Tyson,
On November 28, 2022, the Division of Water Resources (Division) received your application requesting a 401 Water
Quality Certification from the Division for the subject project. The Division has determined that your application is
incomplete and cannot be processed. The application is on -hold until all of the following information is received:
1. Please copy the Division on your response to the Corps questions below. [15A NCAC 02 .0506(b)(1)]
2. Please provide a map that shows building envelopes for all lots with streams or wetlands as well as all
stormwater control measures. [15A NCAC 02H .0502]
3. It appears stream impact S1 could be avoided by connecting the water line along the southern access road
directly to the water main along Haywood Road. Please revise the plans to avoid this impact or explain why it
cannot be practically avoided. [15A NCAC 02H .0506(b)(2)]
Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the
proper consideration of the application. Please provide your response by January 6, 2023. If all of the requested
information is not received, the Division will be unable to approve the application and it will be denied as incomplete.
The denial of this project will necessitate reapplication to the Division for approval, including a complete application
package and appropriate fee.

Hi Tyson,
I am going through the submittal and have the following questions/comments:
1. It appears that no avoidance and minimization measures have been taken into account with regard to the
wetlands onsite. You stated that the development design has not changed since the original submittal;
however, the onsite wetlands have. Please advise.
2. Please explain why the access roads cannot be shifted to avoid some of the wetland areas.
3. This design does not show the layout for the residences. Will the wetlands along the western portion of the
property be protected from impacts? If so, how? If not, please include those impacts in this submittal.
FYI -I am just waiting on our HQ folks to respond about the AJD, then I will get it out to you. Let me know if you have any
questions.
