SUBJECT: Dam Safety Permit Review for Minimum Release
Unimin Mill Mine Dam
Mitchell County

Longitude: 82° 15'42"
The pond and dam will drain to the North Toe River in the Noliohuoky River Basin. The
drainage area at the dam is about 63 acres.
The dam safety permit is subject to NCAC 15A 2K.0500 Minimum Stream Flows to
Maintain Aquatic Habitat. Based on USGS WSP 2403,the dam is located in Hydrologic Area HA10.
The 7Q10 low flow for sites in HA10 is estimated to be zero if the calculated flow is 0.05 cfs or less.
No minimum release will be required from the dam.
Water withdrawal from the impoundment and the North Toe River will be subject to G.S. 143-
215.22 (G)and(H)and as amended in 1993;registration of water withdrawals and transfers. Please
contact Lisa Routh with the Division of Water Resources,(919)715-5441, if any withdrawal of water
is planned.
The applicant has already consulted with the Wildlife Resources Commission(WRC)and the
Division of Water Resources(DWR)to determine if there are concerns about the effect of the run-of-
river intake on aquatic habitat in the North Toe River. Our understanding of the proposed operation is
that the maximum existing withdrawal rate is 500 gpm,with possible expansion

in the future to a maximum rate of 2000 gpm. These withdrawals constitute 1.1 percent and 4.2
percent of the 7Q10 low flow respectively. Therefore,no significant impacts on aquatic habitats in the
North Toe River are anticipated. The applicant should consult with DWR and WRC if any expansions
beyond 2000 gpm are planned.
