Location description: 396 Granite Lane Bakersville, NC 28705. Mitchell County PIN: 0882-00-54-8571. Current land use on site
is dominated by forested land with active mining/industrial activities occurring in the western portion of the project area.
Surrounding land use is dominated by mountain forests to the north, east, and south, with some small areas of commercial and
residential to the west.
Description of Activity: Vulcan’s proposed project consists of installing temporary mining haul roads and associated stream
impacts to an on-site aquatic feature conforming to 33 CFR § 323.4(a)(6)- “Construction or maintenance of farm roads, forest
roads, or temporary roads for moving mining equipment, where such roads are constructed and maintained in accordance
with best management practices(BMPs) to assure that flow and circulation patterns and chemical and biological
characteristics of waters of the United States are not impaired, that the reach of the waters of the United States is not reduced,
and that any adverse effect on the aquatic environment will be otherwise minimized.”.
Vulcan is proposing the temporary placement of a twelve-inch (12”) corrugated high density polyethylene (HDPE) pipe with
small diameter rip-rap stone placed to a depth of approximately thirty-six inches (36”) and approximately two-hundred and
sixty-seven linear feet (267 lf),consistent with 33 CFR § 323.4(a)(6)(i)”… with the purpose of specific farming, silvicultural or
mining operations, and local topographic and climatic conditions”, within intermittent stream SA-2. This will allow for a
temporary haul road crossing for mining vehicles, with a duration of use of approximately twenty-four (24) to thirty-six (36)
months. Temporary impacts of this size are necessary to accommodate the widths of hauling equipment and allows for the safe
passage of two vehicles crossing simultaneously on extreme terrain and shall maintain stream flow and support aquatic life
through design as stated in 33 CFR § 323.4(a)(6)(iii) “culverted, or otherwise designed to prevent the restriction of expected
flood flows.” and 33 CFR § 323.4(a)(6)(vii) “the design, construction and maintenance of the road crossing shall not disrupt
the migration or other movement of those species of aquatic life inhabiting the water body.”. CEC has created a restoration
plan to satisfy 33 CFR § 323.4(a)(6) (xv) “all temporary fills shall be removed in their entirety and the area restored to its
original elevation.”
Your work as proposed does not require Department of the Army authorization for the following reason(s):

completed with this request. This letter does not address nor include any consideration for jurisdiction on aquatic
resources and shall not be interpreted as such. This is not an appealable action. However, you may request an
approved JD, which is an appealable action, by contacting the Corps for further instruction.
Remarks: An Approved Jurisdictional Determination for this parcel was verified by USACE Brandee Boggs
on 4/22//2021 SAW 2020-02074.
This Department of the Army determination does not relieve the permittee of the responsibility to obtain any other required Federal,
State, or local approvals/permits. The permittee may need to contact appropriate State and local agencies before beginning work.
