Environmental Quality February 15, 2021 CERTIFIED MAIL RETURN RECEIPT REQUESTED 7020 0090 0001 7206 9405 Mr. Chad Hazelwood 11474 Old Mintz Hwy Garland NC 28441 Subject: NOTICE OF VIOLATION/NOTICE OF INTENT Administrative Code 15A NCAC 2T .1304 NOV-202 1 -DV-0094 Hazelwood Family Farm Facility Number 09-146 Permit AWS090146 Bladen County - Dear Mr. Hazelwood: On January 4, 2021, staff of the NC Department of Environmental Quality (DEQ) Division of Water Resources (DWR), Water Quality Regional Operations Section (WQROS) inspected the Hazelwood Family Farm and the permitted waste disposal system. We wish to thank Mr. Curtis Barwick for reporting the non -compliant lagoons and Mr. Hazelwood for your assistance during the inspection. As a result of this inspection, you are hereby notified that, having been permitted to have a non - discharge permit for the subject animal waste disposal system pursuant to 15A NCAC 2T .1304, you have been found to be in violation of your permit as follows: Violation 1: Failure to prevent discharge of waste to surface waters or wetlands. N.C.G.S. 143-215.10C - (Permit No. AWG100000 Section Conditions I 1). On January 4, 2021, Curtis Barwick notified DWR that you had reported to him you had two lagoons that were non -compliant. DWR staff arrived on the farm and confirmed that your two lagoon were non- vew�nvnioin.i�ii�m�iu,mm�. DWR staff observed past discharges of waste from house #1 (one) which was discussed during your routine compliance inspection in October 2020. Seeing that you had issues at house #1, DWR staff inspected house #2 (two) and found a high volume of waste flowing from under the back door onto the ground behind the house. Waste continued to collect in a large area inside the wooded area next to the house, and some waste flowed into a ditch leading from behind the house. Your lift station was full and needed the waste transferred to lagoon 2, and by the pit being full, waste was forced to flow out of the house. Required Corrective Action for Violation 1: Stop the flow of waste from the house and contain waste that has flowed out as discussed the day of the inspection. The waste must be cleaned up behind house two (2), and take all necessary steps prevent this from happening again. Violation 2: Failure to maintain the maximum waste level in lagoons/storage ponds that shall not exceed that specified in the facility's CAWMP. At a minimum, maximum waste level for lagoons/storage ponds must not exceed the level that provides adequate storage to contain the 25-year, 24-hour storm event plus an additional one (1) foot of structural freeboard except that there shall be no violation of this condition if: a. there is a storm event more severe than a 25-year, 24-hour event; b. the Permittee is in compliance with its CAWMP and c. there is at least one (1) foot of structural freeboard. — [15A NCAC 02T .1304(b)]. (Permit No. AWG100000 Section V2) On January 4, 2021, DWR staff was contacted by Mr. Curtis Barwick that your lagoon levels were out of compliance at both lagoons. DWR staff inspected your facility that day and documented with pictures your lagoon level was twelve (12) inches and eight (8) inches based on your markers. DWR staff surveyed your lagoons and documented they were eight (8) and three (3) inches based on how we measure lagoon levels. Page 3 Chad Hazelwood February 15, 2021 Required Corrective Action for Violation 2: Follow 5-day plan of actions provided to the DWR. Take all necessary additional steps to insure lagoon levels remain in compliance with Section (V2) of your permit. Violation 3: The Permittee shall report by telephone to the appropriate Division Regional Office as soon as possible, but in no case more than twenty-four (24) hours following first knowledge of the occurrence of any of the following events: e. Failure to maintain storage capacity in a lagoon/storage pond greater than or equal to that required in Condition V. 2. of this General Permit. (Permit AWG No.100000 Section 17 e). Your permit specifically requires notification by telephone within 24 hours and a written report within 5 calendar days following first knowledge of the occurrence of a reportable permit condition. DWR has no record of receiving the 24-hour notification and the 5-day written report. Reporting to your Integrator does not meet the Permit condition requirements and they are not obligated to report for you. The DWR has no record of you reporting non -compliant lagoon levels prior to January 4, 2021. Required Corrective action for Violation 3: In the event of a high freeboard situation, call the regional office within twenty-four (24) hours of the first knowledge of the high freeboard. Prepare and submit within 48 hours a 30 day a Plan of Action (PGA) for lowering the lagoon/storage pond to an acceptable level as described in your CAWMP and General Permit. Violation 4: The Permittee shall report by telephone to the appropriate Division Regional Office as soon as possible, but in no case more than twenty-four (24) hours following first knowledge of the occurrence of any of the following events: Page 4 Chad Hazelwood February 15,2021 f. Failure to maintain waste level in a lagoon/storage pond below that of the designed structural freeboard (twelve (12) inches from top of dam or as specified in lagoon/storage pond design) Note that this notification is in addition to the report required by Condition III 17 e. Your permit specifically requires notification by telephone within 24 hours and a written report within 5 calendar days following first knowledge of the occurrence of a reportable permit condition. On January 4, 2021 DWR had no knowledge that either of your lagoons were less than 12 inches. The levels were documented with pictures and survey of your lagoon levels. Required Corrective Action for Violation 4: In the event of your lagoon level reaching the structure (twelve (12) inches or less, call the regional office within twenty-four (24) hours of the first knowledge of the high. freeboard. Prepare and submit within 24 hours a 5 day a Plan of Action (POA) for lowering the lagoon/storage pond to anacceptable level as described in your CAWMP and General Permit. Violation 5: Failure to properly operate and maintain at all times the collection, treatment, and storage facilities, and the land application equipment and fields. On January 4, 2021 during the structural evaluation inspection, waste was observed coming from house #2. This was caused by waste backed up in the house due to waste in the lift station not being pumped to the lagoon. During your October 2020 Routine Compliance inspection, it was noted that the lift stations at both housed showed signs of past discharges of waste on the ground next to them. You were advised to maintain the lift stations as designed to prevent this from happening again. Required Corrective Action for Violation 5: In the future, if you cannot manually pump the lift stations in a timely manner to prevent overflow, install float activated pumps. Provide training for your employees concerning the proper operation and maintenance of this waste collection, treatment, storage and application system operated under this General Permit. Page 5 Chad Hazelwood February 15, 2021 The Division of Water Resources requests that, in addition to the specified corrective action above, please submit the following items on or before (March 15, 2021): 1. An explanation from the OIC for this farm regarding how these violations occurred. 2. A list from the OIC concerning the steps that will be taken to prevent these violations from occurring in the future. 3. Provide a copy of your lagoon levels with rainfall for 2020 up to present date. 4. Provide a copy of your IRR 1 and IRR 2 forms for 2020 up to present date. You are required to take any necessary action to correct the above violations on or before March 15, 2021 and to provide a written response to this Notice by March 15, 2021. Please include in your response all corrective actions already taken and a schedule for completion of any corrective actions not addressed. - As a result of the violations in this Notice, this office is considering a recommendation for a civil penalty assessment to the Director of the Division. If you wish to present an explanation for the violations cited, or if you believe there are other factors, which should be considered, please send such information to me in writing within ten (10) days following receipt of this letter. Your response will be reviewed, and, if an enforcement action is still deemed appropriate, it will be forwarded to the Director and included for consideration. Failure to comply with conditions in a permit may result in a recommendation of enforcement action, to the Director of the Division of Water Quality who may issue a civil penalty assessment of not more that twenty-five thousand ($25,000) dollars against any "person" who violates or fails to act in accordance with the terms, conditions, or requirements of a permit under authority of G.S. 143-215.6A. Violation 1: Failure to prevent discharge of waste to surface waters or wetlands. I did not realize that waste was flowing from house #2. After Steve brought it to my attention I scraped up as much waste as I could and pumped it to the lagoon. I cleaned up the waste on the ground and pumped waste out of the ditch with a gasoline pump and back into the lagoon for 5 hours. I plan to build berms around the lift stations to keep this was occurring in the future. Violation 2: Failure to maintain the maximum waste level in lagoons that shall not exceed that specified in the CAWMP. I followed the 5-day Plan of Action to land apply waste in an appropriate way in regards to the permit. We have had a tremendous amount of rain over the past 14 months that has proved difficult to manage at times. Violation 3: Failure to report by telephone to the appropriate Division Regional Office, within 24 hrs., storage capacity greater than required in the permit. I will make certain that I notify your staff as soon as or within 24 hrs. of first knowledge of having less than the required storage capacity. Violation 4: Failure to report by telephone to the appropriate Division Regional Office, within 24 hrs. of failure to maintain the waste level below structural freeboard. Lagoon #2 reached a level less than 12" over New Year's weekend and I assumed no one would be available to notify so I asked Curtis Barwick to contact your staff on the following Monday, January 4th. I was under the impression from my markers that only lagoon #2 was less than the structural freeboard required. Barwick submitted a 5 Day POA. Violation 5: Failure to operate and maintain at all times your waste collection system in accordance with the permit and CAWMP. I am adding a berm around my lift stations to contain any waste that may overflow due to an equipment failure. I plan to pump out my pits more frequently and am researching float systems as well as larger capacity pumps to use in my lift stations. I will make certain to notify your office immediately in the event of non -compliant freeboard or waste discharge from any system component. I also will make certain the lift stations are operating properly. Please see the provided irrigation, freeboard and rainfall levels, as requested. The dimensions of the lagoon as measured and the side slope are needed for calculations of sludge volume and of total treatment volume. If the lagoon is a standard geometric shape, the sludge volume and the treatment volume in the lagoon can be estimated by using standard equations. For approximate volumes of rectangular lagoons with constant side slope, calculate length and width at the midpoint of the layer, and multiply by layer thickness to calculate layer volume, as shown in the example. For irregular shapes, convert the total surface area to a square or rectangular shape. For exact volumes for lagoons with constant side slope, the "Prismoidal Equations" may be used.
