Thank you for those efforts. We believe that your plans are in line with the avoidance and minimization requirements of the 404, 401 and the Jordan Lake Buffer Rules. We have determined that the current design would be able to be authorized as an allowable use (requires a written Buffer Authorization from DWR) rather than the more complicated Buffer Variance process. The is pursuant to Session Law 2013-395 Section 2 . Moving forward with this project you can submit the Buffer Authorization request as part of the PCN with the 404/401 and Colleen in our Raleigh Regional Office will review it once submitted. She can loop me back in as/if needed. Thank you all for your efforts to work through this process to ensure a much simpler approval process. Good Morning Sue and Colleen — Thank you again for meeting us on zoom on the 18t" with regards to the UNC CH Business School Addition. The design team has been reworking the design to minimize the impacts to the stream since we met. We believe that we're headed in a better direction now, but would like your input: • The design you saw on the 18t" is attached in the "previous stream impacts" pdf. • A PDF showing the impacts of the redesign is also attached. We're still working through how the stream ends as it meets the building (the perspective is also attached), but the proposed constructed wetland is now outside of the buffers. We'd propose enhancing the existing plantings in zone 1 and 2. Do you think this will be a more acceptable direction when applying for the major variance?
