even temporarily. 11) The permittee and/or his contractor shall meet with a representative of the Division prior to project initiation in order to discuss the conditions set forth in this permit. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264 -3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal water level. NOTE: The U.S. Army Corps of Engineers authorized the proposed project under COE Action Id. No SAW- 20014 - 01997.
