I received the below email from Lyle on 10-18-22.
Hey Jennifer,
I do not need to send this one to EPA; we send isolated wetlands and nexus calls to EPA.
Based on my site visit and the additional information provided by Austin it is my intention to determine the pond to be
constructed within uplands. If you include me on the courtesy copy of the application I will work to issue the JD during
NCDWRs timeframe.

Attached is the buffer determination that was issued today.
Item #3:
1 revised the overall impact map to correct the pond number. The isolated pond is the only impact on the site.

Hi Jennifer,
I have started my review of the above referenced project and I have a few questions:
• Can you please provide the updated information, referred to in the application, from the USACE regarding the
jurisdictional calls, especially for Pond 2 that is proposed to be impacted (01) and the wetland/stream along the
same crenulation?
• Can you please provide a copy of the buffer determination letter for the site (potentially #22-423). Pond 2 is
shown on the USGS topo map and shown as a stream channel on the soil survey map. We will need confirmation
of buffers before moving forward with the review.
• The impact map found on page 20 has a "call out box' stating the name of the pond as Pond 1, other impact
maps appear to show it as Pond 2. Can you please confirm that this is Pond 2 and that it may have been labeled
in error? If so, please make sure to update this map to reflect the correct name.

Pending the outcome of the Corps site visit and the buffer determination, are the proposed impacts of 0.724
acres of fill to Pond 2 still the only impacts for this project?
