Gents,
Scott requested that I coordinate with NCDWR to determine the responsible agency that would be reviewing concerns
associated with toxicity from the proposed coal ash mines required by the Coal Ash Management Act of 2014 (CAMA-
2014). In talking with Cyndi Karoly on 2 February, it is my understanding that while the former Division of Land Quality is
responsible for the administration of CAMA -2014, DWR is the primary agency reviewing concerns pertaining to toxicity.
I have copied Cyndi and others in DWR so that in the event my understanding is incorrect, she can advise all of us and
then we will know how to direct any questions pertaining to those concerns since the EPA has decided that coal ash is
not a hazardous material.
