On January 19, 2023 a site inspection was conducted for the Fred Smith Company Asphalt Plant facility
located at the 605 Old Montague Ln., Wake County, North Carolina. A copy of the Compliance Inspection
Report is enclosed for your review. The site visit and file review revealed that the subject facility is
covered by NPDES Stormwater General Permit-NCG160000, Certificate of Coverage-NCG160159.
Permit coverage authorizes the discharge of stormwater from the facility to receiving waters designated
as Milburnie Creek, a Class QNSW waterbody in the Neuse River Basin.
As a result of the inspection, the facility was found to be not in compliance with the conditions of the
NCG160000 permit. Please refer to the enclosed Compliance Inspection Report for additional comments
and observations made during the inspection.
Please be advised that violations of the NPDES Stormwater General Permit are subject to a civil
penalty assessment of up to $25,000 per day for each violation. If you or your staff has any

Secondary containment is being pumped out wth no documentation on what was found in the dikes before being pumped
and which dikes were pumped out
The preventive maintenance and good housekeeping section of the plan states only to store drums in secondary
containment and that is no sufficient. The PP&G section should be site specific and should cover removal of any drums or
buckets not in use or have them stored properly, regular cleaning of any areas with containmentaion such as secondary
containment areas and any areas on the site that have the potential for pollution from stormwater runoff. That would include
the plastic containers found around the facility, scrap steel, pallets and refuse.
The pond on site looks to have some issues with staining and surface product accumulation that should be investigated
The Preventive maintenance and Good housekeeping plan should be overhauled to focus on site specific areas and the
inspection documents should list accurately the person inspecting the site and cover all site specific areas on the checklist
