Per my understanding there will be no 404 issued, and thus nothing to associate a 401 to or anything to certify.
Currently, we’d like to withdraw our application.

Mr. Johnson,
On December 1, 2022, the Division of Water Resources (Division) received your application requesting a 401 Water
Quality Certification from the Division for the subject project. The Division has determined that your application is
incomplete and cannot be processed. The application is on‐hold until all of the following information is received:
1. Email discussions with the Army Corps of Engineers indicate that the project is being modified to meet the
exemption for temporary mining roads. Please clarify whether a 401 Water Quality Certification is still required.
If not, please indicate whether you would like to withdraw your application. [15A NCAC 02H .0502(c)]
2. The application proposes the installation of a culvert within a stream. The Division requires that culverts with a
diameter less than 48 inches be placed below the elevation of the streambed by 20% of the culvert diameter to

allow low flow passage of water and aquatic life. Culvert burial is not required when culvert slope is greater than
2.5% or bedrock is present at the culvert location. Please clarify whether the culvert will be buried. If the culvert
cannot be buried, please provide supporting documentation that one of the above conditions is present. If it
cannot be buried due to slope, please include a summary of investigations for flattening and alternate methods
to allow for aquatic life movement/connectivity. [15A NCAC 02H .0506(b)(2)]
3. The PCN does not include a description of how construction techniques will avoid or minimize impacts. Please
include a description of how the culvert and riprap will be installed, ensuring no violation of water quality
standards will occur. Flowing streams must be diverted around the work area. Typically, this is accomplished via
a pump around system or other type of diversion. [15A NCAC 02H .0506(b)(2)]
Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested information for the
proper consideration of the application. Please provide your response by February 17, 2022. If all of the requested
information is not received, the Division will be unable to approve the application and it will be denied as incomplete.
The denial of this project will necessitate reapplication to the Division for approval, including a complete application
package and appropriate fee.
