Progress Energy - Sutton

This letter is offered to clarify the Part I. Condition A.(12) of the permit issued December
27, 2002. Based on correspondence and conversations between Mr. Reid Garrett (Senior
Environmental Specialist with Progress Energy), Mr. Mark Hale (Environmental Biologist with
Division of Water Quality), and Ms. Susan Wilson (Environmental Engineer with Division of Water
Quality), the Division of Water Quality offers the following comments to clarify the fish study and
monitoring requirement.
The fish tissue analysis and reporting are required should a discharge occur from Outfall
004 during any 120 days within the calendar year. Should the 120 days of discharge be met after
the field season (spring to fall), then the analysis shall commence as a one -time study during the
next field season (any period during the spring to fall season). The intent of the condition is to
perform the study only one time during the calendar year. Again, should the 120 days discharge
occur later in the calendar year, then the analysis /study shall commence during the next
calendar year (during the field season).
The Division of Water Quality believes that one study during a calendar year, when
necessary, should provide sufficient information to determine the potential impact of the
discharge.
