Catfish Pond II Bank Parcel Credit Release — Task 5
Dear Mr. Wilkerson:
On October 18, 2022, the Division of Water Resources (DWR) received a Year 2 Monitoring Report
from Wildlands Holdings V, LLC (Wildlands) for the Catfish Pond II site. Overall, site conditions
appear to look good and no encroachment within the conservation easement areas was observed.
DWR received a bond rider and continuation certificate for the performance bond (# 107414675) in
the amount of $60,000 issued to Wildlands from Travelers Casualty and Surety Company of
America, to cover monitoring and maintenance at the subject site. The term of this bond ends with
DWR approval of the Year 3 Monitoring Report. Future credit releases will be dependent on both
the renewal of this performance bond and the annual monitoring reports.
In accordance with the MBI, signed on September 14, 2020, the following Project Milestones have
been met and the corresponding credits shall be released:

By copy of this correspondence, DWR confirms that you have satisfied the above requirements for
the above -referenced tract and therefore the following credits are being released:
• 10% of the Neuse buffer Restoration credits (0.10 x 342,834 ft2 = 34,283.400 ft2) are
available to sell.
• 10% of the Neuse buffer Enhancement via Cattle Exclusion credits (0.10 x 52,041.411 ft2 =
5,204.141 ft2) are now available to sell.
• 10% of the Nitrogen nutrient offset credits (0.10 x 43,287.706 lb-N = 4,328.771 lb-N) are
now available to sell.
• 10% of the Phosphorus nutrient offset credits (0.10 x 2,788.063 lb-P = 278.806 lb-P) are
now available to sell.

Please note that nutrient offset credits generated at this site must be used for impacts in HUC
03020201 of the Upper and Lower Falls Watersheds within the Neuse River Basin pursuant to
15A NCAC 02B .0703 which became effective on April 1, 2020. Additionally, the riparian
buffer credits must be used for authorized impacts in the Neuse River Basin according to
guidelines in the Consolidated Buffer Mitigation Rule, 15A NCAC 02B .0295, which became
effective on November 1, 2015.
