Division personnel have reviewed and approved your application for modification
of the subject permit. Accordingly, we are forwarding the attached NPDES discharge
pemlit. This permit is issued pursuant to the requirements of North Carolina General
Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the
U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended.)
The following modifications have been made to the permit based on the proposed
relocation to a stream with a higher estimated 7Q10 flow:
The inclusion of an additional effluent page with limitations for the proposed
discharge to Buckeye Creek. Most effluent limitations and monitoring will
remain unchanged, modification for NH3 are as follows:
1) Until the outfall pipe is relocated to Buckeye Creek, summer and winter NH3
toxicity limits of 2 mg/I and 4 mg/l, respectively, will remain in the permit.
2) Upon relocation of the outfall pipe to Buckeye Creek, a summer (April 1
through October 31) NH3 toxicity limit of 11 mg/1 will be applied. In the
winter months (November 1 through March 31), only effluent monitoring for
NH3 will be required.
Due to limited accessibility and safety issues, DWQ concurs with the permittee's
request to allow effluent sampling at the effluent pump station rather than at the
end of the outfall pipe.
If any parts, measurement frequencies or sampling requirements contained in this
permit are unacceptable to you, you have the right to an adjudicatory hearing upon written
request within thirty (30) days following receipt of this letter. This request must be in the
form of a written petition, conforming to Chapter 150B of the North Carolina General
Statutes, and filed with the office of Administrative Hearings, 6714 Mail Service Center,

2. After receiving an Authorization to Construct from the Division of Water Quality,
relocate the outfall and discharge from said treatment works at the location
specified on the attached map directly to the Buckeye Creek, which is classified C
Trout waters in the Watauga River Basin. Until receipt of the Authorization to
Construct permit, continue to

This letter is submitted on behalf of the Town of Beech Mountain in regards to the proposed NPDES permit
modification of the above referenced facility. Davis -Martin -Powell has been retained by the Town to provide
:engineering services related to the above this project. We have reviewed the draft permit and have the
following comments:
1. Discharge Location - The location map issued is unclear as to the actual location. It is our
understanding that the relocated discharge location will be into Buckeye Creek at the confluence of
Grassy Gap Creek, based on your speculative limits letter dated January 28, 2001,
2. Sampling — It is noted that the proposed discharge point will be located remotely from the WWTP site, in
an area of limited accessibility. The effluent will be pumped from the WWTP site through a forcemain to
the new discharge point. It is planned to not provide vehicular access to the effluent point to minimize
adverse environmental impacts along the forcemain route. During winter months, accumulations of
snow and ice could create hazardous conditions for the Operators trying to access the effluent point. It
is requested to allow the effluent samples to be taken at the effluent pump station, which will be located
at the WWTP site.

2 SUMMARY OF FACILITY AND WASTELOAD ALLOCATION
Town of Beech Mountain is requesting modification of existing NPDES permit for relocation of
outfall from Grassy Gap Creek to Buckeye Creek. Per Compliance Enforcement Unit, Beech
Mountain is under a statute moratorium that has been imposed for sewer line extensions since
,*a, 1g1 z000.pelebeF 2000. They have had a number of fines since 1998 totaling approximately $32,000 for
permit violations and the Town has paid them all. They have not requested an SOC for flow.
Evidently, the Town constructed sewer lines in the late 70's and 80's in the mountains
surrounding the town, but they don't have a handle on all the extensions so there are serious
inflow and infiltration problems. Winter months show flgwzxceedances because it is the most

Per 10/ 16/01 telecon with WSRO, Beech Mountain under moratorium due to I&I problems and
can't accept any additional flow at either of the WWTPs. The Town has completed engineering
studies, mapped the collection system, know the cause of the problem and how to fix, but have
not submitted a schedule for how they will repair. (The collection system was built in the
1960's, due to the severe topography, the sewer pipe was laid incorrectly, some has been
damaged, some manholes have been covered over the years.)

tD subrwiiied. WSRO does not oppose the relocation of the outfall for helping with NH3
problems. If it will help Beech Mountain with compliance problems, WSRO agrees with the
action. WSRO will continue to use the moratorium to deal with the flow issue, so the
permit does not address it.
Facility is having trouble meeting stringent NH3 limits of 2 mg/1 (summer) and 4 mg/1 (winter).
In January 2001, requested speculative limits for NH3 if facility relocated its outfall to a larger
stream. Upon relocation, summer NH3 limits would be 11 mg/l with no limit in the winter
months. If facility does not relocate, then NH3 toxicity limits of 2 mg/1 in the summer
and 4 mg/1 in the winter will remain in the permit.
A Level B model was run at the new location in Buckeye Creek for verification that secondary
BOD5 limits and NH3 toxicity limits would protect for the DO standard of 6 mg/1 in the trout
stream. Model predicted that a DO minimum of 7.16 mg/1 would occur in Buckeye Creek.

January through August 2001, Avg. Qw = 0. 0778 MGD (approximately 97"/• of capacity),
BOD5=8.01 mg/l, NH3=1.42 mg/l, TSS=10.5 mg/l, TN=2.7 mg/ and TP=0.67 mg/l. Facility
had 4 flow violations, 1 NH3 violation, and 2 fecal coliform violations from January to August
2001.
In 2000, Avg. Qw = 0.0467 MGD (approximately 58% of capacity), BOD5=7.75 mg/l, NH3=1.95
mg/1, TSS=13.3 mg/l, TN=10.2 mg/ and TP=2.29 mg/l. Facility had 3 flow violations, 1 TSS
violation, 4 NH3 violations, 1 fecal coliform violation and 3 pH violations in 2000.
In 1999, Avg. Qw = 0.0593 MGD (approximately 74% of capacity), BODS=15.39 mg/l,
NH3=2.46 mg/l, TSS=32.7 mg/l, TN=13.6 mg/ and TP=4.95 mg/l. Facility had 1 BOD5
violation, 1 TSS violation, 5 NH3 violations, and 1 fecal coliform violation in 1999.
In 1998, Avg. Qw = 0.072MGD (approximately 90% of capacity), BOD5=19.9 mg/l,
NH3=5.08 mg/l, TSS=8.6 mg/1, TN=16.3 mg/ and TP=3.87 mg/1. Facility had 7 flow violations,
3 BOD5 violations, 1 TSS violation and 4 NH3 violations in 1998.

PROPOSED CHANGES:
The following modifications have been made to the permit:
• Combining the two existing effluent pages for discharge to Grassy Gap Creek
• Addition of an effluent page for relocation to Buckeye Creek, summer NH3 limit of 11

I'm writing to request a modification to the NPDES permit for the Grassy Gap Creek
Wastewater Treatment Plant in Beech Mountain (permit # NC0022730). As you may
know, the Town had requested your office to examine speculative limits for NH3 if the
effluent discharge pipe were relocated downstream. Based upon the information
presented in the January 28"' letter from Jacquelyn Nowell, the Town wishes to proceed
with permit modification.
Enclosed is a check for the $215.00 fee. Please let me know if I can provide any
additional information.
