NORTH &ROLINA Environmental Quality January 23, 2023 Subject: COMPLIANCE EVALUATION INSPECTION Thomas Concrete of Carolina Inc. knightdale Facility, Certificate of Coverage-NCG160159 NPDES Stormwater General Perm it-NCG160000 Wake County Mr. Hartley: On January 19, 2023 a site inspection was conducted for the Fred Smith Company Asphalt Plant facility located at the 605 Old Montague Ln., Wake County, North Carolina. A copy of the Compliance Inspection Report is enclosed for your review. The site visit and file review revealed that the subject facility is covered by NPDES Stormwater General Permit-NCG160000, Certificate of Coverage-NCG160159. Permit coverage authorizes the discharge of stormwater from the facility to receiving waters designated as Milburnie Creek, a Class QNSW waterbody in the Neuse River Basin. As a result of the inspection, the facility was found to be not in compliance with the conditions of the NCG160000 permit. Please refer to the enclosed Compliance Inspection Report for additional comments and observations made during the inspection. Please be advised that violations of the NPDES Stormwater General Permit are subject to a civil penalty assessment of up to $25,000 per day for each violation. The PP&G section should be site specific and should cover removal of any drums or buckets not in use or have them stored properly, regular cleaning of any areas with containmentaion such as secondary containment areas and any areas on the site that have the potential for pollution from stormwater runoff. That would include the plastic containers found around the facility, scrap steel, pallets and refuse.
