Page 7of13 D. Impact Justification and Mitigation 1. Avoidance and Minimization la Specifically describe measures taken to avoid or minimize the proposed impacts in designing project The proposed project includes two (2) impact areas to an unimportant/intermittent stream These impact areas have existing culverts that are in poor condition that need to be upgraded (see attached photos) In addition, these culverts must be extended from the existing Right -of -Way as shown on the plans, and designed to meet the current design standards, both requirements the City of Durham Impact Area #1 includes 65 linear feet of permanent stream and 32 linear feet of temporary stream impact necessary to upgrade the existing culverts and access the property The existing 54" CMP's will be removed and replaced with two (2) 60" RC's, utilizing the existing culvert crossings and therefore minimizing overall impacts to the site Headwalls will also be utilized to minimize stream impacts Impact Area #2 includes 32 linear feet of permanent stream and 61 linear feet of temporary stream impact necessary to upgrade the existing culvert and access the property The existing 54" CMP will be removed and replaced with a 60" RCP, utilizing the existing culvert crossing and therefore minimizing overall stream impacts Headwalls will also be utilized on this crossing to minimize stream impacts All temporary impacts to streams will be brought back to original elevations and stream banks stabilized The riparian buffer impacts have been through the No Practical Alternatives review with eh City of Durham, the Approval is attached. The applicant is aware of the regional conditions associated with the Nationwide Permits 29. With respect to residential development conditions (NWP 29- Regional Conditions section 4.0) the applicant does not anticipate any impacts to streams or wetlands associated with stormwater facilities, there are no impact associated with single - family recreation facilities, there are no permanent wetland or stream fills proposed within the floodway/floodplain and the stream classification for this project is WS -IV, NSW (I a not Outstanding Resource Waters, High Quality Waters, Coastal Wetlands or wetland adjacent to these waters) 1 b Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques Asper the project engineer, Appropnate erosion control measures as approved by Durham County and NCDENR will be ubhzed to avoid /minimize the proposed impacts This includes maintaining proper ground cover for diversion ditches and sediment traps/basins on the site during construction, utilization of a skimmer drawdown device for sediment traps/basins, silt fence /tree protection fence along the grading limits, silt fence outlets, inlet protection for catch basins, and appropriate inspection of all erosion control devices on a weekly basis and within 24 hours of a storm reaching a total rainfall amount of 0 5 inches or greater 2.
