Dear Mr. Seymour:
On December 19, 2014, the Division of Water Resources — Water Quality Programs (Division)
received your application dated December 12, 2014, requesting a 401 Water Quality
Certification from the Division for your project. The Division has determined that your
application is incomplete and cannot be processed. The application is on -hold until all of the
following information is received:
1. A complete review of the project cannot be conducted until the U.S. Army Corps of
Engineers has verified what the "Project limits" will be for this lot in consideration of
the larger industrial park and utilities. [15A NCAC 02H .0502(a)(7)]
2. In order for the Division to determine avoidance and minimization, please provide a
site /development plan (you may submit a conceptual development plan if final design
plans are not available) for the project. [15A NCAC 02H .0502(g)]
3. Please locate all wetlands, streams, and other waters of the State as overlays on the
site plan. [15A NCAC 02H .0502(b)]
4. Please locate all of the protected riparian buffers as overlays on the site plan, clearly
showing Zone 1 and Zone 2. [15A NCAC 02B .0267(8)(b)(iv)]
5. Please re- submit your site plans for the entire project shown at a scale of that is
legible and with topographic contours shown. [15A NCAC 02H .0502(b)].

6. Please readdress Item E on Page 8 of the PCN form for the overall development. You
may determine the answers to these questions based on a conceptual development
plan. [15A NCAC 02H .0506(b)(5) and (c)(5)]
7. Per Condition 6 of GC 3890, all work must be done "in the dry ". Therefore,
dewatering methods will be necessary to temporarily dewater the stream channel
during pipe installation. Please provide a construction sequence that details the
method of dewatering to be utilized at the site and the sequence of construction
events to be followed to ensure compliance with this condition. In addition, please
ensure that the location of the temporary impacts are shown on the construction
drawings and clearly indicated in the revised impact table. [15A NCAC 02H
.0502(b)(3)]
8. Please provide a detail showing the proper installation (below the streambed
elevation) of the riprap pad at the culvert outlets. [15A NCAC 02H .0502(b)]
Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested
information for the proper consideration of the application. If all of the requested information
is not received in writing within 30 calendar days of receipt of this letter, the Division will be
unable to approve the application and it will be returned. The return of this project will
necessitate reapplication to the Division for approval, including a complete application package
and the appropriate fee.
Please respond in writing within 30 calendar days of receipt of this letter by sending three
copies of all of the above requested information to the Wetlands, Buffers, Stormwater —
Compliance and Permitting (Webscape) Unit, 1617 Mail Service Center, Raleigh, NC 27699-
1650.
Please be aware that you have no authorization under the Water Quality Certification Rules for
this activity and any work done within waters of the state may be a violation of North Carolina
General Statutes and Administrative Code.
