Hey Barrett,
I have finalized my review of the Dead Tree Phase B As -Built Report submitted to DWR by Restoration Systems, LLC
on September 19, 2022. As a result of the review, DWR has the following comments that need to be addressed:
1. The report is lacking in the following:
a. Signed & Sealed survey - the survey provided is inadequate. The survey should not include the
Project Credit Table in place of accurate measurements taken by the surveyor. The
measurements taken by the surveyor are used to compare with the Credit Table in the Report,
which are two separate documents DWR uses to compare for accuracy and consistency. As
described the approved UMBI for this site, the Survey for this site needs to include a legend that
depicts the measured ft2 (and acres) of each mitigation type and its corresponding widths. For
this specific site, since it is only a Nutrient Offset site, there is no need to separate out
Ephemerals, Streams and Ditches or separate out the specific widths (100, 200) where the 1:1
ratio is applied. However, the surveyor needs to show the measured ft2 and acreage of the
following, as it is currently shown in the corresponding Project Credit Table: Restoration areas,
Diffused flow deduction areas, No Credit Areas (includes the areas denoted as "Preservation"
and where it is less than 50' width.). Modify the survey to remove the Project Credit Table and
have the surveyor replace the Credit Table with their own legend depicting the measurements of
the areas as described above.
b. The Credit Release for Task 2 stated that RS was required to install the missing easement
placards along the entire easement boundary and provide photo documentation of that being
completed (site wide) in the As -Built Report. Section 3.2 indicates this was done, but no photo
documentation was referenced to be included in the report. RS needs to show proof that the
entire boundary was marked appropriately (one photo will not suffice). Keep in mind, that the
easement boundary is supposed to be marked at the Task 2 As -Built walk.
c. The baseline monitoring data shows performance standards that appear to be based on 320
stems/acre rather than 260 stems/acre. Just bringing this to your attention
d. Section 5.3 does not indicate that RS has established a conservation easement. Usually at this
stage, the AsBuilt report identified that the conservation easement was secured. It also
identifies any thing else that is relevant to the easement, such as any assignment to a long term
steward. Explain.
e. Section 5.4 does not indicate specific bonding at this stage. Usually, at this state, a bond is
being secured or has been secured for monitoring. Explain.
f. The planting plan identifies two shrubs. Are these species "shrubs" or mid -story trees? The
BPDP only approved Trees for planting and trees to be used towards the performance
criteria. Explain
g. Please make sure that RS updates their templates for their figures changing the "Prepared For"
from 401 & Isolated Wetland Program..." to "401 & Buffer Permitting Branch". No action is
required for this report, but please make sure to do this on all future documentation submitted
to this Branch.
Please provide a detailed and formal response to all items above, including all necessary supporting documentation,
and submit to DWR via the electronic submittal form. It would be best to send me an email when you have uploaded
