OF PERMITTING Capital►►lesale Fence Company Mecklenburg ► ►; Dear Mr. Olnowich: On September 1, 2022, staff from the Department of Environmental Quality Mooresville Regional Office of the Division of Energy, Mineral and Land Resources (DEMLR), visited the subject facility located at 4709 Rozzelles Ferry Road, Mecklenburg County, North Carolina. The site visit and file review revealed that Capital Wholesale Fence Company, Inc. has neither applied for, nor obtained coverage under an NPDES General Industrial Stormwater Permit for stormwater discharges from the site. The site currently discharges stormwater affected by processes on site to the City of Charlotte Municipal Separate Storm Sewer System. The industrial activities and processes observed on site include but are not limited to: Storage of wood and plastic products as well as plastic cutting operations. An NPDES permit is required to discharge stormwater to waters of the state in accordance with G.S. 143-215.l(a) and Title 15A North Carolina Administrative Code (hereby known as NCAC). 2H .0126. A written response shall be submitted to the Department within 30 days of receipt of this notification. The written response shall specifically address each of the following items: 1) Explain your intent to secure permit coverage for the subject facility and that you will submit a Notice of intent (NOI) within 45 days of the date of this letter. Notice of Permitting Requirement November 17, 2022 Page 2 of 2 2) If you are not seeking permit coverage, please explain what modifications have been made to your industrial process to disqualify the subject facility from permitting requirements. The written response must also include documentation (photos) that the described modifications have been completed and that you are submitting a request for a "no exposure certification" found at: hqps://deq.nc.gov/ . energy -mineral-and-land- resources/storm,vvater/npdes-gene ral-permits/no-exposure-certification- qpplication/dowmload . (Your response should clearly include dates when the modifications were made and when the No Exposure Certification request shall be submitted.) Thank you for your attention to this matter. This office requires that the violations, as detailed above, be properly resolved. These violations and any future violations are subject to a civil penalty assessment of up to $25,000 per day for each violation. Your efforts to undertake activities to bring the subject site into compliance are not an admission, rather they are actions that must be taken in order to begin to resolve ongoing environmental issues. The timeliness with which you submit an NOI, the degree and extent of harm to the environment, and the duration and gravity of the violation(s) will be considered in any civil penalty assessment process that may occur.
