Dear Mr. Shoaf:
In accordance with the application for a discharge permit received on July 27, 1995, the Division is
forwarding herewith the subject NPDES permit. This permit is issued pursuant to the requirements of
North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina
and the U.S. Environmental Protection Agency dated December 6, 1983.
In response to your December 14, 1995 letter concerning the NPDES draft permit no. NCO023868
for the City of Burlington, we have addressed your specific concerns as follows:
- We support your efforts to coordinate sampling of upstream and downstream sites with the City of
Graham.
- The discharge limitations for BOD and Total Suspended Residue for summer and winter were
incorrectly shown as daily -maximum values rather than weekly averages. This error has been
corrected. Please refer to enclosed corrected effluent limitations and monitoring requirements sheets.
- The Daily/3/week and Monthly/3/week notations for parameters that are monitored at both the
effluent and up- and downstream were confusing in the draft permit and have been eliminated. The
final permit contains separate sheets for effluent and instream monitoring.
- We concur with your request to reduce.the conductivity monitoring frequency based. on the
expected consistency of conductivity in the effluent. Conductivity monitoring will be required three
times/week during the months of June, July, August, and September and once/week during the
remainder of the year for both the effluent and instream monitoring locations.
- The orthophosphate requirement has been removed from the effluent limitations and monitoring
requirements for the November 1 - March 31 monitoring period and the heading on this sheet has
been changed to read "winter' instead of "summer". -
- The sample type for cyanide has been changed from composite to grab for both the summer and
winter monitoring periods.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30).
days following receipt of this letter. This request must be in the form of a written petition, conforming to
Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative
Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. Unless such demand is
made, this decision shall be final and binding.

In compliance with the provision of North Carolina General Statute 143-215.1, other lawful standards
and regulations promulgated and adopted by the North Carolina Environmental Management
Commission, and the Federal Water Pollution Control Act, as amended,
City of Burlington
is hereby authorized to discharge wastewater from a facility located at
East Burlington Wastewater Treatment Plant
on Quarry Road
Alamance County
to receiving waters designated as the Haw River in the Cape Fear River Basin
in accordance with effluent limitations, monitoring requirements, and other conditions set forth in Parts I,
II, and III hereof.
The permit shall become effective April 1, 1996
This permit and the authorization to discharge shall expire at midnight on January 31, 2001

screen, grit chamber, equalization basin, primary clarifiers, anaerobic tanks, anoxic tanks,
aeration tanks, secondary clarifiers, final effluent filters, chlorination and- dechlorination
along with carbon addition to aid in color and toxics removal located at East Burlington
Wastewater Treatment Plant on Quarry Road, Alamance County (See Part III of this permit),

2. Discharge wastewater from said treatment works -at the location specified on the attached
map into the Haw River which is classified Class C-NSW waters in the Cape Fear River
Basin.

2 The monthly average effluent BOD5 and total suspended residue concentrations shall not exceed 15% of the respective influent value.

SAMPLE LOCATIONS
1. Upstream at Hopedale Road (NCSR 1712)
2. Downstream at Highway 54 and at NCSR 2158 (above the dam).
Upstream and downstream samples shall be grab samples. Instream sampling should be coordinated to reduce
redundant sampling for the Burlington - East, Burlington : South, and Graham wastewater treatment facilities under
the guidance of the Winston-Salem Regional Office. Each facility should conduct instream sampling the same day
and in so far as possible at the same time of day.
REPORTING REQUIREMENTS
Data entered on a form approved by the Division and summarized in an annual report due by January first of the
year immediately following the summer period when sampling occurred.

H) CHRONIC TOXICITY PASS/FAIL PERMIT LIMIT (QRTRLY)
The effluent discharge shall at no time exhibit chronic toxicity using test procedures outlined in:
1.) The North Carolina Ceriodaphnia chronic effluent bioassay procedure (North Carolina Chronic Bioassay
Procedure - Revised *September 1989) or subsequent versions.
The effluent concentration at which there may be no observable inhibition of reproduction or significant mortality is
36 % (defined as treatment two in the North Carolina procedure document). The permit holder shall perform
quarterly monitoring using this procedure to establish compliance with the permit condition. The first test will be
performed after thirty days from the effective date of this permit during the months of February, May,
August, and November. Effluent sampling for this testing shall be performed at the NPDES permitted final
effluent discharge below all treatment processes.
All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge
Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGP3B. Additionally,
DEM Form AT-1 (original) is to be sent to the following address:

Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in
association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent toxicity
sample must be measured and reported if chlorine is employed for disinfection of the, waste stream.
Should any single quarterly monitoring indicate a failure to meet specified limits, then monthly monitoring will
begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will
revert to quarterly in the months specified above.
Should any test data from this monitoring requirement or tests performed by. the North Carolina Division of
Environmental Management indicate potential impacts to the receiving stream, this permit may be re -opened and
modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism
survival and appropriate environmental controls, shall constitute an invalid test and will require immediate
retesting(within 30 days of initial monitoring event). Failure to submit suitable test results will constitute
noncompliance with monitoring requirements.

MEMORANDUM OF UNDERSTANDING
CITY OF BURLINGTON AND CITY OF GRAHAM
COOPERATIVE INSTREAM SAMPLING IN COMPLIANCE WITH NPDES PERMIT
In compliance with NPDES permits, the City of Burlington and the City of Graham will
enter into agreement for cooperative instream sampling at the specified locations in order to
reduce redundant sampling for the East Burlington (NPDES No. NC0023868), South Burlington
(NPDES No. NCO023876), and Graham (NPDES No. NC002121.1) wastewater treatment
facilities. This agreement shall include a schedule of sample dates; parameters and locations; and
reporting of DMR. This agreement has an effective date of April 1,1996.

1995. Since .that time, the Rapid Assessment Group has been reviewing our instream
monitoring requirements and data needs. We have come to the conclusion that, for
this cluster of facilities, the need and usefulness of orthophosphate (PO4) is not
outweighed by the difficulties associated with sampling for this parameter. Therefore,
we are recommending that the requirements for orthophosphate sampling at the
effluent and instream be removed from the permit. All other requirements should
remain as ou!.Iined in the memorandum dated February 9, 1996.

Per Basin Managemecit Strategy, (section €.5 Texie Substances) -Burlington - East, Graham, and Burlington
- South were reviewed and allocated based upon a new toxics pro cedure utilizing a statistical review and
analysis of current effluent data.
The current permit requirements for Burlington - East, Graham, and Burlington - South collectively contain
seven instream monitoring sites, (some which are monitored by two different facilities) : SR 1712
(Hopedale Road), Highway 54, SR 2116 (bridge over Haw River), Highway 87 (bridge over Big Alamance
Creek), SR 2116 (bridge over Big Alamance Creek), Saxapahaw Lake (above dam), and SR 1005.
Recommendations for permit renewals will not change these sites, but the Technical Support Branch
requests these facilities coordinate instream monitoring under the guidance of the Winston - Salem Regional
Office. Recommendations from the Technical Support Branch would be a collective effort to monitor
instream on the same day and if possible at the same time of day.
Recommendations for parameters to be monitored instream will change for some of these permits. For
example, those permits which previously contained BODS and NH3-N monitoring will no longer be
required to take these samples. Instead, all three of these permits will need to take instream TP and
orthophosphate samples as well as temperature, dissolved oxygen, fecal coliform, and conductivity.

CHRONIC TOXICITY PASS/FAIL PERMIT LIMIT (QRTRLY)
The effluent discharge shall at no time exhibit chronic toxicity using test procedures outlined in:
1.) The North Carolina Ceriodaphnia chronic effluent bioassay procedure (North Carolina Chronic
Bioassay Procedure - Revised *September 1989) or subsequent versions.
The effluent concentration at which there may be no observable inhibition of reproduction or significant
mortality is 36 % (defined as treatment two in the North Carolina procedure document). The permit
holder shall perform auarj_ejry monitoring using this procedure to establish compliance with the permit
condition. The first test will be performed after thirty days from the effective date of this permit during
the months of Feb., May., Aug., and -Nov. Effluent sampling for this testing shall be performed
at the NPDES permitted final effluent discharge below all treatment processes.
All toxicity testing results required as part of this permit condition will be entered on the Effluent
Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter code
TGP3B. Additionally, DEM Form AT-1 (original) is to be sent to the following address:

Test data shall be complete and accurate and include all supporting chemical/physical measurements
performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine
of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of
the waste stream
Should any single quarterly monitoring indicate a failure to meet specified limits, then monthly
monitoring will begin immediately until such time that a single test is passed. Upon passing, this
monthly test requirement will revert to quarterly in the months specified above.
Should any test data from this monitoring requirement or tests performed by the North Carolina Division
of Environmental Management indicate potential impacts to the receiving stream, this permit may be re-
opened and modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival and appropriate environmental controls, shall constitute an invalid test and will require
immediate retesting(within 30 days of initial monitoring event). Failure to submit suitable test results will
constitute noncompliance with monitoring requirements.

1976: WLA for 6.0 mgd w/ limits of 14 mgA BOD5 , 6 mgA NH3-N, 5 mg/I dissolved oxygen, 30 mg/I TSS, 200/100 mL fecal col form,
and 6 - 9 SU pH. No toxics requirements.
1981: WLA for both 6.0 mgd, (same limits recommended) and 12.0 mgd w/ limits of 8 mg/I BOD5,, 5 mgA NH3-N, 5 mg/I dissolved
oxygen, 30 mg/I TSS,1,000/100 mL fecal coliform, and 6 - 9 SU pH. No toxics requirements.
1982: WLA for summer and winter limits of 12.0 mgd.
1984: Toxicological evaluation indicated problems; high phenols, (not limited in C class waters), mercury was detected, and ammonia
levels were potentially acutely toxic. SOC-and instream assessment for increased flow determined that the Burlington —South
plant was the cause of instream DO sags, (predicted 4.8 mgA dissolved oxygen approximately 6 miles below Burlington - East
discharge).
1985: WLA w/ same limits for 12.0 mgd and addition of mecrury limit (0.7 µgA) and aluminum and zinc monitoring.
1987: reissued with same limits and addition of nickel (0.14 mgA) and lead (0.065 mgA) limits as well as cadmium, chromium, mercury,
copper, and zinc monitoring. A chronic toxicity test as well as extensive instream monitoring were added. A 2.0 mgA total
phosphorus limit was required by 1990. 'An extensive Level B was developed, but the proposed Level C was not completed due
to complications in obtaining TOT data, (refer Burlington - South).
1990: Letter outlying the various instream monitoring requirements included.
1992: reissued with current limits.

pretty good for the most part, dramatic BOD and TSS violations in May, '1995.
Instream Monitoring
this facility is currently taking BOD5 and NH3-N as part of their instream requirements. After discussing this with Steve Buvington, it was
decided that we should drop these and required PO4 at various sites to be coordinated between the two Burlington plants. When the
two facility's instream sample averages are compared, it is evident that temperatures drop significantly as this river flows downstream.
This should prove pertinent in a modeling analysis as well as trying to develop nutrient loading into the backwaters of the many dams
along this stretch of river.

The current permit requirements for Burlington - East, Graham, and Burlington - South collectively contain seven instream
monitoring sites, (some which are monitored by two different facilities) : - SR 1712 (Hopedale Road), Highway 54, SR 2116
(bridge over Haw River), Highway 87 (bridge over Big Alamance Creek), SR 2116 (bridge over Big Alamance Creek),
Saxapahaw Lake (above dam), and SR 1006.
Recommendations for permit renewals will not change these sites, but the Technical Support Branch requests these
facilities coordinate instream monitoring under the guidance of the Winston - Salem Regional Office. Recommendations
from the Technical Support Branch would be a collective effort to monitor instream on the same day and if possible at the
same time of day.
Recommendations for parameters to be monitored instream will change for some of these permits. For example, those
permits which previously contained BOD5 and NH3-N monitoring will no longer be required to take these samples. Instead,
all three of these permits will need to take instream TP and orthophosphate samples as well as temperature, dissolved
oxygen, fecal coliform, and conductivity.
