Therefore, the State of North Carolina certifies that this activity will not vialate tl�e applicable portions of Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. This approval is only valid for the purpose and design that yau submitted in your application received October 2, 2014. Should your project change, you are required to notify the NCDWR and submit a new app3ication. If the property is sold, the new owner must be given a copy of this Certification and approval letter, and is therehy responsible for complying with all the conditions. If any additional wetland impacts, or stream impacts, for this praject (now or in the future) exceed one acre or 1501inear feet, respectively, additional compensatory �nitigation may be required as described in l5A NCAC 2H .0546 {h) (6) and (7). For this approval to remain �alid, you are required to comply with all the conditions listed below. In addition, you should obtain all other federal, state or local permits before proceeding with your project including {but not limited to} Sediment and Erosion conkrol, Coastal Stormwater, No�i-discharge and Water Supply watershed regulations. This Certification shall expire on the same day as the expiration date of the corresponding Corps of Engineers Permit. Conditions of Certification: 1. Hazardous spiEl basins shall be constructed along the project corridor at stream crossing located within the Lake Twitty watersl�ed per the commitment in the Record of Decision (ROD) dated August 2010. It is recommended that hazardous spill basins be constructed at all stream crassings where practicable along the project corridor. [15A NCAC 02H.0506(b)(2)] 2. Worfc in the dry. A11 work in or adjacent to the streams/wetlands shall be conducted so that they do not come into contact with the diskurbed areas. [ 15A NCAC 02H.0506(b}{3) and (c)(3)] 3. All portions of the proposed project draini��g ta 303(d) listed watersheds that are impaired due to turbidity shall be designed, constructed, anc� operated with sedirnent and erosion contral measures that meet Design Standards in Sensitive Watersheds (15A NCAC 4B .0124). However, due to the size of tlfe project, NCDOT shall not be rec�uired to meet 15A NGAC 4B .0124{a) regarding khe maximum amount of uncovered acres. All portions of the proposed project draining to 303(d) listed watersheds that are impaired due to biological criteria exceedances shaEl not discharge stormwater directly to surface waters. Stormwater shall be treated using appropriate 6est management practices (e.g., vegetated conveyances, constructed wetlands, detention ponds, etc.) prior to discharging to surface waters. [ 15A NCAC 02BA200] 4, lf any construction staging, storage, refueling, borrow pit or spoil areas are chosen within the Goose Creek or Six Mile Creek watersheds, NCDOT will develop BMPs for aach site to avoid and minimize potential adverse effects. In addition, NCDOT shall caordinate with NCDWR to ensure compliance with the Goose Creek Riparian Buffer Rules. [15A NCAC 02B.Ob07] 5. Diversion ditches and similar measures for tlie purpose of sediment and erosion controi will be matted and maintained to ensure maximam efficiency for the reductian of sediment loss and turbidity. This includes interior and exterior slopes of sediment basins. [15A NCAC 02H.0506(b){3) and (c)(3)] 6. Tha area iminediataly adjacent to the stream within the work zone shall be matted or covered (at minimum) prior to rain events. [15A NCAC 02H.0506(b)(2)J 7. Slopes in excess of 10 ft in height and located within 30 ft of waters of the state shal] be matted, at minimum, upon completion and/or in accardance with the sedimant/erosion control plan. It is strongly recommended to be matted at the earliest possible time. [�SA NCAC 02B.0607] 8. Pipes and culverts used exclusi�ely to maintain equilibrium in wetlands, where aquatic life passage is not a concern, shall not be buried. These pipes shall be installed at natural ground elevation. [l SA NCAC 02H.0506(b)(2}] If multiple pip�slculverts are proposed to pass stream flow, they shall ba designed to inimic natural stream crass section as close as possible. Baffles and sills may be required to meet this requirement. The stream channel shall not be widened to the greatest exte��t practicable. [15A NCAC 02H.0506(b}{2)] 10. Unless atherwise approved by this ce�tification, placement of culverts and other structures in open waters and streams shali be placed below the elevation of the streambed by one foot for all culverts with a diameter greater than 48 inches, and 20 percent of the culvert diameter for culverts l�aving a diameter less than 48 inches, to allow !ow flow passage af water and ac�uatic life. Design and placement of culverts and other structures including temporary erosion control measures shall not be conducted in a manner that may result in dis-equilibrium of wetlands or streambeds or banks, adjacent to or upstream and downstream of the above structures. The app]icant is required to provide evidence that the equilibrium is beii�g maintained if requested in writing by the NCDWR. If this condition is unab2e to be met due to bedrock or other limiting features encountered during construction, please co�ftact the NCDWR for guidance on how to praceed and to determine whether or not a permit modification wil� be required. The dime�3sion, pattern and profile of the stream above and below the crossing shall �iot be madified. Disturbed floodplains and streams shall be restored to natural geomorphic conditia��s. [ 1 SA NCAC 42H.0506(b){2)] 11. Native riparia» vegetation must be reestabEished in the ripariaEi areas witl�in the construction limits oFthe project by the end of the growi►zg season followi�ig completiar� of constructio�f. [1 SA NCAC 02B.0607] 12. There shall be no excavation from, or waste disposaE into, jurisdictioi�al wetlands or waters associated with this permit without appropriate modification. Should waste or borrow sites, ar access roads to waste or borrow sites, be located in wetlands or streams, compensatory mitigation will be required sizice that is a direct impact from road canstruction activities. [15A NCAC 02H.0506{b)(3) and (c)(3}] 13. If concrete is used during construction, a dry work area shall be maintained to prevent direct contact between curing concrete and stream water. Water that inadvertentiy contacts uncured concrete shall not be discharged to surface waters due ta the potential for elevated pH and possible aquatic life and fish kilis. [15A NCAC 02H .0506(b)(3}] 14. Heavy equipment shall be operated from the banks rather than in the stream chan3�e1 in order to minimize sedimentation and reduce the intraduction of other poilutants into the stream. [ 15A NCAC 02H.0506(b)(3)] 15. �n accordance with 15A NCAC 02H.0506(h), compensatory mitigation for the losses of —1> 150 If af stream and or =/> 0.10 acre or wetlands is required. We understand that you have chosen to perform compensatory mitigation for impacts to streams through the North Carolina Ecosystem Enhancement Program (EEP), and that the EEP has agreed to irnplemet�t the mitigation for the project. EEP has indicated in a letter dated November 4, 2014, that tlfey wili ass�me responsibility for satisfying the federal Clean Water Act compensatory mitigation requirements far the above- referenced project, in accordance with the �Ep Mitigation Banking Instrument signed duly 28, 2010. Until the EEP receives and clears your payment, atfd proof of payment has been provided to this Office, no impacts specified in this Authorization Certificate shall occur. Erosion and sediment control practices must be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practicas in order to protect surface waters standards[15A NCAC 02H.OSOb(b)(3) and {c)(3}]: a. The erosion and sediment control measures for #he project must be designed, i��stalled, operated, and ma�ntained in accordance with the most recent version of ti�e North Carolina Sedz�rient and Erosiort Control Planrring and Desigrr Manual. b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of t�e North Carolina Sedinaent and Erosion Control Manual. The devices shall be maintained on all constructian sites, borrow sites, and waste pife (spoil) projects, including contractor-owned or leased borrow pits associated with the project. c. For 6orrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and mai��tained in accordance witli the most recent �ersion of the North Carolina Surface Mirring Manual. d. The reclamation meastires and impletnentation must comply witlt the reclar�-iation in accordance with the requiremevts of the Sedimeniation Pollution Contral Act. 17. Sediment and erosion control measures sl�ail not be placed in w�tlands or waters unless otherwise approved by this Cerkification. [ISA NCAC 02H.0506(b)(3} a»d (c)(3)] 1 S. [ 15A NCAC 02H.4506(b)(3)] 20. Where ponds are drained, praper measures shall be utilized to drain the pond with limited impact to upstream and downstream channel stability and water quality, as well as to nati�e aquatic species. If typical pond draining tecl�niques fail to work or create significant disturbance to aquatic species, additional measures may be required {such as relocakio�f). The permittee shal2 observe any natural channel re-establishment, or utilize natural channel construction techniques, to ensure that the jurisdictianal stream chaiznel above and below the pond remains sta6[e. [15A NCAC 02H.0506(b}(2)� 21. Tail fescue shall not be used in the establishrr�ent of temporary or permanent ground cover within riparian areas. For the establishment of permanent herbaceous cover, erosion contral matting (biodegradable) shall be used in conjunction with appraprtate seeding an disturbed soils within the riparian area and on disturbed steep slopas. All mecl�anized eguipment operated near surface waters must be regularly inspected and maintained to prevent contamination of stream waters fro�n fuels, lubricants, hydraulic fluids, or other toxic materia�s. [15A NCAC 02H.0506(b)(3}] 23. No rock, sand ar other materials shall be dredged from the stream ch�nnel except where authorized by this certification. [ 15A NCAC 02H.0506(b)(3)] 24. Discharging hydroseed mixtures and washing out l�ydroseeders and other equipment in or adjacent to surface waters is prohibited. [ 15A NCAC 42H.0506(b)(3)] 25. The outside buffer, wetland ar water boundary located within the construction corridor approved by this authorization shal] be clearly mar�Ced by hig��ly �isible fencing prior to any land disturbing activities. Impacts to areas within the fencing are prohibited uniess otherwise authorized by this certification. [15A NCAC 02H.0501 and .0502] 26. A copy of this Water Quality Certification shall be maintained on the construction site at a11 times. In addition, the Water Quality Certification and all subsequent modificatio�fs, if any, shall be maintained with the Division Engineer and the on-site project manager.
