Hey Jason, Per our conversation and appreciate you allowing us to follow up to this via email. While we do not recall all details of this incident, to the best of my knowledge, this incident occurred due to an error of a plumber we had on site making repairs which caused the water to overflow. We sent one of our in-house techs as well as another plumbing provider out there to correct the situation immediately, and the situation was corrected. Since then, to the best of our knowledge, we have had no repeat issues or violations at this site. Due to our quick response to correcting the issue and lack of continuing issues, we would ask for leniency in this matter. Thank you for your time! NCDWR staff determines if further enforcement action (potentially a Civil Penalty) will be assessed on a case -by -case basis. As stated in the Notice of Violation letter, please submit a written response to the NOV. It should include the reason for the spill, actions that were taken to remediate tit, actions that have been taken to prevent future sewer spills, and any other information you'd like to provide. The response will be considered when determining if further enforcement action is appropriate. Bryan, this is the issue that occurred on like your first day that you helped Betsy with in Raleigh. 3 @Robinson, Jason — Is there any way for us to avoid the fine on this one since we reacted to the issue once we were notified and have since fixed the issue? My understanding is this was caused by something a previous plumber did to our line, trying to fix something else, which caused it to spill out. Hi Mr. Pate, We (NC Div of Water Resources) was made aware of this spill after the utilities authority in the area (OWASA) contacted Stormwater staff for the town of Chapel Hill. Chapel Hill then notified us. More than likely a citizen saw the sewage spill and notified OWASA. Please see the attached email chain for more details. Jason T. Robinson, P.E.
