Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: * The Site is undeveloped and consists primarily of planted row pine and undisturbed forested areas. The tree canopy consists of mature pines in the upland areas and hardwood trees dominate the drainages. The topography of the Site ranges from a high point of +/- 460 feet above mean sea level (msl) in the northwestern corner of the Site to +/- 400 feet above msl on the southern boundary. The surrounding properties are mostly single-family residences and undeveloped, wooded land. 4b. Explain the purpose of the proposed project:* The purpose is to construct a residential subdivision. Driveways, sidewalks, and roads will be constructed to access multiple parts of the property. Impacts to jurisdictional streams will result from a roadway crossing to provide inter -connectivity. Impact to riparian buffers will result from a greenway trail that provides pedestrian access to a section of the development that is bounded by two drainages. 4i. Describe the overall project in detail, including indirect impacts and the type of equipment to be used:* The proposed project will cross stream SD with a culvert crossing. Temporary coffer dams are to be installed on the upstream and downstream portions of the stream channel to allow for the road crossing and culvert construction to be completed in dry conditions. Existing stream channel shall be pumped around the proposed road crossing during construction. Upon completion of the road crossing, the coffer dams will be removed and the stream will be restored to its original dimensions. A pedestrian, 10-foot wide wooden boardwalk will be constructed to perpendicularly cross Stream SA. The piers for the boardwalk will be located outside the steam banks. Typical construction activities and clearing of the area will be utilized to cross the stream. No permanent or temporary impacts are expected for this crossing, just buffer impacts. Grading, earthwork, and typical construction activities will be utilized in the road construction and proposed stream crossings. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: The property contains five streams and four wetlands that are located throughout the Site. The proposed residential subdivision has been designed to avoid the majority of features on Site. Access to the site will be from Sid Mitchell Road which requires a stream crossing to gain access to the northern portion of the Site and provide for inter -connectivity required by the municipality. Unavoidable buffer impacts are necessary for the proposed stream and buffer impacts due to site constraints and lot size requirements. The greenway trail is required by the municipality to provide pedestrian access around the development. lb. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: Construction equipment including heavy machinery and hand clearing machinery will need to be utilized to install the culvert, boardwalk crossings, and removal of vegetation in Zone 2. Construction fencing will be used to define the construction corridor and prevent any accidental additional impacts. Silt fencing will be installed to provide additional protection from stormwater runoff. 2. Compensatory Mitigation for Impacts to Waters of the U.S. or Waters of the State 2a. The Site is +/- 89-acres and is located south of the intersection of Sid Mitchel Road and Green Road in Franklin County, NC. The coordinates of 36.0345°N, 78.5317°W generally correspond to the center of the Site. Protect Detail The proposed Project consists of the construction of a residential development with associated utilities and roads. Homes will be on individual septic systems and will tie into existing public water systems. Access to the Site will be provided via Sid Mitchell Road. Heavy equipment typically used for utility installation projects (e.g., backhoes, bulldozers, etc.) will be utilized. No federally threatened or endangered species are listed to occur on the Site according to the NC Natural Heritage Program (NCNHP) Database. (See attached report dated December 10, 2021). The Site itself is not listed as a historic property or within a historic district. Two historic properties are listed within 1.0 mile of the Site. Avoidance and Minimization The proposed stream crossing, boardwalk crossing, and buffer impacts are aligned to cross the channels as perpendicularly as possible. Riparian buffer impacts in Zone 2 for the stormwater conveyance were minimized to the maximum extent practicable. Streams are not crossed multiple times by roads. Lots were positioned to avoid Greenpointe Subdivision Page 1 of 2 additional fill in wetlands and streams. Construction fencing will be used to define the construction corridor and prevent any accidental additional impacts. Silt fencing will be installed to provide additional protection from stormwater runoff. General techniques include the use of construction fencing to define the construction corridor and prevent any accidental additional impacts. Silt fencing and sediment basins will also be used to prevent sediment runoff into the stream and wetland areas. Protect Impacts Impact 1 is a proposed road crossing at Stream SD and will result in 123 linear feet of permanent stream impact, 19 linear feet of temporary stream impact associated with culvert crossing. At this crossing, buffer impacts were unavoidable. Zone 1 will be impacted 8,610 SF and Zone 2 will be impacted 4,406 SF. Impact 2 is a proposed boardwalk crossing and will result in 1,383 SF of Zone 1 impact and 875 SF of Zone 2 impact. Lastly, along Stream SC, buffer Zone 2 will be impacted 813 SF for grading and maintenance of a stormwater conveyance to an SCM. If "Breeds elsewhere" is indicated, then the bird likely does not breed in your project area. What are the levels of concern for migratory birds? Migratory birds delivered through IPaC fall into the following distinct categories of concern: 1. "BCC Rangewide" birds are Birds of Conservation Concern (BCC) that are of concern throughout their range anywhere within the USA (including Hawaii, the Pacific Islands, Puerto Rico, and the Virgin Islands); 2. "BCC - BCR" birds are BCCs that are of concern only in particular Bird Conservation Regions (BCRs) in the continental USA; and 3. If your project has the potential to disturb or kill eagles, you may need to obtain a permit to avoid violating the Eagle Act should such impacts occur. Proper Interpretation and Use of Your Migratory Bird Report The migratory bird list generated is not a list of all birds in your project area, only a subset of birds of priority concern. The maps are prepared from the analysis of high altitude imagery. Wetlands are identified based on vegetation, visible hydrology and geography. A margin of error is inherent in the use of imagery; thus, detailed on -the -ground inspection of any particular site may result in revision of the wetland boundaries or classification established through image analysis. The accuracy of image interpretation depends on the quality of the imagery, the experience of the image analysts, the amount and quality of the collateral data and the amount of ground truth verification work conducted. Metadata should be consulted to determine the date of the source imagery used and any mapping problems. Wetlands or other mapped features may have changed since the date of the imagery or field work. There may be occasional differences in polygon boundaries or classifications between the information depicted on the map and the actual conditions on site. Data exclusions Certain wetland habitats are excluded from the National mapping program because of the limitations of aerial 4 imagery as the primary data source used to detect wetlands. These habitats include seagrasses or submerged aquatic vegetation that are found in the intertidal and subtidal zones of estuaries and nearshore coastal waters. Some deepwater reef communities (coral or tuberficid worm reefs) have also been excluded from the inventory. These habitats, because of their depth, go undetected by aerial imagery. Data precautions Federal, state, and local regulatory agencies with jurisdiction over wetlands may define and describe wetlands in a different manner than that used in this inventory. There is no attempt, in either the design or products of this inventory, to define the limits of proprietary jurisdiction of any Federal, state, or local government or to establish the geographical scope of the regulatory programs of government agencies.
