The applicant proposes to repair the dike by filling two breaches (wetlands) and raising other low spots (uplands) using earthen fill. The repair areas will be shaped to match the height of the adjacent, stable dike. Following the filling of the breach areas and low spots, wire - backed silt fencing will be installed to limit the loss of sediment during the stabilization process. Backfill will be stabilized with ground cover seed mix. Approximately 0 045 acre of wetlands will be filled to repair the dike. The definition of the term "development" at N.C. Gen. Stat. § 113A- 103(5)b.5. excludes repair work of the type planned for the dike, irrespective of whether the structure is located within an AEC Therefore, the applicant believes the repair work to be exempt from the CAMA permit requirement Discussions with CAMA representatives have confirmed this.
