Submitting Information to Comply with the
Phase II 316 (b) Rule
Dear Mr. Orser:
The Division of Water Quality has reviewed your request to extend the
deadline for submitting information required by the Phase II Rule, 40 CFR Part
125 Subpart J until January 7, 2008 for the following facilities:
1) NC0000396 Asheville Steam Electric Plant
2) NC0007064 Brunswick Nuclear Plant
3) NC0003433 Cape Fear Steam Electric Plant
4) NC0039586 Harris Nuclear Plant
5) NC0003425 Roxboro Steam Electric Plant
6) NC0001422 Sutton Steam Electric Plant
After considering complexity of the issue and reviewing options allowed by the
rule, the Division grants your request. The Division encourages you to follow the
schedule outlined in your letter and continue consultation with our staff to
achieve compliance with the requirements of the Phase II 316 (b) rule.
