Division personnel have reviewed and approved your application for renewal of the subject permit. Accordingly,
we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of
North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the
U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended).This permit contains no
significant changes from the draft permit sent to you on October 11, 2006.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to
you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of
this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North
Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center,
Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may require
modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to
obtain other permits which may be required by the Division of Water Quality or permits required by the Division of
Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may

permit bearing this number is no longer effective. Therefore, the exclusive authority

µg/L. If the measured level of 1,1-Dichloroethene or 1,2-Dichloroethane is below
the detection limit, then the measurement is considered to be zero for

There shall be no discharge of floating solids or foam visible in other than trace amounts.
A. (2.) CHRONIC TOXICITY PERMIT LIMIT (QRTRLY)
The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant
mortality to Ceriodaphnia dubia at an effluent concentration of 90%.
The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined
in the"North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998,
or subsequent versions or"North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure"
(Revised-February 1998) or subsequent versions. The tests will be performed during the months of
February,May,August and November. Effluent sampling for this testing shall be performed at the
NPDES permitted final effluent discharge below all treatment processes.
If the test procedure performed as the first test of any single quarter results in a failure or ChV below
the permit limit, then multiple-concentration testing shall be performed at a minimum, in each of the
two following months as described in"North Carolina Phase II Chronic Whole Effluent Toxicity Test
Procedure" (Revised-February 1998) or subsequent versions.
The chronic value for multiple concentration tests will be determined using the geometric mean of the
highest concentration having no detectable impairment of reproduction or survival and the lowest
concentration that does have a detectable impairment of reproduction or survival. The definition of
"detectable impairment,"collection methods, exposure regimes, and further statistical methods are
specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised-
February 1998) or subsequent versions.
All toxicity testing results required as part of this permit condition will be entered on the Effluent
Discharge Monitoring Form (MR-1) for the months in which tests were performed, using the
parameter code TGP3B for the pass/fail results and THP3B for the Chronic Value. Additionally,
DWQ Form AT-3 (original) is to be sent to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no
later than 30 days after the end of the reporting period for which the report is made.
Test data shall be complete, accurate, include all supporting chemical/physical measurements and
all concentration/response data, and be certified by laboratory supervisor and ORC or approved
designate signature. Total residual chlorine of the effluent toxicity sample must be measured and
reported if chlorine is employed for disinfection of the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity
monitoring is required, the permittee will complete the information located at the top of the
aquatic toxicity(AT) test form indicating the facility name, permit number, pipe number,
county, and the month/year of the report with the notation of"No Flow" in the comment area
of the form. The report shall be submitted to the Environmental Sciences Section at the
address cited above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required,
monitoring will be required during the following month.
Should any test data from this monitoring requirement or tests performed by the North
Carolina Division of Water Quality indicate potential impacts to the receiving stream, this
permit may be re-opened and modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum
control organism survival, minimum control organism reproduction, and appropriate environmental
controls, shall constitute an invalid test and will require immediate follow-up testing to be completed
no later than the last day of the month following the month of the initial monitoring.

Summary:
On September 30, 1999, the Division of Water Quality issued NPDES Permit No. NC0085928 to
American Truetzschler,Inc., to operate a Ground Water Remediation System (GWR) with a design
capacity of 0.05 MGD. This permit was renewed on November 13, 2001 with minor changes
from the initial permit of 1999. On March 2, 2006, American Truetzschler, Inc., applied to renew
the NPDES permit. The application cited no changes or additions to the system since the
existing permit was issued.
Facility Description:
The facility operates a GWR designed to treat chlorinated organic solvents from groundwater
received from several recovery wells located at the facility in Gastonia, NC. The GWR consists
of an equalization tank followed by a particulate filter, a sodium cation exchange system, a
crushed limestone filtration unit and an air stripper. Solids generation is not expected
therefore, no special handling or disposal of generated solids/sludge's is required.
Basin Plan:
All water supply waters in this Subbasin are Supporting on an Evaluated basis based on
reports from DEH regional water treatment plant consultants.

Whole Effluent Toxicity (WET)Test:
Quarterly sampling data was reviewed from February 2002 to July 2006. The facility had

DMR Instream and Effluent Data Review :
The facility monitors for flow, 1,1-dichloroethene, 1,2-dichloroethane, trichloroethylene (TCE),
1,1-dichloroethane, 1,1,1-trichloroethane, tetrachloroethylene (PCE), and chronic toxicity.
Data from the 2002-2006 DMRs was reviewed to assess reasonable potential for 1,1-
dichloroethene, 1,2-dichloroethane, PCE, TCE, 1,1-dichloroethane, and 1,1,1-trichloethane and
revealed values less than 1 ug/L, which is considered in compliance. No reasonable potential
was run for this permit renewal.
The average flow for the period of January 2002 to June 2006 was 0.004 MGD (8 % of
permitted flow). The maximum monthly flow in 2/1/2003 was 0.027 MGD and the minimum
monthly flow in 5/1/06 was 0.00002 MGD.
Correspondence
Staff Report:
Mooresville Regional Staff Engineer Michael Parker conducted a site inspection on April 5,
2006. The facility was found to be in compliance with the permit requirements at the time of
inspection. The staff report prepared on April 19, 2006 recommends the reissuance of the
permit.
Proposed Modifications:
There were no proposed modifications requested by the facility on the permit renewal submittal
and none are proposed at this time.

PART III -EVALUATION AND RECOMMENDATIONS
American Truetzschler, Inc. (ATI)has applied for renewal of the subject NPDES permit.
The permit authorizes the discharge of groundwater contaminated with chlorinated organic solvents.
This facility has consistently met it NPDES permit limitations with the exception of toxicity. In
fact,the effluent is so clean, the organisms used in the toxicity test cannot survive due to the lack of
nutrients in the waste stream.
After treatment,the recovered groundwater is discharged to a dry road ditch that extends
3000 feet before emptying into the Catawba River(Lake Wylie). The ditch is not currently
designated as an effluent conveyance channel nor is there any evidence that aquatic habitat is
present. Even if the effluent did reach the main segment of the Catawba River, it is likely that
toxicity testing would not be required. The addition of the compost filter in 2003 was an attempt to
"dirty up"the effluent so that compliance with the toxicity testing requirement could be met.
Since there is practically no chance that aquatic life would be expected to survive or
propagate in the ditch that transports the effluent, this Office can not find justification to require
ATI to perform an expensive toxicity test since the results would have little or no bearing on the
protection of water quality. Based on the obvious lack of potential for water quality impacts as a
result of this discharge,this Office questions the need to require toxicity testing at ATI,and
recommends that the requirement for toxicity testing be removed from the permit.
Pending a final review of this renewal request by the NPDES Unit, it is recommended that
the permit be renewed with modifications as noted above.
